Revision of the effective date for some clients’ in-home personal care hour/New Freedom budget reductions due to the elimination of add-on hours for off-site laundry and living more than 45 minutes from essential services
Purpose: / To advise staff that there was an error in the notification process for some clients receiving a change in their in-home personal care hours/budgets related to add-on hours for off-site laundry and/or living more than 45 minutes from essential services. The effective date for the change was February 1, 2012. Clients who were not mailed the notification in time for the February 1st effective date will have the change implemented on March 1, 2012.Background: / The Aging and Disability Services Administration (ADSA) reduced in-home personal care hours for clients of all ages through Emergency Rule Making authority which revised WAC 388-106-0130. The reduction, affecting about 9,000 clients, is related to hours that are added on to CARE assessments
due to off-site laundry and/or living more than 45 minutes from essential services.
This CARE Change Control Release occurred on Tuesday, January 31, 2012 starting at 5:35 pm. CARE users received the new version when they logged into CARE anytime after 8:00 pm on Tuesday.

There was an error in the notification process for clients who have a language other than English or Braille identified in CARE. Because the 10-day notice period was not met, the change in their hours or budget will not take effect until March 1, 2012.
Individual Providers and Agency Providers were notified of the change in hours for all the impacted client(s) they serve. A notice was sent out to them the week of January 16, 2012, alerting them that the client(s) they serve would have a change in the number of personal care hours authorized effective February 1, 2012. Because the clients in the “mailing error” group were not notified of the change, new letters will be sent to providers the week of February 13th informing them of the delay in the effective date to March 1, 2012.
Each Region/PSA received the data used to populate the letters via email on January 13, 2012. This data is still current and will be used to populate the letters with the effective date of March 1, 2012. Use this list to respond to questions and inquiries. If the client has a pending assessment, follow the instructions outlined in the “Handling Pending Assessments” attachment, below.

As noted in MB H12-008, there are no appeal rights for this change through the Office of Administrative Hearings because this is a service change that applies to every client who has been authorized to receive additional personal care hours because he or she uses off-site laundry and/or lives more than 45 minutes from essential services.
Written Notifications
Letters will be mailed using an automated process to clients, guardians, providers and Necessary Supplemental Accommodation (NSA) representatives statewide. Exceptions to this are outlined in the Action section below.
Client and NSA Rep Letter – Clients and NSA reps will receive written notification of this change to personal care hours which also serves as an amendment to the plan of care. Notices will be mailed the week of February 13, 2012. Notices will include specific information regarding the client’s:
· Current hours/budget (including ETR hours) as of January 6, 2012;
· New hours/budget as of March 1, 2012; and
· Total reduction of hours/budget.
Clients will be sent letters in both English and their primary language.
IP Letter - Individual Provider letters will also be mailed the week of February 13, 2012. The letter will inform each provider of the delayed effective date, for the client listed in the letter, the authorized hours as of January 6th, the authorized hours as of March 1, 2012, and the number of hours reduced. The IP will receive a letter for each client that he/she serves.
Agency Notification - Home Care Agencies (HCAs) have received a notification email from HQ with an attached list of the clients that will have a delayed effective date of March 1, 2012 and data similar to what the IPs will receive.
Transaction Generator SSPS will run a second Transaction Generator (TG) to reduce the number of authorized hours for clients whose current CARE generated hours and authorized SSPS hours match. The data will be captured from CARE on Friday, March 2, 2012 and the TG will run on Saturday, March 10, 2012. There will be an exception report generated from the TG. It will be sent to field staff on Wednesday, March 14th, and will list all of the authorizations that weren’t included in the TG.
A March CARE Change Control Release will occur on Wednesday, February 29, 2012 starting at 5:35 pm to update PCRC and CARE Results forms. CARE users will receive the new version when they log into CARE anytime after 8:00 pm on Wednesday. Based on standard CARE functionality Long Term Care (LTC) assessments will reflect the new care hours automatically.
CARE was updated on January 31st for all clients impacted by this reduction. This means that the CARE assessments for the individuals receiving the March 1st reduction will not match SSPS hours in February. (For New Freedom this means any agency hours were reduced to zero.)
DDD Case managers will need to check in DDD assessments and wait for approximately 5 minutes to see the updated personal care hours in the ISP.
DDD Case managers will need to work with their MPC Coordinator to populate the letters when a child’s family has requested maximum base hours.
Letter Exception List: Regions/PSAs will receive an exception list by Friday, February 10, 2012. These clients (except for clients enrolled in WMIP or PACE) will need letters generated from the local office using the attached English template and data from the exception list. The English version of the letter needs to be mailed by close of business Friday, February 17th. For Limited English Proficient (LEP) clients, email Patty McDonald at: to request translated templates and provide her with the language needed.
Letters also need to be sent to providers. The template for the IP letter is attached. If local offices identify home care agency clients on an exception list, field staff will need to notify the HCAs of the reductions. Notifications should be made by close of business February 17, 2012.
HCS/AAA clients who use their total personal care hours for Adult Day Care, Home Health Aide or Home Delivered Meals will not appear on any of the lists because they do not have a current authorization for personal care services. They will not be included on the mass mailing/TG list or the mismatch/exception list. If you have a client who does not have English or Braille as their primary language and uses all of their hours for ADC, HHA or HDM you will need to send the letter to the client and the provider by close of business February 17, 2012 and adjust the SSPS authorization manually. If you need assistance ask your supervisor, HCS/AAA JRP.
TG exception list: Regions/PSAs will receive an exception list on Wednesday, March 14, 2012. These clients (except for clients enrolled in WMIP or PACE) will need their SSPS/CASIS authorizations adjusted manually. Field staff will have until the March 20th SSPS Deadline Date to manually change authorizations.
Personal Care Results Comparison Form (PCRC) and CARE Results
The PCRC and CARE Results forms have been updated to reflect the changes made to add-on hour adjustments.
