Special Council Meeting

July 25, 2005

Mayor Guy called the special meeting to order at 12:00 p.m. Councilman Fowler gave the invocation and Councilman Curley led the Pledge of Allegiance. Also present for the meeting were Councilmen Helms and Medlin, Town Attorney Lanier, Finance Director Jane Kirk, and Town Clerk Patricia Arnold. Mayor Pro Tem Albury was absent from this meeting.

Public Hearing

Mayor Guy recessed the special council meeting at 12:12 P.M. to open the public hearing for comment on Installment Financing Agreement for the Local Government Commission.

Attorney Charles Lanier stated that on Addendum A under Deed of Trust the requirements stated “shall be secured by a first lien deed of trust”, and that the Community Center property, and 300,000 gallon water tank property would be a first lien deed of trust but that the Water Treatment Plant/Well #5/500,000 gallon water tank property is already under a lien with BB&T making this deed of trust a second lien.

With no public comment the Public Hearing was closed at 12:13 P.M.

Councilman Helms made the motion to approve the installment financing agreement for the Local Government Commission. Councilman Medlin seconded motion. Motion carried unanimously with Mayor Pro Tem Albury’s proxy vote being affirmative.

House Moving

Mayor Guy stated that Inspector Padgett had presented a request to move a house from 2216 S. Shore Drive on Sunday July 31, 2005 at 6:00 a.m. With the concern of safety during a hurricane the applicant is asking if they can move the house on the designated day.

Inspector Padgett stated that the applicant had received a permit in April and the owner has removed the house from the pilings and it is still resting on the ground.

Councilman Fowler made the motion to approve the request for moving a house from 2216 S. Shore Drive on Sunday 7-31-05 at 6:00 a.m. Councilman Helms seconded motion and motion was carried unanimously.

Use of Beach for movie production

Finance Director/Acting Manager Jane Kirk stated that the moving company for “One Tree Hill” has asked to use a section of the beach for three days straight to do some filming this week. She is recommending not allowing the use of the beach for there is not a section of the beach that is not occupied by visitors and homeowners.

Councilman Helms made the motion to not approve the request for the beach for movie production. Councilman Medlin seconded motion and motion was carried unanimously.

Adjournment

There being no further business the meeting was adjourned at 12:22 p.m. upon the motion by Councilman Fowler and seconded by Councilman Medlin. The Council unanimously approved motion.
