INSTRUCTIONS & REQUIREMENTS FOR UAS/DRONE USE

THE FOLLOWING ITEMS SHOULD BE COMPLETED AND SENT TO THE RISK MANAGEMENT DEPARTMENT FOR APPROVAL PRIOR TO THE USE OF THE UAS/DRONE.

Completed Non-owned UAS Questionnaire (attached)

A valid CERTIFICATE OF INSURANCE must be obtained from the UAS Operator and it should:

  • Name the company, officers, directors, employees, agents and subsidiaries as additional insureds,
  • Must show ALL AIRCRAFT SCHEDULED TO THE POLICY AND EACH AIRCRAFT MUST BE IDENTIFIED BEFORE USE.
  • Provide waiver of subrogation wording as respects damage to the aircraft hull in favor of all the aforementioned additional insureds in addition to the operator contractually providing the same. If hull coverage is not carried, then the operator must agree contractually to waive all rights of subrogation.
  • State that the UAS Operator’s policy is primary and non-contributory from any other insurance available to the Additional Insured.
  • Provide UAS/DRone liability limits of at least $2,000,000, including all risks of ground and flight.
  • Provide a statement confirming that the noted policies provide coverage (without any exceptions) for the UAS activities described in the contract for hire.
  • Provide a thirty (30) day written notice of cancellation or adverse material change in coverage
  • Include an invalidation clause stating that coverage shall not be invalidated to the production company for any acts, omissions or failure to act on the part of the UAS/Drone operator.
  • Include contractual liability, personal injury coverage and premises liability in addition to primary coverage’s.
  • Include the location where the work is performed as an approved territory or coverage must be worldwide.

The UAS Operatormust confirm that the pilot is approved and covered under the UASoperator’s policy and provide evidence of Worker’s Compensation including a waiver of subrogation in favor of the Additional Insured.

Copy of the agreement between UAS Operator and theCompany must be attached and provided to the the Risk Management department.

UNDER NO CIRCUMSTANCES SHOULD THE PRODUCTION COMPANY OR CLIENT EMPLOY THE PILOT DIRECTLY OR ALLOW ANY OF ITS OWN EMPLOYEES TO PILOT THE AIRCRAFT.

Whenever a UAS/Drone is hired, we will have to arrange Non-OwnedUAS Liability coverage protecting against liability for bodily injury and property damage to third parties arising out of the use of UAS. In order for us to arrange this coverage, we will need the following information for each individual aircraft/UAS/Droneat least five business days prior to use:

The Aircraft Owner must provide the Additional Insured with a Certificate of Insurance evidencing UAS Liability and Hull Physical Damage and naming the Company as Additional Insured.
Provide a copy of the Hold Harmless Agreement and Waiver of Subrogation from the owner of the aircraft in favor of the Additional Insured along with a copy of the agreement between the Company and UAS Operator.
