“PROBLEM CHECKS”

Should a check fail to clear our bankfor any reason, a fee of $20+0 will be imposed upon THECUSTOMER NOT THE MAKER and the returned check must be made good within 24hours of notice to the Customer by the LLC via telephone, fax oremail.The Customer agrees to assign their vendor checks to East End Liquidity Solutions, LLCand fully understands that the LLC will receive any and all benefits as relates to thecheck.

The Customer agrees to indemnify and hold harmless East End Liquidity Solutions, LLCfrom any costs, claims and penalties assessed to any Member including, but not limitedto, legal fees resulting from any benefit received by the LLC as relates to the check.

YOUR RIGHT TO PRIVACY:

Any and all information provided by you to East End Liquidity Solutions, LLC is heldin the strictest of confidence as provided by The Bank Secrecy Act. No information willbe shared with anyone or with any entity, including other banking institutions, Local,State or Federal agencies unless required to do so by law. The Customer understands thatthe service provided is not be used for any purpose(s) prohibited under Local, State orFederal law.

PERSONAL GUARANTEE

The Customer, who will also be known as “The Guarantor”, fully understands that theycompletely guarantee all payments of dishonored instruments presented by the Customerto East End Liquidity Solutions, LLC, also known as “The LLC”.

The Guarantor understands that The LLC is cashing checks for The Guarantor thirdparty and that The Guarantor is fully, completely and personally responsible to make alldishonored checks paid in full back to the original face dollar amount of the check toThe LLC regardless of any and all disputes with the original issuer of the check(s). TheGuarantor is also completely responsible for any and all legal costs and associated costsincurred by The LLC in:

1.  Enforcing this Guarantee.

2.  Collecting the funds from the Maker of the original check.

3.  Any other purpose related to the dishonored check or the Guarantee.

“Legal costs and associated costs” as used above shall include, without limitation, attorneyfees incurred by The LLC in the retention of counsel for advice, suit, appeal and forany insolvency or other proceedings under the Federal Bankruptcy Code or otherwise.
