The substantive and procedural law of contract [transactional and litigation] and of tort law principles in intentional tort, negligence, and strict liability in tort in a study and instruction developed for paralegals.

Course-Level Outcomes:

Upon completion of the course, the student will be able to:

1. Define and apply substantive and procedural general contract law under the Restatement of Contracts 2nd and the parts of the Uniform Commercial Code applicable to transactions in goods given specific fact situations.

1. Analyze and evaluate appropriate elements of contract law in given client transactional matters.

1. Analyze and compare written and oral contracts given specific examples and propose appropriate remedies for a given breach of contract.

1. Define and evaluate elements of tort law for application to specific fact situations.

1. Analyze client-fact situations, spot issues, and propose application of the appropriate tort law and propose appropriate economic and non-economic civil remedies for a given wrong to a person.

1. Distinguish a civil wrong and a criminal act given specific fact situations.

This course is a legal specialty course developed in accordance with the standards and guidelines required by the American Bar Association, Standing Committee on Paralegals which body has approved the Paralegal Studies Program at CoastlineCommunity College. Section G-302 I. Of said Guidelines, as approved September 1, 2003, states as follows:

“The following requirements apply to legal specialty courses: 1. A legal specialty course is a course that (1) covers substantive law or legal procedures or process, (2) has been developed for paralegals, and (3) emphasizes practical paralegal skills.”

In the classroom the instructor may use traditional methods of lecture/discussion; role-playing; student presentations; and multimedia presentations or other films, videotapes, DVD, or CD-ROM presentations. Guest lecturers, field trips, and cooperative learning group activities may also be used by the instructor in designing the course. In addition to text reading, oral and written assignments, students may be given projects using the Internet, CD-ROM, or online research.
