1. CalltoOrder

The Chester Planning & Zoning Commission held its regular meeting immediately following a continued public hearing. Chairman Lavy called the meeting to order at 7:36 PM.

2. RollCallSeatingofAlternates

Those members present and seated were Jon Lavy, Steven Merola, Henry Krempel, Peter Zanardi, Doreen Joslow, Keith Scherber and Michael Sanders (seated for S. Murray).

3. AudienceofCitizens

John and Sally Ratchford and Tim and Kim Hertweck from Wig Hill Road were present, but did not speak.

4. OldBusiness

(a) Application for Special Exception #15-07 submitted by Skyview Properties LLC (owner/applicant) for storage of personal belongings, materials, business inventory, vehicles, tractors, trailers and equipment, on property located at 59 Winthrop Road (Tax Map 17, Lot 27, Zone Research & Light Manufacturing).

No further discussion took place as the public hearing was continued.

(b)ApplicationFees – continuingreview – nothing further to report.

(c) Proposed Marijuana Regulations – public hearing scheduled for November 12, 2015

Chairman Lavy noted a public hearing has been scheduled for November 12, 2015 at 7:30 PM at Chester Town Hall.

6. ReportofOfficersandSubcommittees

(a)ReportfromZoningComplianceOfficer

ZCO Brown noted she has been advised of two projects, one being a dam repair project at TLB Architects, 92 West Main Street, and a driveway bridge replacement at 8 Deep Hollow Road. It was the consensus of the Planning & Zoning Commission that neither project required Zoning approval.

9. ApprovalofMinutes – September 10, 2015 Public Hearing and Regular Meeting Minutes

Motion by Joslow, second by Zanardi, to approve September 10, 2015 Regular Meeting Minutes amended as follows -

Page 2, under (e) Proposed Marijuana Regulations, delete 5th sentence in its entirety. Approved with Krempel and Sanders abstaining.

Motion by Joslow, second by Merola, to approve September 10, 2015 Public Hearing Minutes as presented. Approved with Sanders and Krempel abstaining.

10. PendingLitigation

Motion by Zanardi, second by Joslow, to go into Executive Session for the purpose of discussing pending litigation at 7:50 PM. Unanimously Approved. Commission came out of Executive Session at 7:53 PM.

Motion by Sanders, second by Joslow, to authorize Commission Counsel to enter into statutory mediation relative to appeal of Section 80. Unanimously Approved.

11. Adjournment

Motion by Sanders, second by Joslow, to adjourn at 7:55 PM. Unanimously Approved.
