Procedure to Resolve Disagreements

Concerning Screening, Referral, Identification, and Services

Cabarrus County Schools Academically/Intellectually Gifted Differentiation Program goals, objectives, and service delivery options should be clearly communicated to parents. Parents who have questions or concerns should first talk with the Regular Education Teacher, and/or the AIG Differentiation Program Teacher, the high school Honors or Advanced Placement Teacher, or with the school Principal.

In the event that parents/guardians disagree with a decision, it is hoped that the concerns may be resolved at the local level. The following procedures should be followed to resolve any disagreements.

Level 1.School Site Review

If parents have a disagreement concerning search and nomination, identification, or services, they may request in writing a meeting with the Principal to discuss their concerns. The Principal may convene the Academically/Intellectually Gifted Differentiation Team to review referral and placement records and the student’s current performance.

Level 2.Director of Academically/Intellectually Gifted Differentiation Program Review

If the disagreement is not resolved at the school site, the parents may request an administrative review at the system level. This request should be made in writing within 10 days of the school site decision and sent to the Director of Academically/Intellectually Gifted Education.

Level 3.Assistant Superintendent for Curriculum and Instruction Review

If the disagreement cannot be resolved at the above level, the parents may appeal to the Assistant Superintendent for Curriculum and Instruction and/or to the Superintendent.

Level 4.Superintendent Review

If the disagreement cannot be resolved at the above level, the parents may appeal to the Superintendent.

Level 5.Administrative Law Hearing

If the above procedure fails to resolve the disagreement satisfactorily, the parents may file a petition for a contested case hearing under Article 3 of Chapter 150B of the North Carolina General Statutes. According to the law, “The scope of the hearing shall be limited to

(i)whether the local school administrative unit improperly failed to identify the child as an academically or intellectually gifted student,

or

(ii)whether the local plan developed under G.S. 115C-150.7 has been implemented appropriately with regard to the child.”

Following the hearing, the administrative law judge will make a decision based on the findings of fact and conclusions of law. The decision of the administrative law judge is final, is binding on all parties, and is not subject to further review under Article 4 of Chapter 150B of the General Statutes. Legal fees are the responsibility of the parents.

Procedimiento para Resolver Desacuerdos

Acerca del Escrutinio, Referencia, Identificación, y Servicios

Las metas, objetivos, y opciones de entrega de servicio del Programa de Educación para Dotados del Condado de Cabarrus deben comunicarse claramente a los padres. Padres que tienen preguntas o preocupaciones deben primero hablar con el Maestro de Educación Regular, y/o el Maestro del Programa AIG, el Maestro de la escuela secundaria de clase de Honor o Colocación Avanzada, o con el Principal de la escuala.

En caso de que los padres/tutores no acuerden con una decisión, se espera que las preocupaciones pueden resolverse al nivel local. El siguiente procedimiento debe seguirse para resolver cualquier desacuerdo.

Nivel 1. Revisión en el Sitio de Escuela
Si los padres tienen un desacuerdo sobre la búsqueda y nominación, indentificación, o
servicios, ellos pueden pedir una reunión por escrito con el principal para discutir sus
perocupaciones. El Principal puede reunir el Equipo del Programa para Académicamente/
Intelectualmente Dotado para repasar los archives de referencia y colocación y la actuación
actual del estudiante.

Nivel 2.Revisión del Director de Educación Dotada

Si el desacuerdo no está resuelto en el sitio de escuela, los padres pueden pedir una revisión
administrativa al nivel del sistema. Esta petición debe hacerse por escrito, dentro de 10 días
de la decisión en el sitio de escuala, y enviado al Director de Educación Dotada.
Nivel 3.Revisión del Superintendente Ayudante del Plan de Estudios e Instrucción
Se el desacuerdo no puede resolverse al nivel anterior, los padres pueden apelar al
Superintendente Ayudante del Plan de Estudios e Instrucción y/o el Superintendente.

Nivel 4. Revisión del Superintendente

Si el desacuerdo no puede resolverse al nivel anterior, los padres pueden apelar al
Superintendente.
Nivel 5.Audiencia Jurisprudencia Administrativa
Si el procedimiento anterior no resuelve el desacuerdo satisfactoriamente, los padres pueden
archivar una petición para una audiencia de un caso disputado dajo Artículo 3 del Capítulo
150B de los Estatutos General de Carolina del Norte. Según la ley, “La extensión de la

audiencia se limitará a

(i)si la unidad administrative de escuela local inadecuadamente fallo de indentificar al niño como un estudiante académicamente o intelectualmente dotado, o

(ii)si el plan desarrallado local bajo G.S. 115C-150.7 se ha llevado a cabo
apropiadamente con respect al niño.”

Siguiendo la audiencia, el juez de la jurisprudencia administrative tomará una decisión basada en los resultados de hecho y conclusions de derecho. La decisión del juez de la jurisprudencia administrativa es final, es obligatorio para todos interesados, y no está sujeto a mas revisión bajo Artículo 4 del Capítulo 150B de los Estatutos General. Los honorarios del abogado son la responsabilidad de los padres.
