Will of Margaret Otto, Late of Altoona City, Deceased

In the name of God amen, I, Margaret Otto of Altoona City in Blair County and State of Pennsylvania widow being of sound mind memory and understanding do make and publish this my last will and testament hereby revoking and making void all former wills by me at any time heretofore made. As to such estate as it hath pleased God to intrust me with I dispose of the same as follows.

Item 1st. I direct my Executor hereinafter named to pay all of my just debts and funeral expenses as soon as may be convenient after my decease.

Item 2nd. I give devise and bequeath to my daughter Sarah J. Dugan all of my household and kitchen furniture bed and bedding &c of which I may own at the time of my death and to her and her heirs and assigns forever.

Item 3rd. I give devise and bequeath to my daughter Charlotte S. Delozier all that certain lot or piece of ground which the western part of a *** story double dwelling house is erected thereon and the same part as now occupied by her husband and family adjoining the property of --- Alexander fronting --- feet on Union Avenue known as the plank road 5 Ward in Altoona City Pa. my true intention and meaning is that my said daughter Charlotte is to have all the ground that is now enclosed by fence belonging to said Western part of double dwelling house to have and to hold the same for and during her natural life and after death to be divided equally share and share alike amongst her children their heirs and assigns forever.

Item 4. I give devise and bequeath to my daughter Sarah J. Dugan all that certain lot or piece of ground with the Eastern part of said double dwelling which I now occupy with my said daughter Sarah J. Dugan fronting on said Union Avenue --- feet and adjoining the property which my said daughter Charlotte S. Delozier occupies and to the line of the Pa R. Road Co. thence along said line of the Pa R.R. Co. to dividing line of said property and my other property occupied by my son Josiah Otto to said line thence Southward along said dividing line to said Union Avenue the place of beginning, to her and her heirs and assigns forever in fee.

Item 5. I give devise and bequeath to my said son Josiah Otto and his wife all that certain piece of ground with one two story dwelling house and being the same premises he now occupies fronting on said Union Avenue and the said lot or piece of ground being enclosed with fence and being the Eastern part of my property to have and to hold the same for and during his natural lifetime and also this wife and after their death to be divided equally amongst my said son Josiah's children their heirs and assigns forever in fee conditioned that the sum of One Thousand Dollars be paid at the rate of ten dollars per month from the date and if not paid to be and remain as a lien against said property until paid by him or his heirs or assigns.

Item 6. I direct my Executor hereinafter named to divide all money that I may have at the time of my death and all moneys due and owing me after paying my said debts and funeral expenses to be divided equally share and share alike amongst four of my children namely Mrs. Elizabeth Hartle, John W. Otto, Henry H. Otto, Mrs. Margaret Bechtel.

Item 7. My said daughter Charlotte S. Delozier is to pay the sum of Eight Dollars per month into the --- Loan and Building Association of --- [****] until paid and if not paid at the time of my death to her and remain as lien the amount of said loan due the said loan and building association against the property which I bequeathed to her and the same she now occupies.

Item 8. I hereby appoint and constitute my son in law Jacob Hartle sole Executor of this my last will and testament.

Codicil

I Margaret Otto the within named testatrix, do hereby make and publish this Codicil, to be added to my last will and testament, bearing date the 14 day of November A.D. 1890, in manner following to wit:

I give and bequeath unto my Grandson James M. Dugan all of my real estate that I have bought from the Equitable Loan and Building Association that had formerly belonged to my son John W. Otto, and in case of his death before the death of his mother Sarah J. Dugan then in that case the property hereby bequeathed to said James M. Dugan to revert to his mother Sarah J. Dugan in fee simple. Also all personal property that belongs or appertains to said real estate. This Codicil in no wise to interfere with any property owned by me prior to this purchase, and not to interfere in any way with the disposition made by me of my property as set forth in my will, to which this is a Codicil. [***] all subsequently acquired property (meaning real estate) shall at my death revert to my Grandson James M. Dugan unless otherwise provided by a later Codicil or a conveyance of any portion in my lifetime.

Lingenfelter and John O'Toole the subscribing witnesses to the above will, and being duly sworn and affirmed according to law, did depose and say they were personally present and saw and heard Margaret Otto, the testatrix, sign by her mark, seal, publish pronounce and declare the foregoing instrument of writing as and for her testament and last will, that they signed their names in the presence and at the request of the said testatrix and in the presence of each other, and that at the time of so doing she, the said testatrix was of perfect and sound mind memory and understanding, to the best of their knowledge and belief.
