Title: Discontinuance of maintenance of two portions of Route 641 in Nelson County
WHEREAS, pursuant to § 33.2–908 of the Code of Virginia, the Commonwealth Transportation Board may discontinue Virginia Department of Transportation services and jurisdiction over roadways, public landings, or crossings comprising the secondary system of state highways that no longer provide sufficient public convenience to warrant maintenance at the public expense; and
WHEREAS, discontinuance of any such element of the secondary system of state highways causes jurisdiction over that portion, which remains a public road, to be returned to the local government within which the facility is located; and
WHEREAS, a request was received from Nelson County Board of Supervisors for the discontinuance of two portions of Route 641 to include Segment A which is from 2.72 miles northwest of Route 640 to 3.57 miles north of Route 640, a distance of 0.85 of a mile and Segment B which is from 5.05 miles northwest of Route 640 to Route 641 (Eades Lane), a distance of 0.07 of a mile; and
WHEREAS, the Nelson County Board of Supervisors requested, by resolution, on July 14, 2015, the discontinuance of the two segments of Route 641 (Dutch Creek Lane) pursuant to § 33.2–908 of the Code of Virginia; and;

WHEREAS, on behalf of the Commonwealth Transportation Board, Nelson County Board of Supervisors in concert with the Virginia Department of Transportation published a Notice of Intent to Discontinue, offering to hold a public hearing regarding the matter; and
WHEREAS, no public hearing was requested and VDOT recommends the proposed segments be discontinued as maintenance thereof at the public expense is no longer warranted.
NOW THEREFORE BE IT RESOLVED, pursuant to § 33.2-908 of the Code of Virginia, this Board hereby orders the discontinuance of the two segments of Route 641 (Dutch Creek Lane) to include Segment A which is from 2.72 miles northwest of Route 640 to 3.57 miles north of Route 640, a distance of 0.85 of a mile and Segment B which is from 5.05 miles northwest of Route 640 to Route 641 (Eades Lane), a distance of 0.07 of a mile, as depicted in Attachment A.
