NOTE

1.  An application for a Non-Publication Order under section 15(1) must be made by Ex Parte Originating Summons (Form 242) and supported by an Affidavit (Form 243).[1]

2.  The Applicant must, within 8 days after the date on which the Originating Summons and supporting Affidavit are served on the respondent, file an Affidavit of Service.[2]

3.  The Respondent or any other person to whom the Non-Publication Order is to apply may file a Response affidavit (Form 244) within 14 days after being served with the Originating Summons and supporting Affidavit.[3]

Where any party does not appear at the hearing of the application, the Court may proceed with the hearing of the application in the absence of that party and may make such order as the Court may think just and expedient.[4]

4.  Except with the leave of the Court, no other affidavit is to be filed or served for the purposes of the application.[5]
