Subject: This announcement is to amend the import rules and regulations regarding goods/articles originating in Mainland China.

Legal Basis: Item 1 of Paragraph 1 of Article 7 and Item 1 of Paragraph 1 of Article 9 of the “Regulations Governing Permission of Trade Between Taiwan Area and Mainland Area”

Details of Announcement:

  1. In order to further simplify administrative procedures and facilitate understanding of the rules and regulations governing the import of goods/articles originating in Mainland China, as of April 1, 1998, the import of all goods/articles originating in Mainland China will be regulated by the “Classification of Import and Export Commodities of the Republic of China” (table). For each good/article, permissibility of import is indicated in the column entitled “Import Regulations.” “MW0” indicates that importation of said good is strictly prohibited. “MP1” indicates that importation of said good is conditionally permitted. If neither “MW0” or “MP1” is indicated, then importation of said good is permitted.
  2. The specific conditions for import eligibility are detailed in the “Consolidated List of conditional Import Items of Mainland China Origin and Regulations Governing Import of Mainland China Origin Commodities” This list includes:
  3. Items whose CCC code ends with “EX” can only be imported if they conform to the specifications detailed in the list
  4. Items which have “MXX” “NXX”marked in the “Special Conditions” column.
  5. In order to simplify licensing procedures, other than those items listed in the “Classification of Import and Export Commodities of the Republic of China” which are marked “121” in the “Import Regulations” column or are marked “MP1” in the “Import Regulations” column, are listed in the “Consolidated List of Commodities Permitted for Conditional Import and rules and regulations governing permission for import of goods/articles from Mainland Area,” and are marked “MXX” in the “Special Conditions” column, all items permitted by the MOEA do not require licensing.
  6. Importers whose goods do not require licensing include:
  7. Firms duly registered with BOFT as importers/exporters
  8. Government agency, and/or a government operated enterprise
  9. Legally registered private schools at or above elementary level
  10. Baggage and articles of which the quantities and values are within the limits set by customs brought in by passengers and crew members of vessels and aircraft
  11. Duty free articles for official and/or personal use imported by embassies consulates or various countries in the Separate Customs Territory of Taiwan, Penghu, Kinmen, and Matsu, international organizations, and diplomatic organizations stationed in this country against the duty-exemption application forms issued by Ministry of Foreign Affairs
  12. Commodities which are not listed in the “List of Commodities Subject to Import Restriction” but are imported by other importers through marine shipment, airfreight, or parcel post, at an FOB price less than US$ 20,000 or its equivalent.
  1. Imported goods/articles originating in Mainland China should conform to the regulations listed in the “Classification of Import & Export Commodities of the Republic of China,” the “Consolidated List of Commodities Subject to Import Restriction and Commodities Assisted by Customs for Import Examination,” the “Consolidated List of conditional Import Items of Mainland China Origin and Regulations Governing Import of Mainland China Origin Commodities” and the “Regulations Governing Permission of Trade Between Taiwan Area and Mainland Area.
