TheTeacher may increasethetuitionfeesfromtimetotimeand willgivewrittennoticeofsuchanincreasetothePupil(orthePupil’sparentorguardian whereappropriate)bynolaterthanthestartoftheSeriesoflessonsprecedingtheSerieswhentheincreasetakeseffect.

Conditions

The Conditionsset outon page2willapplyto thisAgreement.

WhenthisAgreementhasbeensignedbyboththeTeacherandthePupilor,ifthePupilisunder18years ofage,thePupil’sparentorguardian,itwillconstitutealegallybindingcontractbetweenthesignatories.

TheAgreementwill remainin force continuouslyfromSeries toSeries unless terminatedin accordancewithCondition6onpage2.

I(thePupilorthePupil’sparentorguardian)accepttheoffer oftuitionfor(Pupil)onthetermsandconditionssetouthereinandagreetobeboundbythemuntilterminationofthisAgreement.

Conditionsofmusictuition

1.Lessons

TheTeacherwillgivetuitioninSeriesoflessonsconsistingofthenumberoflessonsspecifiedoverleaf.Serieswillnotnecessarilycoincide withschoolterms. TheTeacherwillgivethelessonsatthetimeandlocationspecifiedoverleafandtheTeacherwillreservethistimeslotforthePupil.

2.Paymentoffees

ThePupil (orthePupil’s parent orguardian)will paythefees foreach Series in full before the first lesson of the Series. However, payment on the first day of term is also acceptable.

3.Holidays

BeforethefirstlessonofeachSeries,theTeacherwillgivethePupil(orthePupil’sparentorguardian)writtennoticeof(i)holidaybreaks(whenlessonswillnotbegiven)uptothestartofthefollowingSeries;(ii)thedateofthefinallessonintheSeries;and(iii)thestartdateofthefollowingSeries.HolidaybreaksmayoccurpartwaythroughaSeries.

Lessonswill take place on public holidays onlybyprioragreement between theTeacherand the Pupil (orthe Pupil’sparent orguardian).

4.Missedlessons

OutsidetheholidaybreaksnotifiedtothePupil(orthePupil’sparentorguardian)inaccordancewithCondition3above,theTeacherwillchargeforanyscheduledlessonswhichthePupildoesnot attend,unlesstheTeacherchoosesnottodosobecauseof exceptional

circumstances.IftheTeacherisobligedtocancelascheduledlesson,thePupil(orthePupil’sparentorguardian)maychoosebetween(i)carryingthelessonforward;(ii)receivingareplacementlesson;or(iii)receivingarefundofthelessonfee.

5.Examinations,competitionsandpublicperformances

ThePupilwillnotbeenteredfor any examination,competitionorpublicperformancewithouttheprior consentofboththe Teacher andthePupil(orthePupil’sparentorguardian).

6.Terminationoftuition

(a)ThisAgreementmaybeendedbymutualconsentatanytimebybothsignatoriestoitsigninganddatingawrittenstatementtothateffect.

(b)EithersignatorytothisAgreementmayterminatetheAgreementbygivingnoticeinwritingtotheothersignatoryatleastonemonthbeforetheendofaSeriesfor theterminationtotakeeffectattheendofthatSeries. Terminationby onesignatory may takeeffectattheendofaSeriesonlyandnotatanyothertime.IftheTeachergivesnoticetoterminatetuitionattheendofaSeriesinaccordancewiththis ConditiontheTeacherwill continuetoprovidelessons untiltheendofthat Series.

7.Failure togivenotice

UnlessterminatedunderCondition6above,thisAgreementshallcontinuefromSeriestoSeries.IfthePupil(orthePupil’sParentor Guardian)failstogivefullnoticetoterminatethisAgreementinaccordance withCondition6(b)aboveandthesignatorieshavenotagreedtoterminatetheAgreementinaccordancewithCondition6(a)above,thefollowingchargeswillbemadeinlieuofnotice:

(a)WherethenoticegivenislessthanthatrequiredunderCondition6(b),andnotinaccordancewithCondition6(a),butisonemonthor morebeforethestartofthenextSeries:10%ofthefeesforthenextSeries;

(b)Wherethenoticegivenislessthanonemonthbutmorethanthreeweeksbeforethestartofthenextseries:25%ofthefeesfor thenextSeries;

(c)Wherethenoticegivenislessthanthreeweeksbutmorethantwoweeksbeforethestartofthenextseries:50%ofthefeesfor thenextSeries;

(d)Wherethenoticegivenislessthantwoweeksbeforethestartofthenextseries:100%ofthefeesforthenextSeries;

If thePupil stopsattending lessonswhile aSeries isongoing, thePupil (orthePupil’s ParentorGuardian)is notentitled toa refundof anyfeespaid forthatSeries.ThePupilisentitled toattendanylessonspaidfor.

IftheTeacherstopslessonswithoutgivingthecorrectnoticespecifiedinCondition6(b)abovetheTeachershallrefundanyfeesalreadypaidforanylessonsnotgiven.

8.Conduct

IftheTeacher,usingherreasonablediscretion, feelsunable tocontinuetuitiononaccountofconduct bythePupiloranyoneconnectedwiththePupilwhichmakesitunethicalor unsafetocontinueteachingthePupil,thefeesfor any outstandinglessonswillnotberefundable.

9.Changes

(a)AnychangestothetermsofthisAgreementmustbeconfirmedin writingandsignedanddatedbyboththeTeacherandthePupil(orthePupil’sparentorguardian).

(b)IftheTeacherchoosestowaiveanyrightor remedyunderthisAgreementorotherwise(forexample,iftheTeacherchoosestowaivefeesforany lessonswhichthePupil(orany other pupil)doesnotattend)thisshallnotmeanthatshemustdosoinfutureorthatshe waivesany otherrightsor remedies,unlessagreedinwritinginaccordancewithCondition9(a)above.

10.Governinglawandjurisdiction

ThisAgreementshallbesubjecttothelawsofthejurisdictionofthelocationforthelessons(specifiedabove)andthesignatoriestothisAgreementagreethatanydisputerelatingtothesubjectmatterofthisAgreementshallbesubjecttotheexclusivejurisdictionofthecourtsofthatjurisdiction.
