6:30pm October 16, 2007

  1. Call to order on Tuesday October 16, 2007 @ 6:35pm. The board members present were:

  1. Old Business – Reports
  2. Vandenberg/Sellman have requested that the Association purchase his unit and pay $5000 to settle his claim against the Association. The Association insurance carrier investigated the claim and offered $2500 to Vandenberg as final settlement. This is the same amount offered by the Association in October 2006.
  3. We are waiting for a decision on the ice damage claim from our insurance provider, CFR. The board has agreed that repairs cannot wait for a settlement from the insurance company. The $24,000 check awarded to the Association was deposited in the Association account. However, the Association is in disagreement with the claim amount. The Association believes the claim amount should be closer to $60,000. A decision on the remaining balance is pending with the State Insurance Board.
  4. Four bids for a new fence around the property were sent to the city of Tulsa. The city of Tulsa will provide a grant to build a fence on the property as part of the Vision 2020 plan.
  5. The new lighting for the property has been completed.
  6. Owner Joanne Kirk has refused to pay for the windows and doors installed in her unit. The board discussed making a claim in small claims court. Association member Eddie ???? volunteered to make the required appearance in small claims court to help recover the cost.
  7. It is necessary for the Office Manager to collect all correspondence, invoices, and work orders related to the window and door installation in Joanne Kirk's unit. This should be compiled for the impending suite against Ms. Joanne Kirk.
  8. The Office Manager, Penny Taylor, must report if the current insurance policy has been delivered to our Attorney Curtis Kaiser. There is concern about the risks involved if a claim can be denied due to owners renting to section eight tenants. A professional legal opinion is imperative!
  • The Board wants an opinion from our attorney on who is responsible for damages caused by a leaking pipe inside a unit from our attorney, See section 10.02 of by-laws and Schedule 1 Item # 6. The pipe in question is inside the wall and connected to a dish washer in the kitchen.

New Business

  • The AC disconnects on the building roofs are showing age. The Association is considering assessing the owners to have the disconnects replaced to meet current building codes. Three bids were collected from the following:
  • Harp Electric, $384per unit x 184units = $70,656.
  • Murphy Electric, $90,000.
  • Sherack Electric, $315per unit x 184 = $57,960

The low bid from Sherack is bonded.

  • A fire was started in unit F301 owned by Jose Gutierrez on October 15, 2007. Inspection of the unit F301 after the fire showed there was a leak from the bathroom into the unit below. Owner Gutierrez is liable for all damages. Any claim made by the owner suffering damage due to the leak needs to contact Jose Gutierrez. Penny Taylor should confirm the facts about this incident, the owner of the units in question, and amend theses minutes.
  • Additional Speed bumps were installed closer to the main entry point in an attempt to slow traffic as it enters the property.
  • A cover for the pool was proposed to reduce debris in the pool. The cover would reduce maintenance and cleaning costs.
  • A request has been made to determine how the electrical bill is calculated and paid. Penny Taylor should report this information directly to Phil Berman.
  • The next Association budget meeting will be Tuesday November 6 at 6:30pm.
  • The next Association meeting will be open to all owners. The office manager should contact all owner's of the open meeting scheduled for November 13th at 6:30pm in the Association Clubhouse. The office manager needs to send out a notice to all homeowners.
