2014 KIA Raffle

Rules and Regulations

The Walton Touchdown Club’s 2014 Car Raffle (“Raffle”) is a fundraising activity conducted by the Walton Touchdown Club in support of the Walton High School Football program. These Official Rules

& Regulations (“Rules”) govern the conduct of the Raffle and together with the decisions of the Walton Touchdown Club Board and KIA raffle sub-committee are binding on everyone who purchases a Raffle ticket and/or who is named on a Raffle ticket. These Rules may not be waived, modified or supplemented except by the Board in writing.

TICKET COST AND ODDS OF WINNING: The ticket price is $10.00 per ticket.A maximum of 2,000 tickets will be sold. Ticket sales will cease if the maximum number of qualified entries is reached. Any requests and payments received following the cut off time or after the sale of 2,000 tickets will be returned to the buyer. The odds of winning the Grand Prize will depend on the number of eligible entries received and accepted by the stated cutoff date of November 2, 2014 at 11:59pm. However, the odds of winning will never be greater than 2,000 to 1.

GRAND PRIZE DRAWING: The Grand Prize drawing for the Raffle will be held on Friday, November 7, 2014 during the football game at Raider Valley, the Walton High School stadium. The winning ticket will be drawn at random from a drum containing all eligible Raffle tickets. The drawing for the prize is open to the public; however, the winner does not need to be present to win.

GRAND PRIZE:The Grand Prize is a 2015KIA Soul with an MSRP of $17,999. The KIA Soul is being provided by Ed Voyles KIA. Winner of the grand prize has the option to apply the value of the KIA Soul towards the purchase of an alternate vehicle from Ed Voyles KIA. The Walton Touchdown Club does not provide any guarantee or warranty, expressed or implied, in connection with the grand prize. The Walton Touchdown Club accepts no liability or responsibility regarding the manufacturing or condition of the grand prize. No warranties express or implied, of any type or nature are made or offered by The Walton Touchdown Club.

TAXES AND OTHER COST OF OWNERSHIP:The Walton Touchdown Club does not undertake to give advice on the legal or tax consequences of the Raffle to the winners. However, the Walton Touchdown Club understands the IRS’ position is that amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not donations, and consequently do not qualify as deductible charitable contributions.The Raffle winners assume and must pay all applicable fees and charges (including, but not limited to, tags and license) and income taxes (local, state and federal taxes) when the car and/or cash prize is transferred to them by Ed Voyles KIA. In addition, all costs of ownership of the grand prize, including, but not limited to, insurance, are the sole responsibility of the Grand Prize winner. The Walton Touchdown Clubs assumes no responsibility for a prizewinner’s tax obligations. THE GRAND PRIZE WINNER IS STRONGLY ENCOURAGED TO SEEK PROFESSIONAL LEGAL AND/OR TAX ADVICE. ACCEPTANCE OF THE GRAND PRIZE COULD HAVE MATERIAL CONSEQUENCES ON THE GRAND PRIZE WINNER INCLUDING, BUT NOT LIMITED TO, GOVERNMENT ENTITLEMENTS OR OTHER BENEFITS, OR OTHER LEGAL, FINANCIAL OR OTHER MATTERS. All required tax forms and other documents will be prepared and by Ed Voyles KIA, and will be the responsibility of Ed Voyles KIA and the grand prize winner.

OTHER PROVISIONS: By participating, you agree that all ticket purchasers and the person named on

each raffle ticket accept and agree to be bound by all the rules, limitations and restrictions set forth

herein. The Walton Touchdown Club’s interpretation and application of the rules and regulations shall be final. Additionally, all participants release the Walton Touchdown Club, and each of their

respective directors, officers, contractors and agents from any and all liability for injuries, losses or

damages of any kind caused by any prize or resulting from acceptance, possession, use or misuse of

any prize. Each winner agrees to indemnify and hold the Walton Touchdown Club and and each of their respective directors, officers, contractors and agents harmless from any and all losses, damages, costs, expenses, rights, claims and actions of any kind arising in connection with or as a result of the winner's acceptance or use of any prize.

ELIGIBILITY: Raffle ticket purchasers and the person named on a raffle ticket must be at least 18 years

of age at the time of purchase. Raffle tickets may not be purchased in the name of a business, trust,

corporation, or other entity, or wherever prohibited by applicable law. Members of the official Raffle

sub‐committee as well as the Walton Touchdown Club Board of Directors and their immediate family are not eligible to win the Raffle. Prizewinners may be required to sign an affidavit of eligibility. Offer void where prohibited by law.

TICKETS:Tickets may be purchased in person by cash or check.You have not entered the Raffle until your entry submission, with full payment has been accepted by the sub-committee of the Walton Touchdown Club. All entries must be fully completed in order to be eligible including the printed name, email address, and phone number of the entrant. Acceptance of your entry submission will be communicated to you by delivery of a ticket stub. If a submission is accepted it will be deemed to have been accepted on the date and time on which the submission was received by the Walton Touchdown Club. You may buy as many tickets as you wish, subject to availability, until all 2,000 tickets have been sold. Each Raffle ticket will be entered separately in the drawing. Each Raffle ticket is a separate and equal chance to win any of the prizes offered.

REFUNDS: All Raffle ticket sales are final. No refunds will be made except that any ticket request with

verified payment received after 2,000 tickets have been sold or after the Grand Prize Drawing

deadlines set forth herein will be returned or destroyed with notice to the purchaser. No other refunds

are available. The Walton Touchdown Club assumes no responsibility for lost, late, misdirected or non‐delivered mail or any other failure to receive orders or deliver receipts prior to the drawing deadlines. A Raffle participant's sole and exclusive remedy for a breach by the Walton Touchdown Club shall be limited to the return of the purchase price paid for his or her Raffle ticket(s). In no event shall the Walton Touchdown Clubs, or their respective directors, officers, contractors, members, committee members, agents, advisors, or representatives beliable to any party for any loss or injuries to earnings, profits or goodwill, or for any incidental, special, punitive or consequential damages of any person or entity.

NOTIFICATION AND CLAIMING OF PRIZES: If the winner is not present at the time of the drawing, the Walton Touchdown Club shall notify the winner by telephone and/oremail within thirty (30) days of

the drawing. The winner must claim the prize within sixty (60) days of the drawing. The winner will need to provide proper identification to the satisfaction of the Raffle sub-committee.If a winner does not wish to claim the prize, another ticket will be drawn, and the same provisions will again be applied.

This Raffle is conducted for the benefit of the Walton High School Football Program by the Walton Touchdown Club, and licensed by the Cobb County Sheriff’s Department.
