Mayor, Bourque called the meeting to order and welcome public.

Mayor, Bourque requested a moment of silence in memory ofGeorge Culligan of Belledune and Alphonse Lavigne of Lorne

Council reaffirmed their Oath of Office.

Agenda

Mario Lapointe moved the following changes be made to the agenda; add under Administrative Report, CAO – Culvert Installations CAO #15-18 and under Statements by Members of Council, Mayor, Bourque – Host BBQ, seconded by Heather Frenette. Motion carried.

Heather Frenette moved that the Agenda be adopted as Amended, seconded by Mario Lapointe. Motion carried.

Minutes:

Heather Frenette moved that the Minutes of the Committee of Whole meeting June 8, 2015, Regular meeting of June 22, 2015, Special meeting June 29, 2015, be adopted as presented, seconded by Mario Lapointe. Motion carried.

Mayor’s Report

Jerry Guitard moved that the Mayor's Report be accepted and approved for posting to Belledune website, seconded by Mario Lapointe. Motion carried.

Appreciation Plaque – Belinda & Mike Babin

Heather Frenette moved that the Village of Belledune present Belinda and Mike Babin of Restigouche Guardian Pharmacy with an Appreciation Plaque for the services they provide to the community, seconded by Mario Lapointe. Motion carried.

Community Memorial Park & Opening Ceremonies

Award Monuments Tender (3)

Jerry Guitard moved that the tender for two (2) Monuments for the Community Memorial Park be awarded to Goguen Monuments Inc. for the amount of $6,200 (HST Included) and for the additional amount of $3,100 (HST included), add one (1) other Monument for Honk Kong Veterans, as per the design information provided by Emmie Flanagan of HKVCA, seconded by Mario Lapointe. Motion carried.

Councillor, Frenette inquired why the Fire Dept. was listed on the Emergency one when they have a monument of their own. She does not really see the need for them to have their own, signals them as more important than the other emergency services, in her opinion. However, they do have a separate monument so they should be removed from the Emergency Services.

Councillor, Lapointe concurred as it is redundant.

Directive to remove Fire Department from the Emergency Services Monument as they have a separate monument of their own and it is redundant.

Opening Memorial Park Ceremony Dinner – Invitation

Jerry Guitard moved that the Village of Belledune extends an invitation for the Community Memorial Park Opening Ceremony Dinner, to the veterans outside of Belledune who are registered members of the Royal Canadian Legion – Branch #77, seconded by Heater Frenette. Motion carried.

Councillor, Frenette inquired about where the other Veterans are from outside of Belledune.

Mayor, Bourque advise the surrounding area of Nash Creek, Lorne, etc.

Belledune Days – Max 104.9 Advertising Proposal

Jerry Guitard moved that the Village of Belledune accept Max 104.9 Option # 1, 2015 Belledune Days advertising package for the amount of $1,995, seconded by Mario Lapointe. Motion carried.

Host BBQ- Liberal Caucus

Mayor, Bourque said he was approached by MLA, Daniel Guitard to see if Belledune would be interested in hosting a BBQ on August 12, 2015 for the liberal caucus with a general invitation to the public. There are funds in the budget for this type of event and if Council deems appropriate they could set a limit to be spent.

Council members felt that if the liberal caucus wishes to host a BBQ they must have some funds they can use for the BBQ, and the Village of Belledune could provide the facilities. Don’t’ feel like spending the taxpayer’s money for this.

Mayor, Bourque said he did not ask if they had funding, but felt it would be a great opportunity for the citizens to be able to meet all the Ministers and Premier to discuss issues that are important to them.

Mario Lapointe moved that the Village of Belledune support the hosting of a BBQ for the NB Liberal Caucus on August 12, 2015 by providing the facilities with the condition that they provide the food, seconded by Jerry Guitard. Motion carried.

Councillor, Frenette reported on meetings missed due to work and meeting attended.

Appreciation Dinner for Fire Department

She was asked by a firefighter about the appreciation dinner for this year. Last year it was offered but not accepted by the Fire Chief. It was usually done in June. If the firefighters are being invited to the Memorial Park ceremonies and dinner in September, she feels that would be sufficient for this year. If Council wishes to consideration something else, perhaps around Christmas, they can discuss later in the year perhaps.

Councillor, Guitard noted the Firefighters have money of their own that they use for Christmas Party.

Signage/Light coming down Jacquet River hill

CAO, Hughes has been working on this with DTI as he explained to Councillor, Frenette prior to the commencement of the meeting.

As well, Councillor Frenette inquired about the status of the sign for the end of Turgeon Rd. We are getting late in the season and there is nothing yet.

CAO, Hughes noted that in his discussion, both the Port and NB Power are opposed to removing their signs and being placed by small icons on a larger sign. CAO, Hughes said that while the Village could proceed and just tear them down, he does not fell that would create good partnership. This will take a bit more time to work on.

Speed Limit on Jacquet River Drive

Councillor, Frenette inquired about the reduction on speed limit on Jacquet River Dr. and as it has been defined as a municipal street, what is the process to use. She would think from an 80 to 60 km would be logical. Would this require a motion? She also raised the question about the population / residence density on the street making a difference for the purpose of speeds. This is what she was told in the past

Clerk/Treasurer noted that in the absence of a By-law, a motion or resolution would most likely be necessary. However, the proper wording of the motion should be checked to make sure compliance with Motor Vehicle Act as well as municipal authority. This should be checked into and perhaps if ready could be presented at the August Regular meeting.

CAO, Hughes said that if there was a By-law the authority would be with the municipality for regulating speed and it could also address the density question.

A directive for CAO, Hughes to check with legal counsel to determine the proper process for reducing speed limit to make sure compliant with Motor Vehicle Act and Regulations and to get the appropriate wording for a Resolution of Council.

Super Village Trail Blazers Club – Donation Request

Guitard moved that the Village of Belledunedonate the sum of $25,000 to the Super Village Trail Blazer to bring there building and groomer and canteen equipment up to date with necessary repairs and purchases, seconded by Heather Frenette. Motion carried.

Councillor, Lapointe reported on meetings attended.

Administration Reports

Purchase & Sale (PID 50075266) - Extend Closing Date

Jerry Guitard moved that the Closing Date of Purchase and Sale Agreement for property PID 50075266, motioned by Council at their Regular Meeting on June 22, 2015, be extended from July 15, 2015 to on, or before, July 29, 2015, seconded by Mario Lapointe. Motion carried.

Recreation Centre, Automatic Door System – #CAO-15-14

Jerry Guitard moved that as recommended by CAO – Report #CAO-15-14, the Automatic Door System for Belledune Recreation & Cultural Centre be awarded to the lowest bidder, Levesque & McIntyre Electric Company Ltd., for the cost of $6,400 (plus HST), seconded by Heather Frenette. Motion carried.

Building Entrance Modification, Municipal and Arena – Tender – #CAO-15-15

Heather Frenette moved that as recommended by CAO Report #CAO-15-15, Council authorizes CAO, Hughes to proceed to tender for the Municipal Building Entrance Modification (Vestibule) and the temperature barrier system in the Arena to keep warm air out, seconded by Mario Lapointe. Motion carried.

Beach Erosion, Maureen Pascal’s (#20 Waterfront Drive) – Quotations - #CAO-15-16

Jerry Guitard moved that that as recommended by CAO Report #CAO-15-16, Council authorizes CAO, Hughes to proceed to get updated quotes for the two (2) options prepared by Roy Consultants, dated May 15, 2014, for the beach washout on property of Maureen Pascal at #20 Waterfront Drive (cottage), with the understanding that prior to any work being awarded by the Village of Belledune, a Watercourse Alteration Permit will be required, seconded by Mario Lapointe. Motion carried.

#3442 Main Street – Engineering Drainage Issue - #CAO-15-17

Mario Lapointe moved that as recommended by CAO Report #CAO-15-17, Council authorizes CAO, Hughes to give directive to Roy Consultants to proceed with an evaluation of drainage issue at #3442 Main Street (private property) to determine possible solution and cost estimate, seconded by Jerry Guitard.

Council discussed the issue in terms of it being a private property issue with the problem being created by adjacent owner on private property. The question of the right of way being worked on and the pipes being blocked when the adjacent property was back filled has created the problem. Is this the municipalities and taxpayers problem? Why is the private individual not required to fix the problem created. If there was building permit issued, why did the Planning Dept. not inspect when the road work was being done.

Mayor, Bourque clarified that the drainage issue has been in place for a long time, maybe fifty (50) years. However, the issue is the additional work done on the right of way has created massive flooding damage to the home at #3442 Main Street. Going legal is an option, but could take years to resolve because the fact is the adjacent property is in the name of an Estate and not everyone can come together to agree and resolve. However, in the meantime, #3442 could see more damages over the next few years if something is not done.

The question is not for the Village to do the work, but it is for the Village to have engineering look at for a possible solution. The solution being looked at is there a way for the property to be able to drain into the existing municipal storm sewer, running east and west along route #134 in that area. What is really being asked is can there be a recommendation on what could be done to resolve the problem for the owners of #3442 Main St.

Councillor, Lapointe said it sounds like a few additional pipes could resolve the problem. He will go and have a look.

Councillor, Frenette noted it is still taxpayer’s money being spent to resolve s private problem

Councillor, Guitard said that just like filling ditches (along Mitchell Rd.); this could be opening another can of worms.

Heather Frenette moved that the motion for CAO Report # CAO-15-17 be tabled until August Regular Meeting, seconded by Mario Lapointe. Motion carried. (2 yeas – Councillor’s Frenette & Lapointe) (1 nay - Councillor Guitard)

Jacquet River Dr., Phase 2 & Memorial Park -Project No. 135-11-2 – Award Tender

Jerry Guitard moved that as recommended by Francis Frenette, Roy Consultant Engineer, the tender for Jacquet River Dr., Phase 2 & Memorial Park -Project No. 135-11-2 be awarded to the lowest compliant bidderSt-Isidore Asphalte Ltée for the sum of $406,190.93 (H.S.T. included), seconded by Mario Lapointe. Motion carried.

Councillor, Frenette inquired about the scope of work for the about Project, how far on Jacquet River Dr. is being paved, what is the cost of Memorial Park work and what is being done for the amount of money and what is the total cost of the Memorial Park.

Mayor, Bourque said the scope of work for Memorial Park included walkway, bases for monuments, bases for flag poles (not the poles) and ground work for electrical (but not the electrical fixtures).

Clerk/Treasurer, Cormier noted in the report the Memorial Park work is $61,000 the scope of work for both Jacquet River Dr. and the Memorial Park would be in the Tender documents, which CAO, Hughes has. As for the Memorial Park, to date there is the $61,000 for the ground work part of tender, $22,000 plus for the large Monument, $9,300 for the three (3) Monuments just approved, as well as the $11,000 approved for engineer of design and there will be ongoing engineering/inspection cost as the construction is taking place.

She asked if she could get a copy or have access to the Tender document and from her calculation the Memorial Park is now at over $100,000.

Mario Lapointe stated he received a call from Mr. Lawrence Donnelly regarding the issue in front of his residence at #12 Jacquet River Dr. As the problem has arisen as a result of the work done on Jacquet River Dr. last year and the amount to rectify is minimal $570, he would like to bring this back to the table again to have it cleared up.

Mario Lapointe moved that the work at #12 Jacquet River Drive, Project No. 135-11-2, for the amount of $570 (included in the $406,190.93) be included back into the scope of work for completion, seconded by Jerry Guitard. Motion carried. (2 yeas – Councillor’s Guitard & Lapointe) (1 nay – Councillor Frenette)

Smoke Free Place Act – Modifications – Update

CAO, Hughes reviewed the modification to the Act and the proposed signage recommended by the province. This is not mandatory for municipalities to do, but the province is asking them to consider placing signage.

Councillor, Lapointe said he did see where Charlo placed signs at their Spring Splash event this past weekend.

Councillor, Guitard felt it was important to place where there are children, example at the Arena.

Clerk/Treasurer, Cormier said she contacted the province to find out where citizen should report. She received a 1-866 telephone and website address for issues complaints or getting information. If the signs are going to be put up, they should have that information on them so the public knows who to contact. It should be the province as it is their piece of legislation to enforce.

  • CAO, Hughes will administer accordingly alook at and determine if and where signs should be displayed.

Culvert Installation

Jerry Guitard moved that as recommended by CAO – Report #CAO-15-18, the Culvert Installations be awarded to the only bidder, Woodcox Trucking., for the cost of $16,910.45 (HST included), seconded by Heather Frenette. Motion carried.

Financial Report – General Funds and Utility Funds

Mario Lapointe moved that the Financial Reports be accepted as presented and the Accounts Payable be paid, seconded by Heather Frenette. Motion carried.

Mayor, Bourque noted that there is an outstanding amount of $904 owed to the Village by the lawyer who was renting facilities. He questioned how we could collect. He does not want to see it cost more than necessary, but he also does not want to see this go unaddressed.

Council gave the directive to CAO to have Village legal counsel submit a letter to the lawyer for 2014 outstanding office rental space fees.

Christmas Displays, Christmas in the Park - Order

Mario Lapointe moved that as presented and directed by Council at the Committee of Whole, three (3) Christmas Displays for Christmas in the Park, be order from Dekra-Lite for the amount of $9,219.67 (HST included), plus shipping, seconded by Heather Frenette. Motion carried.

UMNB Conference Registrations

Mario Lapointe moved that Councillor, Frenette, Deputy Mayor, Culligan, Councillor, Lapointe and Mayor, Bourque register for the UMNB 2015 Conference in Fredericton from October 2-4, 2015 at the registration cost of $330 each (prior to August 21), seconded by Heather Frenette. Motion carried.

Correspondence In:

Marilyn Guitard-McDonnell - Arena Canteen Operations

  • Directive to submit a letter to Mrs. Guitard-McDonnell acknowledging receiving her letter and advising that the Council will review her proposal as the next Committee of Whole meeting on August 10, 2015.

Restigouche Multi Cultural Association - Letter of Support

  • Directive to have Mayor, Bourque submit a letter of support.

Public Safety - Fire Inspection Frequency Schedule

  • Directive to submit to Fire Chief as this would fall under his duties.
