Theactivities,controlsandassessmentcriteriaintheunderlyingMarinazone,PublicOpenSpace­SportandActiveRecreationzoneandPublicOpenSpace–InformalRecreationzone,andAuckland­widerulesapplyinthefollowingprecinctandsub­precinctsunlessotherwisespecified.Refertotheplanningmapsforthelocationandextentoftheprecinctandsub­precincts.

3.Thetotalcumulativegrossfloorareaofmarineretailactivitieswithintheprecinctmustnotexceed300m².

1.Restaurantsandcafesmustbeaccessorytomarinasandmarinerelatedsportandrecreationactivitiesbasedinthisprecinct.

2.Parkingofvehiclesincludingtrailersmustbeassociatedwithmarinesportsandrecreationactivities.

3.Theminimumnumberofvehicleparksinthesub­precinctAmustbe158.

4.VehicleparksmaybeusedfortrailerparkswithinsubprecinctBinamannerdeterminedbythelandowner.

5.TheuseofsubprecinctCforvehicleandtrailerparksmustbemanagedbythelandowner.

5.2Assessmentcriteria

Thecouncilwillconsidertherelevantassessmentcriteriabelowfortherestricteddiscretionaryactivitieslistedbelow.

1.Maintenancedredging

a.Dredgingshouldbedoneatatimethatwillavoidorminimise,adverseeffectsonrecreationalusersoftheCMA.

b.Workshoursofoperationshouldbelimitedtominimiseeffectsofnoiseanddisruptiononnearbyresidentialandopenspaceareas.

c.Dredgingshouldnot:

causeorexacerbateerosionwithintheCMAoronadjacentlandcausedamagetoexistinglawfulstructures

resultinthepermanentlossofanyhabitatofarareorendangeredspecies

d.Dredgingshouldusebestpracticemethodsandprocedures,particularlyfordredgingcontaminatedsediments,tominimisesedimentorcontaminantmobilisationanddispersal.

e.Dredgingshouldnotimpactonpublicuseofthelaunchingfacilitiesorimpactonmarineusers’safety.

2.Grandstandsandrelatedstructures.

a.Constructionorworksshouldbedoneatatimethatwillavoidorminimise,adverseeffectsonbirdroosting,nestingandfeeding,andrecreationalusersoftheCMA.

b.Constructionorworkshoursofoperationshouldbelimitedtominimiseeffectsofnoiseanddisruptiononnearbyresidentialandopenspaceareas.

c.Theform,intensityandscaleofstructuresshouldbesensitivetothemarineenvironmentandsurroundingadjoiningspacesandensureefficientuseoftheCMAbyusingtheminimumareanecessaryfortheirpurpose.

d.Thedesign,materialsandfinishshouldcomplementandenhancethecoastalenvironment,openspacesandpedestrianlinkages.

e.Thebuildingmaterialusedforstructuresshouldbeappropriatelymarinetreated,orifrelocatedorrecycledbuildingmaterialisused,itshouldbetreatedtopreventthetransferenceorintroductionofharmfulaquaticorganisms.

f.Thelocationofstructuresshouldavoidimpactsontheusersofthesportandrecreationfacilitiespresentwithintheprecinct,particularlyduringpeakboatingtimes,andshouldnotimpactonaccesstoandfromdedicatedboatstorage,cleaning,paintingandmaintenanceareas,orimpact

onusersoftheidentifiedrecreationaltrails.

6.Assessment­Discretionaryactivities

6.1Mattersofdiscretion

Whilenotlimitingtheexerciseofitsdiscretion,thecouncilmayconsidertheparticularmattersspecifiedforthediscretionaryactivitieslistedbelow:

1.Buildingsandstructuresnototherwiseprovidedfor

a.Sufficientlandshouldbeavailableforthefuturelongtermprovisionofpublicopenspace.

b.Publicaccessviaidentifiedrecreationaltrailsshouldnotberestricted.

c.Sufficientcarparkingshouldbeavailableforboatusersofthemarinaandthemarinerelatedsportandrecreationfacilities,particularlyduringpeakboatingtimes.

d.Sufficientlandshouldbeavailabletocontinuetoundertaketheenvironmentalmanagementregimeassociatedwithmanagingcontaminantsorwastematerialfromthecleaning,paintingandmaintenanceofvessels,andanypotentialreversesensitivityeffectsduetothecleaningandmaintenanceactivitiesinrelationtothepublicaccessareasshouldbeavoided,remediedormitigated.

2.Activitiesnototherwiseprovidedfor

a.Sufficientlandshouldbeavailableforthefuturelongtermprovisionofpublicopenspace.

b.Sufficientparkingshouldbeavailableforboatusersofthemarinaandthemarinerelatedsportandrecreationfacilities,particularlyduringpeakboatingtimes.
