The Osceola County Board of Supervisors Met Pursuant to Law and to Adjournment with The

The Osceola County Board of Supervisors met pursuant to law and to adjournment with the following members present: Merlin Sandersfeld, Mike Schulte, Phil Bootsma, Jayson VandeHoef and LeRoy DeBoer.

It was moved by Schulte, second by DeBoer motion unanimously carried to approve the November 17th, 2015 agenda.

VandeHoef moves to approve the November 10th, 2015 minutes. Second by Schulte. All vote aye. Motion carried.

Board member Schulte introduced the resolution hereinafter next set out and moved its adoption, seconded by board member VandeHoef; and after due consideration thereof by the Board, the Chairperson put the question upon the adoption of the said resolution and the roll being called, the following named board members voted:

Ayes-Schulte, VandeHoef, Bootsma, DeBoer, Sandersfeld. Nays-None.

Whereupon, the Chairperson declared the resolution duly adopted as hereinafter set out:

RESOLUTION NO. 12-15/16

Resolution Setting Date for a Public Hearing on the Proposal to Incur Non-Current Debt

WHEREAS, the Board of Supervisors of Osceola County, Iowa (the “County”), has established the Osceola County Urban Renewal Area 7 (the “Urban Renewal Area”) and has established the Osceola County Urban Renewal Area 7 Tax Increment Revenue Fund (the “Tax Increment Fund”) in connection therewith; and

WHEREAS, the County has undertaken the Economic Development and Blight Alleviation Sewer Improvement Project (the “Harris Sewer Project”), including funding a payment to the City of Harris, Iowa in connection with initiation, planning and designing of the Harris Sewer Project and funding certain startup, legal and administrative costs related to the authorization and initiation of the Harris Sewer Project in the Urban Renewal Area; and

WHEREAS, it has been proposed that the County facilitate an internal advance of funds in the amount of $175,000 (the “Advance”) for the purpose of paying the costs of the Harris Sewer Project, and the County desires to make the Advance eligible to be repaid from future incremental property tax revenues to be derived from the Urban Renewal Area; and

WHEREAS, pursuant to Section 331.479 of the Code of Iowa, it is now necessary to fix a date of meeting of the Board of Supervisors which it is proposed to take action to approve the Advance and to give notice thereof as required by such law;

NOW, THEREFORE, Be it resolved by the Board of Supervisors of Osceola County, Iowa, as follows:

Section 1.This Board will meet at the Courthouse, Sibley, Iowa, on the 24th day of November, 2015, at 10 o’clock a.m., at which time and place a hearing will be held and proceedings will be instituted and action taken to approve the Advance.

Section 2.The County Auditor shall publish notice of said hearing, the same being in the form attached to this resolution, which publication shall be made in a legal newspaper of general circulation in Osceola County, which publication shall be not less than four(4) nor more than twenty(20) days before the date set for the hearing.

Section 3.All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict.
