RELEASE OF LIABILITY
In consideration of the acceptance of my participation, in this event race, on behalf of myself and my crew, I release, hold harmless and covenant not to sue on account of any claims of liability for personal injury orpropertydamage caused by or resulting from the passive or active negligence on the part of the NYAC Yacht Club, Inc. (NYAC YC) and the New York Athletic Club of the City of New York, Inc. (NYAC) to the fullest extent permitted by law, relating to my participation in the event. This release is intended for the benefit of the NYAC YC and the NYAC and their officers directors, governors, members, committee members, employees, staff, instructors, agents, race officials and volunteers and affiliates and any other persons involved in or assisting in the event or the facilities where the event is conducted. I will hold all such persons and entities harmless from any claims arising from my participation in the event or that of my crew. I understand that yacht racing and related activities carry risks of injury and property damage, including serious injury and death. I knowingly assume such risks, in connection with my participation in this event. I agree to familiarize myself with, abide by and be bound by the Racing Rules of Sailing and by all other rules that govern this event and to ensure that my crews are as well. I warrant that my craft is seaworthy, in good repair and in compliance with all regulations; that I am in good health and physical condition and that I am not aware of any limitation on my ability to fully participate in the rigors of this event. I will select crews that are experienced, fit and competent to engage in competitive sailing and I will be responsible for their conduct and safety during the event. I will not use, possess or provide any alcoholic beverages during this event nor permit any use or possession on my craft or by my crews. I will inform all crew members of the conditions stated herein, and that such conditions shall apply to each crew member as a condition of their participation in the event. If any portion of this agreement and release shall be held to be invalid, then the remaining portion shall continue in full force and effect.
