Privacy Notice - Data Protection Act 1998

Shireland Collegiate Academy uses personal data about its students and is a ‘data controller’ in respect of this for the purposes of the Data Protection Act 1998. A ‘data controller’ is an organisation that is responsible for the use made of someone’s personal information.

We use this data to:

•support teaching and learning

•monitor and report on progress

•provide appropriate pastoral care

•assess the quality of our services

This data includes contact details, national curriculum assessment results, attendance information, any exclusion information and characteristics such as ethnic group, special educational needs and relevant medical information. For pupilsenrolling for post 14 qualifications, the Learning Records Service will give us the unique learner number (ULN) and may also give us details about learning or qualifications.

Data may only be used or passed on for specific purposes allowed by law to organisations which include:

Student information is held on our Computerised Information Systems (CMIS, SIMS and Coscole)to assist with the efficient organisation of the Academy. Security measures are taken to ensure that the information is kept confidential and is only available to authorised staff. The Academy is registered under the Data Protection Act and we share information in accordance with data laws to third party organisations whom havea contract with the Trust to deliver services to assist with the delivery of our day to day duties.

By law, certain information for students aged 13 has to be passed on to providers of youth support services and we must provide any information relevant to the support services’ role. We may also share certain personal data relating to children aged 16 and over with post-16 education and training providers in order to secure appropriate services for them.

Parents or the students themselves if aged 16 or over, can ask that no information beyond names and address (for students and parents) be passed on to Post 16 providers. Please inform Mrs Sheila Riley at the Academy if you wish to opt-out of this arrangement.

We will not give information about our students to anyone without your consent unless the law and our policies allow us to do so.If you want to receive a copy of the information about your son/daughter that wehold, please contact Mrs Jo Cook at the Academy.

We are required, by law, to pass some information about our pupils to the Department for Education (DfE). This information will, in turn, then be made available for use by the LA.

DfE may also share pupil level personal data that we supply to them, with third parties. This will only take place where legislation allows it to do so and it is in compliance with the Data Protection Act 1998.

Decisions on whether DfE releases this personal data to third parties are subject to a robust approval process and are based on a detailed assessment of who is requesting the data, the purpose for which it is required, the level and sensitivity of data requested and the arrangements in place to store and handle the data. To be granted access to pupil level data, requestors must comply with strict terms and conditions covering the confidentiality and handling of data, security arrangements and retention and use of the data.
