Background and Conditions Governing the Title III, Part A Grant Award

made on July 1, 2007

Findings

1. Rhode Island did not make subgrants in school year 2005-2006 pursuant to section 3114(d), which requires States receiving Title III awards to reserve a portion of their grant, up to 15 percent, to make subgrants to local educational agencies (LEAs) that experience a significant increase, as compared to the average of the two preceding fiscal years, in the percentage or number of immigrant children and youth enrolled in schools within the jurisdiction of such LEAs.

2. In their December 1, 2006 Consolidated State Performance Report (CSPR), Rhode Island did not submit achievement results for Title III students making progress in English language proficiency and attaining English language proficiency for the 2005-2006 school year. This information is required under section 3122(a)(1), (a)(3)(A)(i-iii).

3. Rhode Island did not incorporate annual measurable achievement objective (AMAO) determinations for the 2003-2004 school year into calculations to determine the subgrantees that did not meet Title III AMAOs for two or four consecutive years, and are therefore, subject to the accountability requirements under section 3122(b).

4. In their December 1, 2006 CSPR, Rhode Island did not submit information, on the acquisition of English language proficiency for all limited English Proficient (LEP) students in the State for the 2005-2006 school year, as required in sections 1111(b)(7) and 3122(a). .

If Rhode Island believes that the findings are in error or that the State and its LEAs have corrected these problems, Rhode Island may submit the relevant information or evidence that demonstrates compliance, and a description of how the problems were corrected.

Conditions

In order to respond to these findings, Rhode Island must submit to the Department by September 30, 2007:

(a) a corrective action plan describing the actions Rhode Island will take to resolve the compliance issues identified in the Attachment T Conditions document, including the specific steps that will be taken to implement the plan and a detailed timeline that sets out when each critical element of the plan will be completed; and

(b) the name of a State contact who will be responsible for ensuring that the corrective action plan is implemented and that any reports or evidence submitted to the Department to document Rhode Island’s progress in meeting the timelines are accurate and complete.
