1.INTRODUCTION

1.1 An Bord Pleanála is a non-commercial semi-state body, which has the responsibility for determining planning appeals and other matters.

1.2 The Board invites tenders for a domestic and overseas courier service (Ireland, Northern Ireland and Great Britain in the main).

1.3 There were approximately 1000 call outs during 2008 including 365 nationwide overnight consignments and 170 overseas overnight consignments.

1.4The tendering procedure is Open and the contract will be for a period of three years from the date of commencement of contract and may be extended in certain circumstances dependent on performance, quality of work, price and level of service.

1.5 A detailed specification of requirements is set out in Section 6.

2.FORMAT OF TENDER

2.1Tenders must address all the requirements specified and must be in the format requested below. Tenders not in this format will not be considered.

2.2The following must be supplied:

Name, address, telephone number, e-mail address and fax number of tenderer.
Confirmation of acceptance by the tenderer and any third parties of the conditions of tender described in section 5 below,’ General Conditions of Tender’ of the invitation to tender.
Details of their client/customer base and the level of services provided to that base. The names of companies [must be at least three] where similar service is being provided.
  • Details for at least three referees who may be contacted on a confidential basis see Appendix 2
  • A declaration of bonafide in the form of Appendix 6 attached hereto.
  • An appropriate financial profile for the last three years must be provided including, in the case of corporate entities, independently audited accounts. Where a tenderer is trading for less than three years accounts for each year of trading must be provided.

2.3 A brief profile of the company must be supplied incorporating the following:

  • Length of time in existence.
  • Number of employees, both general and staff involved in deliveries/collections.
  • A short description of the company’s principal areas of activity.
  • Details on the provision of volume courier services.
  • A declaration of company details in the form of Appendix 3 attached hereto.

2.4Textual response on a point by point basis outlining how the requirements specified in each section will be met and all appendices completed.

2.5Confirm that the tender holds good for 90 days after the closing date for receipt of tenders.

2.6A contract will be concluded with the tenderer whose tender is deemed to be the most economically advantageous subject to agreement on conditions of contract. Please note the following:

Any terms and conditions in the proposed contract does not imply acceptance by the Board.
All works carried out shall be governed by the Laws of Ireland and subject to the exclusive jurisdiction of the Courts of Ireland.
The Board may cancel the tender process at any time prior to a contract being entered into.

2.7Tenderers must submit evidence of appropriate insurance including employers and public liability.

2.8Tenderers must provide a statement of the percentage and aspects of business that were subcontracted (if any) in past 18 months.

2.9Tenderers must submit details that the company has a Health and Safety Policy in operation in accordance with the Health and Safety Act 2005.

2.10 Whilst every effort has been made to adequately describe the requirements arising from this procurement, it is for tenderers to satisfy themselves regarding the nature and extent of the services to be provided and should therefore provide any other information which may be relevant to this proposal.

3.EXAMINATION AND EVALUATION OF TENDERS

3.1Tenders will be examined initially by reference to the following:

Completeness of proposals and tender documentation as specified in each Section of this document.
Stated ability of the tenderer to meet all the requirements specified.
Statement that none of the circumstances listed in paragraphs 1 and 2 of Article 45 of EU Directive 2004/18/EC (copy attached) apply to the tenderer.
Technical capacity, relevant experience and financial standing as evidenced by the information requested above.

3.2Only those tenders who satisfy conditions in relation to the above will be eligible for inclusion in the award process. See Appendix 7.

4.AWARD CRITERIA

4.1The contract will be awarded to the most economically advantageoustenderof those meeting the specifications set out in this document, and not otherwise validly excluded, on the basis of the following award criteria [ scored from 200 marks weighted as indicated]

4.1.1Technical capacity for providing all services 40 marks

4.1.2The management and service structure: quality of delivery fleet 30 marks

expertise and skills of personnel 30 marks

4.1.3The cost of providing the service as per attached Appendix 1 (2 parts) 60marks.

4.1.4Time frame for delivery of service 40 marks

4.2During the evaluation period clarification may be sought in writing/by e-mail from tenderers. Responses to requests for clarification may not materially change any of the elements of the tenders submitted. No unsolicited communications from tenderers will be entertained during the evaluation period. A number of the most competitive tenderers may be invited to make presentations on their proposals for the purpose of elaboration, clarification and/or aiding mutual understanding. Invited tenderers must be in a position to make such a presentation.

5.GENERAL CONDITIONS OF TENDER

5.1Tenders should be prepared in English or Irish and are subject to the following:

5.1.1This Request for Tender shall form part of the contract documents.

5.1.2Tenderers should be aware that national legislation applies in other matters such as Data Protection and Health and Safety.

5.1.3Tenderers must have regard to statutory terms relating to minimum pay and to legally binding industrial or sectoral agreements in preparing tenders.

5.1.4Information supplied by tenderers will be treated as contractually binding. However, the Board reserves the right to seek clarification or verification of any such information.

5.1.5Any conflicts of interest involving a tenderer must be fully disclosed to the Board particularly where there is a conflict of interest in relation to any recommendations or proposals put forward by the tenderer.

5.1.6Any registerable interest involving the tenderer and the Board, members of the Government, members of the Oireachtas or their relatives must be fully disclosed in the response to this RFT, or should be communicated to the Board immediately upon such information becoming known to the tenderer, in the event of this information only coming to their notice after the submission of a bid and prior to the award of the contract. The terms 'registerable interest' and 'relative' shall be interpreted as per section 2 of the Ethics in Public Office Act, 1994.

5.1.7Before a contract is awarded the successful tenderer (and agent, where appropriate) will be required to promptly produce a Tax Clearance Certificate, or in the case of a non-resident tenderer, a statement from the Revenue Commissioners confirming suitability on tax grounds. Non-residents should contact the Office of the Revenue Commissioners, Revenue Residence Section, Government Offices, Nenagh Co. Tipperary. In addition, contractors must retain records of tax reference numbers for any subcontractors where payments exceed €650 (incl.VAT).

5.1.8Tenderers should note that the provisions of Department of Finance Circular 22/95 apply and the Board may require sight of Tax Clearance Certificates for any subcontractor where payments exceed €2,600. Forms are attainable from the following address: Office of the Revenue Commissioners, Sarsfield House, Limerick. Where a Tax Clearance Certificate expires within the course of the contract, the Board reserves the right to seek a renewed certificate. All payments under the contract will be conditional on the contractor(s) being in possession of a valid certificate at all times.

5.1.9The successful tenderer shall be responsible for the delivery of all services provided for within the contract on the basis of a fixed price agreement set at the beginning of the contract. The contract is for a three year period from the date of commencement of contract subject to 6 monthly reviews, it may be extended in certain circumstances dependent on performance, quality of work, price and level of service. Prices quoted in the tender cannot be increased during the currency of the tender. Similarly, terms and conditions cannot be altered.

5.1.10The Board retains the right to withhold payment where a contractor has failed to meet its contractual obligations in relation to the delivery of services to an acceptable level of quality.

5.1.11An Bord Pleanála shall have the right to terminate the contract in the event of non compliance with the terms of the contract by the service provider, and to forthwith substitute a courier provider of its own election. In the event of termination in such circumstances, the service provider will be liable for any loss (including consequential loss) or delay suffered by An Bord Pleanála in obtaining alternative courier services.

5.1.12The Boardwill not be liable in respect of any costs incurred by tenderers in the preparation of tenders or any associated work effort.

5.1.13 The Board is not bound to accept the lowest or any tender submitted.

5.1.14Responses to this RFT will be evaluated in their own right. No recognition will be given to information previously submitted.

5.1.15The Board undertakes to hold confidential any material provided in response to this tender subject to their obligations under the Freedom of Information Acts (FOI), 1997 and 2003. Tenderers are asked to consider if any of the information supplied in response to this notice should not be disclosed because of its sensitivity. If this is the case, tenderers should when providing the information identify it and specify the reasons for its sensitivity. The Board shall consult with tenderers about sensitive information before making a decision on any freedom of information request received. If tenderers consider that none of the information supplied by them is sensitive, they should make a statement to that effect. Such information may be released in response to an FOI request.

5.2Tenders must be completed in accordance with the format specified in Section 2.

5.2.1Tenders which are incomplete will not be evaluated.

Four copies of the tender and one CD in a sealed envelope, marked“Tender for Courier Services PP/80” should be delivered to the following address not later than 4.00pm on25th May, 2009 and addressed to: Mr. Chris Clarke, Secretary, An Bord Pleanála, 64 Marlborough Street, Dublin 1, Ireland. Faxed or emailed tenders will not be considered.

Tenders delivered after this time will not be accepted.

5.3All prices must be quoted in euro (€) with the applicable rate of VAT in respect of each of the services shown separately. Where prices are linked to non-euro currency the relevant exchange rate must be quoted with the date and source of the exchange rate provided. Indicate clearly any discounts. Payment terms must also be specified.

The Board is not responsible for any errors on the calculation of the costs.

5.4The successful tenderer will be required to ensure that all couriers assigned to the contract carry appropriate identification identifying them as bonafide members of the company.

6.SPECIFICATION OF REQUIREMENTS

6.1A domestic and overseas courier service comprising;

6.2 Consignments Charges:

- Domestic services (Ireland) by dimension.

-Non-domestic services by dimension/weight.

6.3 Requirements of Service:

-The capacity to make several collections/deliveries throughout the working day and on occasion out of working hours.

-Deliver overnight items up to 5pm to the offices of the Board the next day.

-A pick up deadline up to 5pm from the offices of the Board for all delivery areas.

-The capacity to facilitate emergency same day collections/deliveries nationwide.

-An on line booking system for use by the Board.

-Prompt notification of problems or delays by phone and email.

-A detailed invoice containing the following information for domestic service; i.e. date/Board reference number/mode of carrier/collection and delivery points /journey rate per km. Similar details are necessary for overseas billing.

In the event that a third party needs to be engaged to collect/deliver any item from a recipient to complete the service, all the conditions to this tender shall be considered to equally apply to that third party. However, the responsibility for delivery and/or collection shall remain at all times with the courier company selected by this tender competition.

7.FINANCIAL ARRANGEMENTS

7.1Payment for services covered by this invitation to tender will be on foot of appropriate invoices, which will be based on agreed deliverables. Invoicing arrangements will be agreed with the successful service provider, following the award of contract. A contract entered into on foot of this Request for Tender is subject to the Prompt Payments of Accounts Act.

7.2 Each invoice from the service provider shall include, as a minimum, the following information:

(a) the full business name and registered address of the service provider;

(b) the service provider’s Value Added Tax registration number;

(c) details of the services to which the invoice relates as outlined in paragraph 6.3 above;

(d) details of any service credits due to An Bord Pleanála;

(e) the total charged excluding Value Added Tax;

(f) the Value Added Tax charged;

(g) the total sum payable (including VAT).

7.3Invoices shall be submitted only after the services to which the invoice relates have been performed to the satisfaction of An Bord Pleanála.

8.1Every effort has been made to ensure that this documentation contains all the necessary information for completion of tenders. However, in the interests of equity, requests for additional information and clarification on the content of this document and all other queries of substance (other than in relation to purely factual or procedural matters) must be made in writing or by email. Any additional information elicited will be made available to all potential tenderers who have obtained a copy of this document via the etenders website or directly from An Bord Pleánala.

9.ARTICLE 45 OF EU DIRECTIVE 2004/18/EC

Personal situation of the candidate or tenderer

1.Any candidate or tenderer who has been the subject of a conviction by definitive judgment of which the contracting authority is aware for one or more of the reasons listed below shall be excluded from participation in a public contract:

(a)participation in a criminal organisation, as defined in Article2(1) of Council Joint Action98/733/JHA[1];

(b)corruption, as defined in Article3 of the Council Act of 26May1997[2] and Article3(1) of Council Joint Action98/742/JHA[3] respectively;

(c)fraud within the meaning of Article1 of the Convention relating to the protection of the financial interests of the European Communities[4];

(d)money laundering, as defined in Article 1 of Council Directive 91/308/EEC of 10June1991 on prevention of the use of the financial system for the purpose of money laundering[5].

Member States shall specify, in accordance with their national law and having regard for Community law, the implementing conditions for this paragraph.

They may provide for a derogation from the requirement referred to in the first subparagraph for overriding requirements in the general interest.

For the purposes of this paragraph, the contracting authorities shall, where appropriate, ask candidates or tenderers to supply the documents referred to in paragraph 3 and may, where they have doubts concerning the personal situation of such candidates or tenderers, also apply to the competent authorities to obtain any information they consider necessary on the personal situation of the candidates or tenderers concerned. Where the information concerns a candidate or tenderer established in a State other than that of the contracting authority, the contracting authority may seek the cooperation of the competent authorities. Having regard for the national laws of the Member State where the candidates or tenderers are established, such requests shall relate to legal and/or natural persons, including, if appropriate, company directors and any person having powers of representation, decision or control in respect of the candidate or tenderer.

2.Any economic operator may be excluded from participation in a contract who:

(a)is bankrupt or is being wound up, whose affairs are being administered by the court, who has entered into an arrangement with creditors, who has suspended business activities or who is in any analogous situation arising from a similar procedure under national laws and regulations;

(b)is the subject of proceedings for a declaration of bankruptcy, for an order for compulsory winding up or administration by the court or of an arrangement with creditors or of any other similar proceedings under national laws and regulations;

(c)has been convicted by a judgment which has the force of res judicata in accordance with the legal provisions of the country of any offence concerning his professional conduct;

(d)has been guilty of grave professional misconduct proven by any means which the contracting authorities can demonstrate;

(e)has not fulfilled obligations relating to the payment of social security contributions in accordance with the legal provisions of the country in which he is established or with those of the country of the contracting authority;

(f)has not fulfilled obligations relating to the payment of taxes in accordance with the legal provisions of the country in which he is established or with those of the country of the contracting authority;

(g)is guilty of serious misrepresentation in supplying the information required under this Section or has not supplied such information.

Member States shall specify, in accordance with their national law and having regard for Community law, the implementing conditions for this paragraph.

3.Contracting authorities shall accept the following as sufficient evidence that none of the cases specified in paragraphs1 or 2(a), (b), (c), (e) or (f) applies to the economic operator:

(a)as regards paragraphs1 and 2(a), (b) and (c), the production of an extract from the "judicial record" or, failing that, of an equivalent document issued by a competent judicial or administrative authority in the country of origin or the country whence that person comes showing that these requirements have been met;

(b)as regards paragraph2(e) and (f), a certificate issued by the competent authority in the Member State concerned.
