WHEREAS Block F, Plan 2572 KS; located north of Stony Plain Road NW and west of 218 Street NW, Winterburn Industrial Area West,Edmonton, Alberta, is specified on the Zoning Map as (CHY) Highway Corridor Zone; and

WHEREAS an application was made to rezone the above described property to (IB) Industrial Business Zone;

NOW THEREFORE after due compliance with the relevant provisions of the Municipal Government Act RSA 2000, ch. M-26, as amended, the Municipal Council of the City of Edmonton duly assembled enacts as follows:

  1. The Zoning Map, being Part III to Bylaw 12800 The Edmonton Zoning Bylaw is hereby amended by rezoning the lands legally described asBlock F, Plan 2572 KS; located north of Stony Plain Road NW and west of 218 Street NW, Winterburn Industrial Area West, Edmonton, Alberta, which lands are shown on the sketch plan annexed hereto as Schedule “A”, from (CHY) Highway Corridor Zone to (IB) Industrial Business Zone.

DISCUSSION

1.The Application

This application proposes to rezone a site from (CHY) Highway Corridor Zone to (IB) Industrial Business Zone in the Winterburn Industrial area. The purpose of the IB Zone is to provide for industrial businesses and compatible commercial businesses that carry out their operations such that no nuisance is created or apparent outside an enclosed building. The Zone is specifically intended for sites on the periphery of industrial areas adjacent to arterial or major collector roadways. The applicant’s stated intent is to develop a site for the repair and maintenance of recreation vehicles such as motorhomes, trailers, and campers.

2.Site and Surrounding Area

The subject site, 0.97 ha in size, is currently undeveloped and is located north of Stony Plain Road and west of 218Street. Lands to the west, north, east, and south are zoned CHY, IB, IB, and (AGI) Industrial Reserve respectively. The site to the west is developed with motel buildings and accessory uses. A house is developed on the property to the north. The site to the east is developed with recreational vehicle storage. The lands to the south, across Stony Plain Road, remain in a rural/agricultural state.

ANALYSIS

1.Compliance with Approved Plans and Land Use Compatibility

The Winterburn Industrial Area Structure Plan (ASP) is in effect for the lands north of Stony Plain Road. The ASP states that high standard industrial developments will be permitted adjacent to primary highways that border the plan area. The proposed IB Zone conforms to the intent of the ASP as the regulations provide for highest standard of industrial development of any of the City of Edmonton’s industrial zones. Additionally, because the site fronts onto Stony Plain Road, it is also subject to the additional development regulations of the Major Commercial Corridors Overlay.

The land uses available under the proposed IB Zone are compatible with the existing motel, house, and recreational vehicle storage facility to the west, north, and east respectively, as well as redevelopment opportunities for these surrounding properties under their existing CHY and IB Zones. The proposed IB Zone is also compatible with future development on the south side of Stony Plain Road where the lands are designated for Industrial Business uses as per the Lewis Farms ASP.

2.Environmental Review

The applicant submitted environmental information regarding the subject site in support of the rezoning application. The Planning and Development Department, the Transportation and Streets Department, Capital Health, and Alberta Environment have accepted the information and deemed the site environmentally suitable for industrial business development.

3.Transportation and Utilities

The Transportation and Streets Department and the affected utility departments and agencies expressed no objections to the proposed rezoning. Water service is available by connection to a water pipeline in a right-of-way that crosses the northern portion of the subject site. Temporary sanitary and stormwater management facilities shall be provided on-site at the Development Permit stage.

4.Surrounding Property Owners’ Concerns

Advance notices were mailed to the owners of 16 surrounding property owners, the Westview Village Community Association, and the WardCouncillors on June 6, 2005. The Planning and Development Department did not receive any calls or letters in response to the advance notice.

JUSTIFICATION

The Planning and Development Department recommends that Bylaw14097 be APPROVED on the basis that development opportunities under the proposed IB Zone conform to the Winterburn Industrial ASP and are compatible with the existing uses and future development opportunities on the surrounding properties.
