MINUTES

l. CALL TO ORDER

The January 14, 2010 meeting of the State of Delaware’s Architectural Accessibility Board was called to order by the Acting Chairman, Chad Toms. In addition to Mr. Toms, the record will show that the following members were also in attendance: Nash Childs, Neil Himelein and Chang Yoon. Participating by telephone hook up: Armando Liberti and Wayne Carter.

. II. APPROVAL OF PREVIOUS MINUTES

A motion to approve the minutes of the Board’s previous meeting, held on December 9, 2009, was made and seconded. By a unanimous vote, the minutes were approved as recorded.

III. DISCUSSION OF AGENDA

The Chief Administrator added three (3) cases to the agenda as follows:

1. 09068-RE Howard H.S. Science Lab

2. 09071 R & R Building - Painting

3. 09072 Wilson & Foulk Roads (Del DOT)

IV. CHIEF ADMINISTRATOR’S UPDATE

The Chief Administrator reported to the Board on his activities for the month. The activities were routine in nature and consisted of normal field inspections, complaint issues, and accessibility inquiries.

V. SUBMISSIONS REVIEW COMMITTEE REPORT

At their December 17, 2009 meeting, the Submissions Review Committee reviewed two (2) cases. These cases were forwarded to the full Board for their review. The Board’s comments and actions on these cases, and for the additional three (3) cases submitted by the Chief Administrator, are attached as a part of these minutes.

VI.  OLD BUSINESS

Once again, the matter of the AAB being prohibited (by State code) from any/all accessibility issues involving polling places was discussed. This prohibition had been discussed by the Board on several prior occasions. Mr. Brian Hartman, from the Disabilities Law Program (within the Community Legal Aid Society) presented the draft legislation that he prepared that would remove the prohibiting provision(s) which would then allow the AAB’s involvement (when necessary or requested) at polling place sites. It was felt that the AAB may be excluded from accessibility matters in ‘covered’ facilities that would normally fall under the AAB’s purview, by virtue of it being considered a ‘polling’ place. The Board, as previously debated, felt a facility was only a polling site on the day of election. However, it was generally agreed by all that the code should not exclude the AAB from polling places and the said code provisions should be amended to reflect this. Further discussion reflected the Board’s position that it was not the AAB’s mission, or intent, to determine polling sites. Their involvement would be, as with all other covered facilities, to determine that planned alterations were compliant with accessibility requirements. Mr. Hartman understood the Board’s concerns and agreed to restructure some of the language in his draft legislation and get back to the Board for further review.

VII.  NEW BUSINESS

There was no new business.

VIII. SCHEDULE OF NEXT MEETING

The next meeting of the Architectural Accessibility Board was scheduled for Thursday, February 4, 2010, at 2:00 PM. The location will be the State Police Troop 2 Facility.

COMMENTS / This project was not approved because of
corrections required on the design of the stair
handrails, as well as insufficient detail on the
casework in the science lab and for the laboratory
sink/work station areas. These items were
adequately addressed. In addition, the toilet rooms
serving this primary function area were not found
to be in compliance and are now being upgraded
within the scope of this project. The design for
these upgrades is acceptable.

Addition and Renovations

COMMENT / The project consists of constructing a small
addition for this existing school and completing a
wide variety of accessibility repairs/alterations
throughout the school. The design of the addition
appears to be acceptable. The plans and drawings,
as they pertained to the repair work, were
confusing and hard to understand. The committee
could not be sure what repair work was actually
being proposed. Mr. Tony Vassolotti, on behalf of
the architect, was present to explain those areas on
the plans and drawings that were actually
confusing due in large part to the way the
drawings were reprinted. The Board was satisfied
that the proposed upgrades to these various
elements and spaces were also acceptable.

Intersection Improvements

COMMENT / The project is for the roadway improvements at
the Foulk and Wilson Rds. intersection. Several
curb ramps will be installed for pedestrian traffic
crossing the roadways. The detail for these ramps
is correct, along with the cross walks and pass-thru
islands.
