September 11, 1946

Minutes of a regular meeting of the Orem City Council held September 11, 1946 in the Orem City Hall at 8:10 PM. The following members were present: Mayor J. W. Gillman, Councilmen James G. Stratton, Woodruff Jensen, Roy H. Gappmayer, Vern Williams, Ephraim E. Twitchell and clerk Orland E. Pyne. Mayor J. W. Gillman was in charge of the meeting.

Mayor Gillman reported on his visit to the Pl. Grove Cannery in regard to waste material being dumped west of the cannery. Citizens living near there are complaining of the stench. Nothing definite was decided as to what was to be done about it. He also read a letter from the BYU regarding advertising of the opening of football season. They asked for permission to fly a plane over the city and drop leaflets. It was agreed by the council that they be given permission to go ahead.

Elmo Martin and Ted Bandley of Mart & Ban's were present concerning the beer license issued them by the city. A License was issued in error as the Zoning ordinance definitely prohibits the sale of beer in an industrial area. The council decided to take up the matter with the Planning and Zoning Commission and determine whether or not a commercial district should be allowed in the area of Mart Ban's cafe. In the meantime Mr. Martin and Mr. Bandley were given permission to operate as before until the matter could be settled properly.

The problem of getting water to the High School was discussed with Mr. Pierce. After going over the situation thoroughly it was decided to install an 8 inch line from the highway on 8th south to the High School that is if it is possible to purchase the pipe and fixtures. If that is not possible now, a valve is to be installed at the end of the 3 inch line on 8th South. It was decided to bet the necessary parts for the Booster Pump if that was needed.

Jolley Motor Co. presented some literature on fire fighting equipment. The estimated cost of a Mack Fire Truck, 500 gallon capacity fully equipped would cost around $7,000.00. The Council informed Mr. Jolley that they would notify him if they decided to order a new truck from him. He recommended that the council go to Payson and inspect their fire truck which was purchased last year.

It was moved by Councilman James G. Stratton that Mayor Gillman be given a check for $40.72 to replace money spent by him for the Municipal Convention in Cedar City, seconded by Councilman Ephraim E. Twitchell and passed.

A copy of a letter written by the Mayor to Attorney Skeen about the culvert on 4th North Street was read by him to the council.

The water rates were discussed by the council. It was felt that the 20¢ per thousand gallon rate was much too high since sufficient water was available for use. No decision was made.

The well at Scera was discussed before Mr. Victor Anderson was invited in to the meeting. Mr. Anderson upon his arrival explained the situation as to drilling of a new well or completing the old one but that he had not been able to get at it. He presented a proposition from the Scera Board whereby the Scera would be willing to furnish the 275 feet of 12 inch casing on the ground back of the theatre and a new Pamona Pump if the city would be willing to assume the responsibility of finishing and operating the well provided Scera be given sufficient water for cooling purposes. The Council agreed that the proposition should be accepted and a meeting between the council and the Scera Board was set for 6:00 P.M. Sept. 12, 1946 at the Auditorium.

The Planning and Zoning Commission was invited in to discuss the Zoning ordinance as to putting a Commercial District in part of the Industrial Area in the City. After discussing the situation it was decided that probably the highway should be opened up for the full length as far as the city limits extended, although it was admitted that to open to business would be inviting a certain type of undesirable element. The matter was put aside for the time being until the next meeting.

The Ordinance regulating a subdivision of land as prepared by the city Attorney and the Planning and Zoning Commission was read by the clerk. It was decided that the Planning & Zoning Commission should go over the ordinance and double check it, in the meantime the clerk was instructed to publish notice of hearing for September 30, 1946 in the Orem City Hall at 8:00 PM.

Councilman Woodruff Jensen reported on contact with Joseph Clegg in regard to sewer right-of-way through his property. The situation was reported to Engineer Hugo Price. Mr. Price stated that he would take care of it.
