MERCER POINT CONDOMINIUM RULES AND REGULATIONS

I. INTRODUCTION

The following RULES AND REGULATIONS documents are a quick and clear distillation of our common community standards taken directly from the larger volume of rules and regulations found in the MERCER POINT CONDOMINIUM DOCUMENTS AND DECLARATIONS.

III. MONTHLY ASSOCIATION FEES: 2012

Monthly Association fees are due the 1st of every month. If not paid by the 10th of each month, a ten percent 10% late fee will be additionally charged. Direct deposit is available. Please contact the property manager for further information on direct deposit or any fees questions and concerns.

Association fees provide for the following amenities:

a)Insurances, b)fire protection,c)building maintenance, d)gate maintenance, e)pool maintenance, f)gym maintenance, g)landscaping, h)waste management (compactor),i)property management, j)legal advice and k)termite/pest control.

FAILURE TO PAY any fee, dues or fines after 60 consecutive days will result in the loss of Mercer Point common area use, to include parking within the gated community. Both owner and tenant access cards will be shut off until arrangements have been made to rectify debts.

IV. MERCER POINT RULES AND REGULATIONS

The following rules and regulations have been adopted by Mercer Point Condominium Association to promote a safe and harmonious community. The Association has the right to amend these rules and regulations to better serve changing community needs. We ask for your full cooperation in abiding in these rules and regulations.

Fines can be issued for repeated violations.

  1. PETS. Dogs must be kept on leash at all times on property. Owners are responsible for picking up after their pets. (3) dog-care stations have been purchased and are daily maintained so residence can clean up after their dogs. If owners fail to properly pick up after their pets, fines will be levied. Full bread Pit Bull terriers, Dobermans and Rottweilers are NOT permitted.
  1. FEEDING WILDLIFE. Feeding of any outdoor animals, INCLUDING CATS, on Mercer Point property, is strictly forbidden.
  1. SPEED LIMITS ON PROPERTY. Maximum speed limits anywhere on Mercer Point Property

is 10 MPH. This is a major safety concern and will be strictly enforced.

  1. PARKING RULES AND RESTRICTIONS.

a)There are a number of handicap and no parking areas at Mercer Point. Vehicles illegally parked will be towed at the owner’s expense.

b)All vehicles must be properly licensed, insured, and in good working order and appearance. Vehicles deemed inoperable (can not move under its own power/flat tires, visibly damaged) will have 5 days to correct this condition, or the vehicle will be towed at owner expense or contact the Property Manager to coordinate additional time consideration if necessary.

c)All parked vehicles must maintain a visible license plate with current tag registration. Vehicles failing such maintenance will be considered abandoned and towed.

d)Repair or extraordinary maintenance on vehicles will not be performed on Mercer Point property. Changing of any fluids in any parking area is also strictly forbidden.

e)Only approved motor vehicles are authorized to park in the GATED parking areas overnight. “Approved” motor vehicles include all conventional passenger cars, trucks, vans, motorcycles. Boats and small recreation trailers are allowed to be parked at Mercer Point but only in the back lot facing buildings 8 and 9 for a monthly fee. See the property manager for information on renting a slip. UNAUTHORIZED vehicles include campers, motor homes, horse/construction trailers, and commercial rigs of any kind to include county/city vehicles and any vehicle with more than 2 axles. Commercial vehicles must be parked in the front parking area overnight.

f)Any OVERSIZED VEHICLES that cannot properly fit in any parking space are also prohibited.

g)No single, mobile storage units are allowed to be placed in the parking lots without prior written approval by the Property Manager.

h)Temporary loading/unloading of unauthorized vehicles can be approved. Contact the Property Manager in advance for clearance and guidance on proceeding.

  1. SALE/RENT SIGNS. No sign of any kind can be posted in common areas. Signs may be placed in windows and should be professionally done.
  1. STRUCTURAL CHANGES.

a)Owners are not permitted to make any changes to the exterior of the unit or common elements. This includes adding signs, antennas, flags, dishes, etc.

b)Owners are required to receive approval from the Board or Architect Control Committee prior to alteration of the interior of their units if any weight-bearing walls will be changed/altered.

c)All alteration work must be completed within 90 days of commencement.

  1. BUILDING MAINTENANCE. The Association is responsible for the maintenance of the exteriors of all buildings. Unit owners are responsible for maintaining exterior windows, window casings, window screens, all exterior doors and screen-in porches if applicable. Should damage occur to any of these exterior items, unit owners are expected to fix these damages immediately or face fines.
  1. INSURANCE. Each owner is responsible for purchasing condo owner’s insurance coverage sufficient to cover all content and upgrades to structure.
  1. SMOKING POLICY. Currently all breezeways are deemed “No Smoking” areas. This policy is currently under review for further clarification of ‘allowed’ smoking areas.
  1. QUIET HOURS. Mercer Point enforces a 7 days a week QUIET HOUR policy between 10pm and 7AM. Be kind and courteous to community neighbors by keeping noise to a minimum during these periods.
  1. CONDO USE RESTRICTIONS

a)Owners are responsible for ensuring that all rules and regulations of the association are followed by the owner’s family, guest occupants and tenants. This includes financial responsibility to repair and or replace anything on property damaged by the owner’s family, guest occupants or tenants.

b)Units are for residential use only. Any business activities on premise must be limited in size and scope as to not increase traffic in/out of the condo and encumber parking.

c)Total occupant number is limited to 2 per bedroom.

d)No objects other than potted plants and patio furniture shall be placed on a porch. This includes the storage of bikes and any grilling equipment other than electric grills.

  1. No Owner or Occupant of a Unit may, at any time endanger the health, unreasonably annoy or disturb or cause the embarrassment or discomfort to other Owners or Occupants
  2. No Owner or Occupant of a Unit will be allowed to generate community disturbing noises, including the loud use of stereos or televisions.
  3. The display or discharge of firearms or fireworks on the Common Elements or Limited Common Elements is prohibited. The term "firearms" includes "B-B" guns, pellet guns
  4. No signs, advertising posters, flyers, political placards or billboards of any kind shall be erected, placed, or permitted to remain anywhere in the Condominium without the prior written consent of the Board or its designee
  5. All rubbish, trash, and garbage shall be regularly removed from the Unit and shall not be allowed to accumulate
  6. All breezeways must be free of trash at all times. Garbage shall be disposed of in sealed bags and placed in the trash dumpster.
  7. Garage sales, yard sales, flea markets, or similar activities are prohibited unless approved in writing by the Board.
  8. All breezeways are zoned NO SMOKING. Do not dispose of cigarettes in any common area, breezeway, grass area or parking.
  9. Garage doors shall remain closed at all times unless in use.
  10. Flammable and combustible materials can not be stored in any unit or in garages or storage areas.
  11. Grilling is strictly prohibited on or around patio areas. The use of gas or charcoal grills is prohibited at all times, with the exception of grills provided on the property.
  12. The garbage compactor is for bagged household garbage only. Do not leave junked appliances, furniture or any other items in front of the compactor as this requires additional money to dispose of. Fines will be levied to any resident abandoning garbage near the compactor.
  13. Any persons observed performing vandalism, in any manner, will be prosecuted. This includes trespassing into the pool area after hours. Call 911 and request immediate police assistance. OWNERS are legally and financially responsible for the conduct of renters. Parents will be held responsible for the actions of children.
  1. LEASING "Leasing," is defined as regular, exclusive occupancy of a Unit by Persons other than the Owner. Leasing of all Units shall be governed by the following provisions;

a)Notice of at least seven (7) days prior to entering into the lease of a Unit, the Owner shall provide the Board or management with a copy of the proposed lease agreement.

b)Units may be leased only in their entirety. All leases shall be in writing and in a form approved by the Board prior to the effective date of the lease

c)There shall be no subleasing of Units or assignment of leases without prior written Board approval All leases must be for an initial term of not less than six (6) months

Failure to abide in all the above rules can result in fines being imposed against unit owners. In accordance with Condo rule amendments, ‘The use of common areas are prohibited by owners and tenants if amenities are delinquent. Units that are delinquent longer than 60 days will lose both pool and parking privileges as their access cards will be deactivated.’ Cars will be allowed to park in the lot in front of the club house only.

V. POOL USE RULES

The following rules have been adopted by the Mercer Point Condo Association for the protection and benefit of our community to ensure safe and sanitary operations of the pool. We request full cooperation of both owners and guests while using the pool.

  1. Use of the pool is ONLY permitted during posted pool hours. Violators are subject to fines and charges of trespassing.
  2. All residents in good financial standing are welcome to use the pool. The Board of Directors reserves the right to check or challenge ‘residency’ of all entering the pool area.
  3. Children shall not use the pool without an adult in attendance.
  4. Children, three years old and younger, as well as any child not potty trained, must wear snug fitting plastic pants or a water resistant swim diaper.
  5. Children under the age of 18 must be accompanied by a supervising adult. Minors are NEVER allowed to be in the pool area without constant parental oversight. Parents are responsible for the safety and conduct of their children.
  6. Each unit is allowed a maximum of 2 guests in the pool area and the unit resident MUST be in the pool area with all guests. Exceptions for visiting guests and family can be made through management.
  7. Non-residents or unapproved guests will be kindly asked to leave the property or face trespassing charges.
  8. Persons suspected of being under alcohol and drug influences will be asked to leave the pool area.
  9. No running or rough play allowed.
  10. No diving or splashing in or around the pool.
  11. No jumping or screaming in or around the pool.
  12. No spitting, spouting of water or blowing nose in pool.
  13. No “cut-offs” allowed.
  14. No swimming allowed during heavy rain or when thunder and lightning can be seen or heard.
  15. No glass articles allowed in or around pool.
  16. No food, drink or wrappers shall be permitted within ten feet (10’) of the swimming pool or spa.
  17. All trash will be properly kept and disposed of by pool users.
  18. No pets allowed in the pool area.
  19. Pool parties (groups larger than 10 people in one gathering) must be pre-approved by management.
  20. Any games that involve throwing items will be moved outside the pool gate to the common grass area surrounding the pool.
  21. Unattended solo bathing is prohibited.
  22. Only one bather at a time allowed on diving board.
  23. Diving area must be clear of other patrons before diving is permitted.
  24. If there are any emergencies, trespassing or serious conduct issues in the pool area at any time, please contact the police by calling 911.

VI. FINES

The following fine increments have been voted upon by the Mercer Point Condo Association Board and will be administered for all violations of Rules and Regulations.

*** FIRST TIME VIOLATION- WRITTEN WARNING

*** SECOND VIOLATION (for same infringement) - $100 FINE

*** THIRD VIOLATION (for same infringement) - $250 FINE

*** FOURTH VIOLATION (for same infringement) - $250 FINE and loss of amenities for one month
