General membership terms and conditions (effective 1 July 2016)

Terms and conditions

Parties to application

The “Centre” refers to Melbourne City Council (MCC) trading as Melbourne City Baths. The “Customer” refers to you.

Customer details

The Customer is responsible for notifying the Centre of any changes to their personal details by completing a customer amendment form available at reception.

Student membership

A student membership is available for full time Australian tertiary students on presentation of valid student card showing the student is full time and an expiry date. Alternatively a student may present a letter from their education institution stating that they are a full time student and the end date of their course. On expiry of student status a student may upgrade their membership or cancel their membership in accordance with these conditions. Failure to produce a proof of student status will result in the termination of membership.

Concession membership

A concession membership is available for holders of a valid Australian Health Care or pension card. On expiry of a concession card the member may present their updated concession card, upgrade their membership or cancel their membership in accordance with these conditions. Failure to produce proof of concession status will result in the termination of your membership.

Administration fee

It is the Customer’s responsibility to ensure that the Centre can successfully debit the nominated account. Should your payment be dishonored, an $20 administration fee will be charged in addition to your outstanding direct debit amount. These fees will be required to be paid in full upon your next visit or the Centre will retrieve any outstanding funds on your next scheduled debit day. In the event of payments being dishonored on two consecutive occasions, the Centre reserves the right to terminate your membership.

Suspending flexi memberships

Memberships may be suspended for a minimum of five days, and must be arranged prior to the start date of your suspension period. If your suspension request is within three days of a debit day, the reduced debit amount may not take effect until the following debit period. Suspensions will only take effect upon the completion of a customer amendment form at reception or the online membership suspension form[1]. Facsimile will not be accepted. The first four weeks of suspension (eight weeks for students) in a calendar year are free after which the Customer will be charged $10 per fortnight of suspension in accordance with the normal direct debit schedule. All medical suspensions are free upon presentation of a valid doctor’s medical certificate.

Suspending results memberships

Memberships may be suspended for a minimum of five days, and must be arranged prior to the start date of your suspension period. Suspensions will only take effect upon the completion of a Customer amendment form available at reception or the online membership suspension form1. Facsimile will not be accepted. The first four weeks of suspension (eight weeks for students) for the annual membership are free after which the Customer will be charged $10 per fortnight of suspension in accordance with the normal direct debit schedule. All medical suspensions are free upon presentation of a valid doctor’s medical certificate.When a suspension request is processed, the expiry date of the membership will be extended by the number of days of the suspension period.

Suspending term memberships

Memberships may be suspended for a minimum of five days, and must be arranged one day in advance. Suspensions will only take effect upon the completion of a customer amendment form or online membership suspension form1. Facsimile will not be accepted. Suspension will be calculated on a pro rata of four weeks per annum for free, based on your membership term length after which the Customer will be charged $5.00 per week of suspension. All medical suspensions are free upon presentation of a valid doctor’s medical certificate. Part payment, three and six month memberships are non-refundable.

Cancelling flexi memberships

The Customer may cancel their membership by completing a cancellation form at the Centre or through the online membership cancellation form[2]. It is the Customer’s responsibility to confirm the cancellation notification has been received and retain a copy of the cancellation communication. Facsimile will not be accepted. A period of 14 days written notice must be given and suspension cannot be used throughout this period. One fortnightly payment will be debited from the Customer once notification has been received. Should there be any arrears in payments the Customer authorises the Centre to debit the outstanding balance in order to bring the account up to date, including a $20 administration fee if applicable.

Cancelling results memberships

The Customer may cancel their membership by completing a cancellation form at the
Centre or through the online membership cancellation form2. It is the Customer’s responsibility to retain a copy of the cancellation communication. Facsimile will not be accepted. A period of 14 days written notice must be given and suspension cannot be used throughout this period. The unused portion of membership will be refunded, less the $69 cancellation fee equivalent to the Centre’s joining fee.

Change to membership type

The Customer may change membership types by completing a cancellation request for current membership type and new membership application at the Centre. The change of membership type will occur on the day of your next direct debit. If this request is made less than one week prior to the next direct debit, the change will occur in the following debit.

Damaged or lost wristbands / cards

A membership wristband/card enables access to facilities, lockers and self-ticketing for group fitness at the Centre. It is the Customer’s responsibility to ensure that membership wristband/card is not damaged or lost. If the Customer’s membership wristband/card is damaged or lost, the Customer will be required to purchase a replacementmembership wristband/card for $20.

Documentation

It is the Customer’s responsibility to obtain their own copy of documentation between the Customer and the Centre. Correspondence includes the membership application form, amendment forms, suspension or cancellation requests. Members will receive emails regarding promotions, events and operational updates at the Centre.

Reciprocal rights

Membership entitles the Customer to reciprocal rights to Melbourne City Baths, North Melbourne Recreation Centre, Carlton Baths and Kensington Community Recreation Centre upon presentation of membership wristband/card. Operating hours

Management reserves the right to alter Centre operating hours as required. Operating hours can be viewed at melbourne.vic.gov.au/mcb3.

Membership conditions

The Centre reviews prices and operations annually, taking effect 1 July. Intended pricing changes are displayed in the Centre from 28 May and written notice is sent to the Customer’s last known email address. It is the Customer’s responsibility to provide the Centre with any change of personal details. In the event that the initial membership conditions are to change the Centre will give one month’s notice. Current membership conditions are displayed at melbourne.vic.gov.au/mcb3.

Disputes

If you dispute any suspension or cancellation you must notify the Centre in writing within 30 days. It is the Customer’s responsibility to retain any such communication.

Liability

Despite foreseeable risk and the probability of serious harm, the burden of taking reasonable precautions to avoid the risk of harm lies with the Customer. These risks include, but are not limited to, loss or damage to personal property, injury or fatality. The Customer acknowledges and agrees that they use the facility at their own risk., If the Customer suffers injury or illness, the Centre and/or its employees or contractors may arrange medical treatment as deemed essential for the safety of the customer.

Customer conduct

Inappropriate behaviour – physical, verbal or otherwise – by customers towards any employee, contractor, member or guest may result in cancellation of membership or multi visit pass and/or removal from the premises. The Centre reserves the right to refuse entry to any person, request any person to leave and/or cancel any membership or multi-visit pass in accordance with these terms and conditions. Items that in the opinion of a Centre employee could cause harm or public nuisance are not permitted within the facility.
