MINUTES

February 4, 2015

CALL TO ORDER:

John Wieczorek called the meeting to order at 7:05 p.m. at the Mahoning Township Building, 2685 Mahoning Drive East, Lehighton, PA 18235

PRESENT:

John Wieczorek, Chairman; Franklin Ruch, Vice Chairman; Bruce Steigerwalt, Supervisor; Shawn Haggerty, Supervisor; Kerry Verrastro, Supervisor, Thomas Nanovic, Solicitor and Natalie D. Haggerty, Secretary-Treasurer

NEW BUSIENSS:

Curbing and Sidewalk Construction Repair Ordinance

Discussion took place with regards to revised curbing and sidewalk construction repair ordinance and CDBG Project of Westside Road. Tom Nanovic re-wrote the ordinance to break it in two parts. John Wieczorek has a difficult time telling residents of Westside that they have to tear out their curbing and put in new. I don’t think it’s fair to impose a bill on those property owners. Bruce Steigerwalt shared that we have a project that needs to go out for bid. Do we want to shorten up the project and do what we can with the money we got or do we want to use liquid fuels or general funds if we don’t have enough? All supervisors agree that we should prepare the specifications based upon the estimate and yards for FDR Reclamation. Bruce will contact Peter.

MOTION

Bruce Steigerwalt made a motion to advertise Curbing and Sidewalk Ordinance to be enacted upon at next meeting. Seconded by Shawn Haggerty. John Wieczorek, yes; Bruce Steigerwalt, yes; Shawn Haggerty, yes; Kerry Verrastro, yes and Franklin Ruch, yes 5-0 vote.

Marcellus Shell Committee Group

John asked Tom to prepare a draft resolution.

John Wieczorek made a motion to advertise for any interested local residents that would like to take part in the committee group to contact the township office. John Wieczorek retracted his motion. Dave Wargo will place an article requesting any interested residents to contact the township.

KIA Stormwater Clarificationquestion/contract for professional services provided by Peter Eisenbrown

Peter got an email from RKR Hess, they are preparing plans for KIA Dealership. They submitted a sketch plan only at this point. They have questions regarding stormwater. Peter Eisenbrown emailed us a sample document for contract for professional services which would allow developers to submit escrow monies to the township if questions arise. The township would deposit fees into Subdivision and Land Development fund. Shared the agreement with Tom to review.

Walmart Letter of Credit Release

Items that need to be addressed before release of securities. Traffic Signal Agreement needs to be provided and executed and escrow needs to be replenished. Beck Deed needs to be signed.

MOTION

Bruce Steigerwalt made a motion to not release letter of credit until all property transfers and proper traffic signal agreement is executedas well as monies are submitted into an escrow.

Seconded by Franklin Ruch. John Wieczorek, yes; Bruce Steigerwalt, yes; Shawn Haggerty, yes; Franklin Ruch, yes and Kerry Verrasto, yes. 5-0 vote Motion carried.

MOTION

Bruce made a motion to authorize Peter Eisenbrown to proceed forward with plans and specifications regarding CDBG Project Westside Road. Seconded by Shawn Haggerty. Kerry Verrastro, yes; Bruce Steigerwalt, yes; John Wieczorek, yes; Shawn Haggerty, yes and Franklin Ruch, yes. 5-0 vote. Motion carried.

COMMITTEE REPORTS:

Road Committee

  • Backhoe down but now repaired.
  • Snow shoveled in streets, when you see it call cops
  • New truck was down, send message to Lowe and Moyer that we are not happy with the service.
  • Mahoning Heights Road and Cherrywood Lane issue with some shrubbery. Question is that can we go in and request property owner to remove. Is it in the right of way? Situation no clear sight triangles both ways we need to look at and see what we need to do to remedy. Talk to Ron to see if in right of way and what the right of way is.

Police Committee

John Wieczorek said he and Kerry had a police committee meeting with the Chief yesterday

  • KIS: Audie thought nothing wrong with the way Lehighton handled it. Arrange to meet with Amie notify the intention and go from there.
  • Audie is gathering info for a new car and to upgrade computers in cars to iPad, including mounting and hardware about $5000 per car to upgrade

Verbiage Provided by Chief Mertz for the Hiring of Part Time Police Officers, add 1000 hours.

Spike Strips Purchase

MOTION

John Wieczorek made a motion to purchase spike strips for vehicle. Seconded by Bruce Steigerwalt. John Wieczorek, no, Kerry Verrastro, no, Franklin Ruch, no, Bruce Steigerwalt, no and Shawn Haggerty, no. 0-5 vote motion fails

OFFICIALS:

Bruce Steigerwalt Westside Road parking issue and plowing snow. A lot of vehicles parked in the street. Is there something we can do about that? Send letter and enclose copy of ordinance 112-27 and 112-28. Find out who the property owner is and send a letter.

John Wieczorek executive session for personnel at the conclusion of meeting.
