IN THE MATTER OF AN APPLICATION TOREGISTER LAND AT

FRENCHAY HOSPITAL, FRENCHAY PARK ROAD, FRENCHAY, BRISTOL, SOUTH GLOUCESTERSHIRE AS A TOWN OR VILLAGE GREEN

On 11 April 2013 an application was submitted to South Gloucestershire Council (the Registration Authority) to register the land at Frenchay Hospital delineated by the yellow line on Plan 1 as new town or village green (TVG) in accordance with section 15(2) of the Commons Act 2006.

On 31 December 2013 the Applicant sought to amend the area to be registered as a TVG by the substitution of the plan appended as Exhibit A to the application and delineated by the green line on Plan 1. The landowner, North Bristol NHS Trust, objected to the application. The Registration Authority determined that a non-statutory inquiry should be held to enable the evidence to be assessed. The inquiry opened on 14 March 2014 but was adjourned by the Inspector following agreement between the parties for the voluntary registration of some of the landsubject to the application as a TVG.

Subsequently, the parties agreed to amend the area to be voluntarily registered as a TVG. On 9 March 2016 the landowner submitted an application to voluntarily register that part of the land hatched green on Plan 2 as a TVG. On 20 April 2016, following confirmation from the Registration Authority that the land would be registered, the Applicant wrote to the Registration Authority to withdraw his application. On 29 April 2016 the Registration Authority formally amended the Commons Register to register the land hatched green on Plan 2 as a TVG.

Under the terms of the agreement between the parties an application to voluntarily register as a TVG those parts of land coloured purple on Plan 2 will be made once the Registration Authority confirms that works affecting that land required under the terms of a section 106 planning agreement for the redevelopment of the former Frenchay Hospital site have been satisfactorily completed. The parties have also agreed that the areas coloured yellow on Plan 2 will not be registered as a TVG. The Applicant has confirmed to the Registration Authority that he does not intend to pursue the registration of the land coloured yellow on Plan 2.

The result of all of the above is that, if the Registration Authority accept the withdrawal of the application, then the areas coloured light and dark grey on Plan 1 (including within the area originally applied for by the Applicant) will not be registered as TVG.

Before determining whether or not to accept the withdrawal of the application the Registration Authority must consider that wider public interest, including whether there is any other member of the public who wishes to take over the application and pursue it (in respect of those parts of the land not already voluntarily registered) as if they were the applicant.If any member of the public wishes to pursue the application to register land at Frenchay Hospital as TVG as if they were the original Applicant, they should so inform the Registration Authority in writing, with their name, address and reasons for wishing to do so by no later than ▼ [suggest 14 days after second week of advert]. A plan showing the area of land which has been registered as TVG, compared to the area included in the original and the amended applications can be viewed on the Council’s website at ▼.

The Applicant has confirmed that he will not support any new applicant wishing to pursue the application
