Thank you for your recent request received28 January. Your request was actioned under the Freedom of Information Act 2000 in which you requested thefollowing

  1. Any document/part of the Council's Constitution or legislation that allows a Council officer to:
  1. eliminate a written question from a member of the public or Councillor, without any consultation with that person
  1. modify a written question from a member of the public or Councillor, without any consultation with that person
  1. remove part of a written question from a member of the public or Councillor, without any consultation with that person
    [It is understood that any questions that were abusive, highly personal, racist, homophobic etc etc, in nature - would not be submitted]

Liverpool City Councilholdsinformation relevant to your request and can confirm thefollowing:

  1. a. Section 21 of the Freedom of Information 2000 states that there is no obligation on a Local Authority to provide information to an applicant where that information is already considered to be reasonably accessible to the applicant by other means.

With this in mind we would specifically refer you to both the Council Procedure Rules and Select Procedure Rules as set out within the City Council’s Constitution.

In accordance with the application of Section 21 of the Freedom of Information Act 2000 we have not provided the information requested. As such we are required to serve you with the following section 17 notice.

TheCity Council will consider appeals, referrals or complaints in respect of your response and thesemust be submitted these in writing thin 28 days of receiving your response.

The matter will be dealt with by an officer who was not previously involved with the response and we will look to provide a response within 28 working days.

If you remain dissatisfied you may also apply to the Information Commissioner for a decision about whether the request for information has been dealt with in accordance with the Freedom of Information Act 2000.
