REQUEST UNDER THE FREEDOM OF INFORMATION (SCOTLAND) ACT 2002 (FOISA)

Thank you for your request dated 8 March 2016 under the Freedom of Information (Scotland) Act 2002 (FOISA).

You asked:

A Code of Practice on Litter and Refuse (COPLAR) was published for the UK in accordance with S89(7) of the Environmental Protection Act 1990 and this was updated in Scotland in 2006.

It is understoodto again be under review in Scotland. This enquiry, in terms of the Freedom of Information Act/Environmental Information (S) Regs 2004 seeks information on what actions you have taken to date to “have regard” to COPLAR, with the objective of understanding how “Duty Bodies” in Scotland are meeting their legal duties.

COPLAR requires all duty bodies to allocate their land to zones aslaid out in COPLAR to recognise their differing cleansing needs. Such zoning should be reviewed periodically to ensure that it is appropriate and to reflect changes in land use.

1. Zoning: Since 1996, give the date(s) on each occasion the dutybody has zoned all or part of its relevant land and relevant roads?It is recommended that zoning be done after a period ofconsultation and that the allocation must be given due publicity

Response to your request

The information within your request is not held by the Scottish Government.

The Scottish Government has not allocated zones, as outlined in the Code of Practice on Litter & Refuse, to its ‘relevant land’. This land has a regular and consistent use and so zoning, as per the Code of Practice on Litter & Refuse 2006, wouldnot aid in fulfilling the duty to keep land clear of litter and refuse.
