Northside Farmers Market, LLC (NFM) aims to provide a competitive and equitable venue for local farmers, producers, and processors of quality items to sell directly to customers. The following questions and requirements are designed to create the best farmers market experience for everyone involved and to highlight how applicants (you) can contribute toward that aim as a potential vendor with NFM.

Northside Farmers Market applicants MUST complete and sign 2 copies of the Northside Farmers Market 2018 Outdoor Vendor Application and Agreement. Once completed and signed, please return both copies to the Market Manager, Emily Diefendorf. The address, if you wish to mail the paperwork, is on the last page of this document. You may also drop it off at the market on Wednesdays. If you have any questions, please contact Emily Diefendorf, the NFM Market Manager, at 513.614.3671 or by email at .

Applications will be processed in the order that they are received. You will be sent an email upon approval the week of March 7th, 2018. Once you are approved, the NFM will provide you with a signed copy of this Vendor Application and Agreement for your records.

For purposes of this application, a “Vendor Produced” item is defined as any item produced and/or processed into its final form entirely by the vendor selling the item (e.g. vegetables, fruit, flowers, honey).

Any “Non-Vendor Produced” item must be labeled as to where it comes from and it must be within 70 miles of the Northside zip code 45223. Each vendor is allowed 3 non-vendor produced items. Please indicate all such products in the designated table on page 6 and 7.

Rules of Operation

  1. Market hours of operation are Wednesdays from 4pm – 7pm.
  1. Vendors furnish their own tables, chairs, canopies, cash-box and change. Vendors are responsible for cleaning their stall(s) & removing trash &/or boxes at the end of each NFM. NFM cannot remove vendor trash or boxes. Trash, including boxes, MAY NOT be placed in any City or private business trash bin or left on the street.
  1. Sampling is encouraged as long as it is within your assigned stall space, in small amounts (less than 1oz), and peaceful. No sampling outside of stall space. No attempting to attract customers by making noise and/or shouting. Prepared food vendors and vendors offering food samples must provide a trash receptacle within vending space.
  1. Electricity is available at the NFM on a limited basis. If a participant requires electricity they are required to request approval on the NFM application, generators may be approved under certain circumstances. Vendors provide generators or if they need electricity, must provide an extension cord and cover for the part of the cord that lies in walkways and all areas utilized by public.
  1. The NFM requires all Vendors to purchase and provide Liability insurance. Applicant must include the insurance plan’s account number on their application.
  1. Participants shall conduct themselves professionally and behave courteously toward NFM attendees, other participants, staff, volunteers, entertainers, etc. Conduct deemed inappropriate, unprofessional, offensive or serious will not be enforced with reminders, warnings, or fines, but will result in administrative action devoid warnings or fines, including possible ejection or barring vendor from selling at the NFM &/or future NFM events.
  1. Smoking is prohibited by all market vendors/participants, within their stall and on the market premises.
  1. The sale of live animals is not allowed on market premises. Posting of pets/animals for sale is not allowed.
  1. Vendors shall not leave children at a vendor stall without adult supervision, for any amount of time. Vendors are responsible for their children at all times. The NFM staff cannot be responsible for your children.
  1. Vendors are expected to understand the NFM Gift Certificates redemption procedure. When vendors see a gift certificate being used as money at their booth they are to direct the customer to the NFMInformation booth. The NFM will redeem all gift certificates in $5 token increments. Vendors will not be able to turn in gift certificates at the market for redemption.
  1. In case of inclement weather, and with the assistance of local police and volunteers, the message and pertinent information will be broadcast to onsite vendors via siren, fog horn type sound, and/or verbal announcement. The NFM Market Manager is allowed to close the market. If the Market is closed or cancelled:
  1. Vendors are required to shut down immediately and remain closed for the day(s) noted.
  2. Vendors are not allowed to sell product on, in, or near Market premises.
  3. Vendors are required to take cover and/or promptly exit the market site completely, including removal of product, equipment, & vehicles.
  4. Conduct of disregard to Emergency Closure procedure will result in administrative action devoid warnings or fines, including ejection and/or barring vendor from selling at the NFM and/or future NFM events.

Procedures and Attendance

  1. Spaces will be assigned by the NFM Market Manager. Preference is given to vendors with greatest seniority and vendors who intend to attend the most market dates.
  1. Attendance by all scheduled vendors is vital to all market dates. Vendors not able to attend a scheduled market date are required to notify NFM () with as much notice as possible. Failure to notify NFM management of an absence in writing and in a timely manner, repeat absences, planned or unplanned, may result in loss of stall privileges. Unforeseen emergencies will be taken into consideration on a case-by-case basis. Cancellation or no show date fees are not refunded or waived.
  1. Vendor stalls do not allow space for a vehicle. Vendor must move vehicle out of NFM premises promptly after unloading and before setting up booth and product. Vehicles used for loading and unloading may not block street, vendor must park vehicle as to not block others from driving down street and to not block neighboring vendor stalls. If you need special arrangements, please note on application. To prevent backups, Vendors must unload vehicle, park their vehicle, THEN set up their stall.
  1. Market staff is available for assistance at the NFM Information Booth located in front of the Hoffner Park pavilion. Vendor vehicles must exit the Market by 3:45pm. If a situation arises where a vendor needs to arrive after 3:45pm, vendor will need to park outside of the Market and carry in items. All vendors/participants are not allowed to drive vehicles into the market area after 3:45 pm, and NOT before 7:15pm
  1. The NFM closes at 7PM. Vendors are not allowed to drive vehicles into Market area until 7:15pm. Please plan and park accordingly. To ensure a smooth transition for the entire NFM community, vendors are required to prepare and pack product & equipment and completely take down booth and be ready to load vehicle BEFORE driving vehicle into market area. Vehicles used for loading cannot block street or sidewalks. Vendors who have sold out of product before 7pm may not begin tearing down before NFM closes at 7PM, and also cannot enter the market area with vehicle before 7:15pm, or at the discretion of the Northside Farmers Market Manager.
  1. NFM Vendors and participants MUST NOT park in the Northside Bank and Trust Parking Lot until after 5:30pm. Your vehicle will be towed.
  1. NFM Vendors and participants MUST NOT drive across the grass in Jacob Hoffner Park. The market will be fined for improper use of the park.
  1. NFM management and assigned entities will randomly evaluate participants using the Vendor Compliance Checklist. Compliance and enforcement may include verbal reminders, written notice of non-compliance, notices &/or fines. If a vendor is issued a reminder or warning, vendor must adjust in effort to comply with NFM requirements on the day the warning is issued or before continuing participation in the NFM.
  1. Vendor agrees to pay Northside Farmers Market, LLC a required vendor fee, as rent for a booth space during the 2018 Northside Farmers Market. Should a vendor not attend or decide to forfeit their vendor space after signing this agreement, NFM will retain 25% of their fee as a non-refundable application fee. Fees are invoiced in person or via email and can be paid by check made payable to Northside Farmers Market, LLC.
  1. Northside Farmers Market will conduct farm inspections throughout the summer. Inspections will take place at a scheduled time between the vendor and NFM Market Manager. Refusal of being inspected is grounds for immediate cancellation of participation in the NFM.
  1. Vendor agrees to anonymously report estimated sales at the end of each market day. The vendor should write an amount on a sales slip, provided by the market manager, and leave it at the Information Booth at the end of market.
  1. Market staff is available for assistance at the NFM Information Booth.

Vendor Information

  1. Only local farmers, growers, cottage producers, family members, partners, employees/representatives or members of cooperative farming groups may sell at the Northside Farmers Market.
  1. Each booth space must prominently display a sign clearly identifying the farm or business by name and the location of the farm or business.
  1. Each Vendor must display prices in a clear and prominent place.
  1. Vendors are individually responsible for conforming to all city, state, and federal laws, including the securing of any licenses required in connection with the operation of their Market space.
  1. Vendors selling non-consumable items are responsible for collecting and reporting sales tax on their own.
  1. Vendor complaints or concerns should be directed to NFM management in a timely manner. Customer compliments and complaints will be forwarded to vendors and kept on file. Complaints may result in further inquiry or disciplinary action, including barring vendor from selling at the NFM temporarily or permanently, devoid written or verbal warning or fines. Vendors may send complaints via email to . The NFM manager will then document the situation and send the information to the NFM board for further guidance.
  1. Vendors, their staff, and all participants are expected to uphold professionalism, know the requirements & expectations, and respect the integrity of the NFM by adhering to the 2018 Outdoor NFM Guideline requirements of participating in the NFM. Vendors are responsible for making sure that all persons working at their booth know and adhere to all NFM regulations. Please print and share this information with your staff.
  1. An Occasional Vendor may come at the discretion of the NFM manager and is:

a.)A locally grown food producer that is new to the Northside Farmers Market.

b.)A grower wishing to sell seasonal Ohio raised product & does not have the capacity or amount of product to serve the Market from 4 – 7pm during the entire Market season.

c.)A vendor who does not sell exclusively Ohio raised product grown by vendor (crafts, packaged food, clothing, jewelry, prepared food, etc).

d.)A vendor that agrees to be scheduled occasionally throughout the NFM season and assigned various stall locations

After an Occasional vendor has been accepted, information regarding scheduled dates for the entire season will be available in their online account. Occasional Vendors are not assigned a permanent stall location, alternatively they are rotated and assigned stalls throughout the NFM based on vendors present.

Product Information

  1. Products for sale must be produced or processed by the principal farmer/producer (“vendor”); items not meeting these standards must be declared as being Non-Vendor Produced, either on the vendor’s Application Form or submitted in writing to the Farmers Market Manager. Locations of other gardens must be listed separately; clearly noting what items will be grown at each site.
  1. Non-compliance, unless otherwise noted within the rule or deemed and exception, will result in the following:

First verbal and written warning – No fine.

Second verbal and written warning – You may be asked to leave the market for the day.

Third verbal and written warning – Your case will be brought to the attention of the Advisory Board and you may be asked to terminate your participation in the NFM.

  1. Value-added edible items (e.g. jams, sauces, baked-goods) must be produced from scratch ingredients by producers on their farms or in a licensed facility according to state and federal regulations.
  1. All packaged items (wrapped, bottled, or canned) must be labeled with the producer’s name, address, complete list of ingredients, and net weight, in accordance with state and federal guidelones..
  1. Prior to commencing sales and throughout the market hours; market prices for all items must be visibly posted.
  1. Scales must be inspected and sealed by the Ohio Department of Consumer Affairs and approved by the Hamilton County Office of Weights and Measures.
  1. All products labeled organic or verbally designated as being organic, must be third-party certified according to USDA standards by a recognized organic certifying agency. Certification letters must be available at the producers stand. For products labeled as containing organic ingredients or verbally designated as containing organic ingredients, the primary producer of the ingredient must be disclosed upon request.

Wireless Electronic Benefits Transfer (EBT), Produce Perks and ATM/Credit/Debit Policy

  1. Upon signing the 2018 NFM Vendor Outdoor Application and Agreement vendors are agreeing to participate in the EBT Wireless and ATM/CREDIT/DEBIT Program. You must place a “We accept EBT/ATM tokens” and “We Proudly Accept Produce Perks Tokens” signs at your booth, provided by the NFM Manager.
  1. For the EBT Program: $1.00 denomination “Northside Farmers Market EBT Tokens” will be “sold” to Ohio Direction/EBT customers by the NFM authorized representative at the NFM Information Booth through a transaction in which the customer’s EBT card is swiped through the “Market Terminal” for a requested dollar amount of tokens. The EBT customer uses the tokens to purchase eligible food and food plant products from participating farmers and vendors. Vendors may only redeem EBT tokens for EBT eligible products. The list of these products is below (see D).
  1. At the end of each market day, the farmer or vendor counts the EBT tokens collected and brings them to the NFM Information Booth. A deposit slip will be completed by market staff and signed by staff and the vendor and will be turned in along with the tokens. On a weekly basis, the market reimburses farmers and vendors by means of a check for the full amount of the EBT tokens redeemed within two weeks.
  1. ACCEPTED EBT items include: bread, cereal, fruit, jams, jellies, honey, fermented foods, juice, tea, coffee, vegetables, herbs, meats, fish, poultry, dairy products, seeds and plants which produce food for the household to eat.
  1. NOT ACCEPTED EBT items include: beer, wine, liquor, cigarettes, tobacco, pet food, soap, paper products, household supplies, vitamins, medicines and hot/prepared foods such as sandwiches, pizza, wraps, dispensed coffee, dispensed tea, cider, cut flowers, ornamental plants, soap, art & crafts and any non-consumable Items.
  1. No change is given during EBT purchases. If a transaction is for less than a whole dollar amount (i.e. $2.50) the vendor may add product to make up the difference – or the customer may pay the difference in cash. No tax can be charged.
  1. ONLY NFM Farmers Market EBT tokens taken will be accepted for reimbursement at NFM. Vendors accept other farmer’s market tokens at their own risk and with no promise of reimbursement from NFM.
  1. Notify the NFM Manager and/or NFM authorized representative of any problems with the EBT program.
  1. For the ATM/CREDIT/DEBIT Program: $5.00 denomination “Northside Farmers Market ATM Tokens” will be “sold” to customers by the NFM authorized representative at the NFM Information Booth through a transaction in which the customer’s card is swiped through the “Market Terminal” for a requested dollar amount of tokens. Customer uses the tokens to purchase products from participating farmers and vendors. Change is given during ATM Token purchases for less than a five dollar denomination. All NFM products are eligible for the ATM/CREDIT/DEBIT token program.
  1. For the Produce Perks Program: $1.00 denomination metal, dark green ‘Produce Perks” tokens will be given as an EBT token match (up to $10) to Ohio Direction/EBT customers by the NFM authorized representative at the NFM Customer Service booth. The EBT customer uses the Produce Perks tokens to purchase fresh fruits and vegetables only from participating farmers and vendors. Vendors may only redeem Produce Perks tokens for fresh fruits and vegetables or plants which produce fruits or vegetables. No change may given for Produce Perks Tokens.
  1. At the end of each market day, the farmer or vendor counts the Produce Perks tokens collected and brings them to the NFM Information Booth. A deposit slip will be completed by market staff and signed by staff and the vendor and will be turned in along with the tokens. On a monthly basis, the market reimburses farmers and vendors by means of a check for the full amount of the Produce Perks tokens redeemed within one month and two weeks.
