Certificate of Nameplate Capacity for Completed Energy Project

Pursuant to Ohio Revised Code Section 5727.75(F)(2)

As authorized by Amended Substitute Senate Bill 232, project owners or lessees of energy projects must file a certificate indicating the project’s “nameplate capacity” as defined by Ohio Revised Code (ORC) Section 5727.01(Q) in order to be eligible to be considered a “Qualified Energy Project” under ORC § 5727.75.

Generally, this certificate must be filed before the first day of March of each year during the energy facility’s construction or installation. The certificate shall reflect the nameplate capacity of the energy facility as of the preceding thirty-first day of December. Unless instructed by the Director of Development, the project owner or lessee of the energy facility must also file an annual report by March 1st for each year in which the energy facility remains operational. This report will set forth the nameplate capacity of the facility as of the preceding thirty-first day of December. If a project was completed before the effective date of Amended Substitute Senate Bill 232 (June 17, 2010), then a prospective applicant must file a certificate of nameplate capacity within sixty days, or by August 16, 2010.

The completion of a certificate of nameplate capacity is a requirement for a project to receive the tax exemption authorized under ORC § 5727.75, but does not obviate a prospective applicant’s obligation to timely file an application to be considered a “Qualified Energy Project” nor any of the other requirements imposed by Amended Substitute Senate Bill 232.

The undersigned hereby certifies to the State of Ohio as follows:

  1. This Certificate is being filed with the Ohio Development Services Agency by the entity identified above, which is a prospective applicant for certification of a qualified energy project pursuant to Ohio Revised Code § 5727.75.
  2. As of the date of this Certificate, the undersigned is employed by the Prospective Applicant in the position indicated in the signature block and is duly authorized to make this certification to the State of Ohio on behalf of the Prospective Applicant. Further, the undersigned has examined such documents and records and made such inquiries of officers, employees and representatives of the Prospective Applicant as the undersigned has deemed relevant and necessary as the basis for this Certificate.
  3. The Prospective Applicant is the owner or lessee, as indicated above, of the energy project, as that term is defined in Ohio Revised Code § 5727.75(A), located at the project site described above (the “Energy Project”).
  4. Construction of the Energy Project was completed on the completion date set forth above.
  5. The nameplate capacity, as that term is defined in Ohio Revised Code § 5727.01(Q), of the Energy Project is as set forth above.
  6. The information provided to the Ohio Department of Development in this Certificate is true, correct and complete.

The undersigned acknowledges that this Certificate is being filed with the Ohio Development Services Agency as part of an application process to obtain a financial benefit from the State of Ohio, and that the Ohio Development Services Agency may rely on the information provided in this Certificate in evaluating such application.
