Dear Mr. Fuglesang,
In response to your e-mail of 16.2.2010 to Mrs. Bredima, please, note the following:
The EU Directive 2005/33 has been transposed into Greek legislation with a Decision published in the Government Gazette on 30.8.2007.
The Greek Administration has accepted the EC Recommendation C(2009) 10289 of 21.12.2009 and has given the following instructions regarding monitoring of compliance with the 0,1% at berth requirement.
If in the period 1.1.2010 - 31.8.2010 Port State Control verifies that a ship does not comply with the at berth 0,1% requirement in connection with the safety of boilers, its representative will be requested to produce detailed evidence of actions taken, or planned to take immediately to fulfil compliance. Such evidence may include:
a) A contract of the company with the manufacturer of boilers or fittings relevant to compliance,

b) A retrofit plan approved:
· by the classification society, or
· in the case or a ship under an EU flag by an EU Recognized Organization, or
· by the flag administration, if the ship is not classed with a Recognized Organization
The plan should specify by which date the retrofitting and certification will have to be completed.
When considering penalties for non-compliance the existence of a plan will be taken into account for imposition of lightest penalties.
The Administration has underlined the risks associated with the fuel change-over during the non-compliance period and the need for companies to develop and ships to adhere to operational procedures, as well as the need for relevant crew training.
