Richland Clubhouse Rental Agreement

In consideration of Richland Homeowner’s Association (hereinafter “Association”) allowing me the exclusive use of the Richland Clubhouse located at 2074 Quinton Place, Suwanee, Georgia, 30024 and furnishings therein (hereinafter “Premises”), I, ______, agree to the following:

1. Rental Period. I understand that I am entitled to use the Premises from 10:00AM on ______to 12:00 AM midnight on ______(“Rental Period”).

2. Rental Fee. I agree to pay a rental fee (“Rental Fee”) in the amount of $175.00 for each use of the Premises during the Rental Period.Rental & Deposit checks must be made payable to Richland HOA from the residents account. No checks will be accepted from a 3rd party.(Deposits – read items 7.1, 7.2 and 7.3)

3. Use of the Premises.

3.1 I confirm that I am a Member of the Association and that use of the Premises during the Rental Period is for my direct benefit or that of a member of my immediate family. I may not sponsor an event of a nonmember of the Association or rent the Premises on a nonmember’s behalf.

3.2 The Premises will be used during the Rental Period for the purpose of______.

3.3 I agree that no more than one hundred (100) persons shall occupy the Premises during the Rental Period at any given time.

3.4. I understand that any use of the Richland pool facilities during the Rental Period must be in accordance with the Association member and guest guidelines.

3.5I understand that I am entitled to use the upper verandah of the Premises.

3.6 I understand that the application of tape of any kind to any interior or exterior wall of the Premises and the use of tacks, staples, nails, or screws of any kind on any part of the Premises is not permitted. The application of tape to the woodwork of the Premises is permitted.

3.7 I agree to return the Premises to the Association clean and in the same condition as the Premises were delivered to me. The following items must be done or the deposit fee may be held to cover expenses incurred by the Association.

Turn off all inside and outside lights.

Turn the air conditioner / heater off upon leaving.

Close, secure, and lock all doors being careful to check veranda doors verifying they are locked into the frame.

Sweep & Mop Hardwood Floor.

Sweep and mop kitchen, entry way and bathrooms.

Empty all trash, including bathrooms. Trash must be removed and placed in outside containers.

Kitchen sink and counters must be cleaned and free from food.

Remove all tables, chairs or furniture brought into the Premises by renter no later than 9:00 a.m. the morning following the Rental Period.

No decorations may be taped or tacked to the woodwork or walls of the Premises.

3.8 I understand that if I find the Premises unclean or damaged in any way prior to my use of the Premises that I must notify the Association immediately by contacting ShaBen & Associates at (770) 271-2252. If your call is placed outside of business hours, please follow the Emergency directions on their voice mail. Please be sure to leave a number where a representative from the management company can contact you referencing the problems.

Also, be very descriptive of the condition that exists, giving size, location, color or any other discerning information. Any unreported conditions will be deemed to have occurred during the Rental Period.

______5. Television. I intend to use the television during the Rental Period. I understand that I must pay the Television Deposit set forth in Section 7.2.

______6. Alcohol. I intend to provide or allow the use of alcoholic beverages on the Premises during the Rental Period.

7.Deposits.

7.1.Security Deposit. I agree to submit a security deposit (“Security Deposit”) in theamount of $350.00 to the Association. I understand and agree that the Association will use the Security Deposit to pay for the costs to repair any and all damages to the Premises and its contents caused by me, my guests, invitees, employees or agents, or anyone in any way related to my use of the Premises during the Rental Period or for the costs of any necessary cleaning following the Rental Period. The Association may retain up to the full amount of this Security Deposit without my prior approval.

7.2.Television Deposit. I agree to submit an additional deposit (“TelevisionDeposit”) in the amount of $150.00 for use of the television on the Premises. I understand and agree that the Association will use the Television Deposit for the costs to repair any and all damages to the television or television cabinet caused by me, my guests, invitees, employees, or agents, or anyone in any way related to my use of the Premises during the Rental Period. The Association may retain up to the full amount of this Television Deposit without my prior approval.

7.3.Forfeit of Deposits. The Association may retain up to the full amount of both the Security Deposit and the Television Deposit, if applicable, for cleaning and/or damages to the Premises, television, or television cabinet,if either Deposit does not individually cover the total cost of repair or cleaning. If the cost of repair or cleaning exceeds the amount of my Deposit(s), I agree to pay the Association the full cost of all repairs or cleaning within ten (10) days of my receipt of a bill from the Association for such costs.

8. Form of Payment. I shall pay all fees and deposits by check made payable to Richland Homeowner’s Association. I will pay the Rental Fee, Security Deposit, and Television and mail each Deposit, if applicable, by separate check, with this Agreement to the Association at P.O. Box 3189, Suwanee, Georgia, 30024-0989 (envelope provided). Checks must be received 30 days prior to the scheduled rental. If they are not received by this point in time, the reservation will be cancelled. (Check must be written by Richland resident.)

9.Cancellation. I may cancel this Agreement at any time prior to the start of the Rental Period. I understand that if cancellation is not made at least 7 days prior to the reserved date, I am not entitled to a refund of the Rental Fee upon cancellation.

10.Government Regulations. I shall comply with all requirements of any legally constituted public authority concerning or affecting the Premises, including but not limited to any Gwinnett County fire ordinances.

11. Release. I hereby assume all responsibility, risks, liabilities, and hazards incidental to the activities relating to my use of the Premises and fully release and forever discharge the Association and its officers, directors, employees, agents, and members, past, present, and future, from any and all claims, demands, liabilities, causes of action, and costs and expenses (including, without limitation, court costs and reasonable attorney’s fees) for personal injury or death and damage to or destruction of property arising out of or otherwise in connection with my use of the Premises and its appurtenances.

12. Indemnification. I agree to indemnify and hold harmless the Association, its officers, directors, employees, agents and members, past, present and future, from and against any and all charges, claims, demands, causes of action, liabilities, and costs and expenses (including, without limitation, court costs and reasonable attorney’s fees) for any injury to either person or property, of whatever kind and nature, known or unknown, anticipated or unanticipated, suffered by me, my family members, guests, invitees, employees, agents, servants or any member of the Association or any other person, arising out of or otherwise in connection with the above Rental and related activity.

13. Inquiries. Any inquiries about my use of the Premises and all reports of damage or unclean conditions existing in the Premises prior to my use should be immediately directed to ShaBen and Associates at 770-271-2252.

14. Entire Agreement. This Agreement contains the entire agreement of the parties hereto and no representations, inducements, promises or agreement, oral or otherwise, between the parties, not embodied herein, unless contained in a modification in writing executed by all of the parties hereto, shall be of any force or effect.
