Eligibility of programmes 2007-2013

Regulation / Eligibility
Regulation (EC) No 1905/2006 of the European Parliament and of the Council of 18 December 2006 establishing a financing instrument for development cooperation / a. Natural persons who are nationals of, or legal persons who are established:
- a Member State of the Community:
Austria, Belgium, Bulgaria, Czech republic, Cyprus, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, United Kingdom.
- in an official candidate country as recognised by the European Community:
Croatia, The former Yugoslav Republic of Macedonia, Turkey.
- in a Member State of the European Economic Area:
Iceland, Lichtenstein, Norway.
b. For geographic programmes: natural persons who are nationals of, or legal persons who are established in, any of the following countries:
Asia: Afghanistan, Bangladesh, Bhutan, Cambodia, China, Democratic Republic of Korea, India, Indonesia, Laos, Malaysia, Maldives, Mongolia, Myanmar, Nepal, Pakistan, Philippines, Sri Lanka, Thailand, Vietnam. Latin America: Argentina, Bolivia, Brazil, Chile, Colombia, Costa Rica, Cuba, El Salvador, Ecuador, Guatemala, Honduras, Mexico, Nicaragua, Panama, Paraguay, Peru, Uruguay, Venezuela. Central Asia: Kazakhstan, Kyrgyz Republic, Tajikistan, Turkmenistan, Uzbekistan. Middle East: Iran, Iraq, Oman, Saudi Arabia, Yemen. South Africa: South Africa.
c. For thematic programmes and ACP Sugar Protocol: all natural persons who are nationals of, or legal persons who are established in, a developing country, as specified by the OECD/DAC :
Least Developed Countries: Afghanistan, Angola, Bangladesh, Benin, Bhutan, Burkina Faso, Burundi, Cambodia, Cape Verde, Central African Rep., Chad, Comoros, Congo Dem. Lower Middle Income Countries and Territories (per capita GNI $826-$3.255 in 2004) : Albania, Algeria, Armenia, Azerbaijan, Belarus, Bolivia, Bosnia and Herzegovina, Brazil, China, Colombia, Cuba, Dominican Republic, Ecuador, Egypt, El Salvador, Fiji, Former Yugoslav Republic of Macedonia, Georgia, Guatemala, Guyana, Honduras, Indonesia, Iran, Iraq, Jamaica, Jordan, Kazakhstan, Marshall Islands, Micronesia, Morocco, Namibia, Niue, Palestinian Adm. Areas, Paraguay, Peru, Philippines, Serbia & Montenegro, Sri Lanka, Suriname, Swaziland, Syria, Thailand, Tokelau, Tonga, Tunisia, Turkmenistan, Ukraine, Wallis &Futuna.
Upper Middle Income Countries and Territories (per capita GNI $3.256-$10.065 in 2004) : Anguilla, Antigua and Barbuda, Argentina, Barbados, Belize, Botswana, Chile, Cook Islands, Costa Rica, Croatia, Dominica, Gabon, Grenada, Lebanon, Libya, Malaysia, Mauritius, Mayotte, Mexico, Montserrat, Nauru, Oman, Palau, Panama, Saudi Arabia (1), Seychelles, South Africa, St. Helena, St. Kitts-Nevis, St. Lucia, St. Vincent & Grenadines, Trinidad & Tobago, Turkey, Turks & Caicos Islands, Uruguay, Venezuela.
(1) Saudi Arabia passed the high income country threshold in 2004. In accordance with the DAC rules for revision of this List, it will graduate from the List in 2008 if it remains a high income country in 2005 and 2006.
in addition to natural or legal persons eligible by virtue of the thematic programme or the ACP Sugar Protocol programme:
Barbados, Belize, Guyana, Jamaica, Saint Kitts and Nevis, Trinidad and Tobago, Fiji, Republic of the Congo, Côte d'Ivoire, Kenya, Madagascar, Malawi, Mauritius, Mozambique, Swaziland, Tanzania, Zambia, Zimbabwe.
d. All natural persons who are nationals of or legal persons who are established in any country, where reciprocal access to their external assistance has been established.
e. Reciprocal access in the least developed countries as defined by the OECD/DAC shall be automatically granted to OECD/DAC members.
Least Developed Countries: Afghanistan, Angola, Bangladesh, Benin, Bhutan, Burkina Faso, Burundi, Cambodia, Cape Verde, Central African Rep., Chad, Comoros, Congo Dem. Rep., Djibouti, Equatorial Guinea, Eritrea, Ethiopia, Gambia, Guinea, Guinea-Bissau, Haiti, Kiribati, Laos, Lesotho, Liberia, Madagascar, Malawi, Maldives, Mali, Mauritania, Mozambique, Myanmar, Nepal, Niger, Rwanda, Samoa, Sao Tome & Principe, Senegal, Sierra Leone, Solomon Islands, Somalia, Sudan, Tanzania, Timor-Leste, Togo, Tuvalu, Uganda, Vanuatu, Yemen, Zambia.

f. International organisations:
(a) international publicsector organisations set up by intergovernmental agreements, and specialised agencies set up by such organisations;
(b) the International Committee of the Red Cross (ICRC);
(c) the International Federation of National Red Cross and Red Crescent Societies;
(d) the European Investment Bank and the European Investment Fund.
g. The above is without prejudice to the participation of categories of eligible organisations by nature or by localisation in regard to the objectives of the action to carry out.
h. In duly substantiated cases natural and legal persons from countries having traditional economic, trade or geographical links with neighbouring countries or other third countries.
i. In duly substantiated exceptional cases, natural persons who are nationals of or legal persons who are established in other countries than those referred in points (a) to (e).
j. Whenever Community funding covers an operation implemented through an international organisation, participation in the appropriate contractual procedures shall also be open in addition to points (a) to (e) to all natural or legal persons who are eligible pursuant to the rules of that organisation, care being taken to ensure that equal treatment is afforded to all donors.
k. Whenever Community funding covers an operation co-financed with a third country, subject to reciprocity or with a regional organisation, or with a Member State, participation in the appropriate contractual procedures shall be open to all natural or legal persons who are eligible pursuant to point (a) to (f) as well as to all natural or legal persons who are eligible under the rules of such third country, regional organisation or Member State.
l. For the purposes of aid channelled directly through non- State actors under the thematic programme "Non-State actors and local authorities in development", the provisions of points (a) to (c) shall not apply to the eligibility criteria established for the selection of grant beneficiaries. Beneficiaries of these grants shall abide by the rules above where the implementation of aid requires the award of procurement contracts.
European Neighbourhood and Partnership instrument (Regulation (EC) N° 1638/2006 of the EP and of the Council - OJ L 310/1 of 9.11.2006) / a. Natural persons who are nationals of, or legal persons who are established in:
- a Member State of the Community:
Austria, Belgium, Bulgaria, Czech Republic, Cyprus, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, United Kingdom.
- a country that is a beneficiary of this Regulation:
Algeria, Armenia, Azerbaijan, Belarus, Egypt, Georgia, Israel, Jordan, Lebanon, Libya, Moldova, Morocco, Palestinian Authority of the West Bank and Gaza Strip, Russian Federation, Syria, Tunisia, Ukraine.
- a country that is a beneficiary of an Instrument for Pre-Accession Assistance set up by Council Regulation (EC) No 1085/2006 of 17 July 2006 establishing an Instrument for Pre-Accession Assistance (IPA):
Croatia, The former Yugoslav Republic of Macedonia, Turkey.
Albania, Bosnia, Montenegro, Serbia, including Kosovo.
- a Member State of the EEA:
Iceland, Lichtenstein, Norway.
b. In duly substantiated cases participation of natural persons who are nationals of, and legal persons established in, a country having traditional economic, trade or geographical links with neighbouring countries.
c. All natural persons who are nationals of, or legal persons established in a country under reciprocity.
d. International organisations:
(a) international publicsector organisations set up by intergovernmental agreements, and specialised agencies set up by such organisations;
(b) the International Committee of the Red Cross (ICRC);
(c) the International Federation of National Red Cross and Red Crescent Societies;
(d) the European Investment Bank and the European Investment Fund.
e. In duly substantiated exceptional cases participation of natural persons who are nationals of, and legal persons established in, countries other than those referred to in points (a) to (c).
f. Whenever Community funding covers an operation implemented through an international organisation, participation in the appropriate contractual procedures shall be open to all natural or legal persons who are eligible pursuant to points (a) to (c) as well as to all natural or legal persons who are eligible pursuant to the rules of that organisation, care being taken to ensure that equal treatment is afforded to all donors.
g. Whenever Community funding covers an operation co-financed with a Member State, with a third country, subject to reciprocity or with a regional organisation, participation in the appropriate contractual procedures shall be open to all natural or legal persons who are eligible pursuant to points (a) to (c) as well as to all natural or legal persons who are eligible under the rules of such Member State, third country or regional organisation.
h. The above mentioned points shall be without prejudice to the participation of categories of eligible organisations by nature or by localisation in regard to the objectives of the action.
i. Where Community assistance under this Regulation is managed by a joint managing authority the procurement rules shall be those laid down in the implementing rules.
Stability instrument (Regulation (EC) N° 1717/2006 of the EP and of the Council - OJ L 327/1 of 24.11.2006) / a. All natural or legal persons from Member States:
Austria, Belgium, Bulgaria, Czech Republic, Cyprus, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, United Kingdom.
b. All natural and legal persons from any country that is a beneficiary of the Instrument for Pre-Accession Assistance:
Croatia, The former Yugoslav Republic of Macedonia, Turkey, Albania, Bosnia, Montenegro, Serbia, including Kosovo.
c. All natural and legal persons from any non-EU Member State of the European Economic Area:
Iceland, Lichtenstein, Norway
d. All natural and legal persons from any other third country or territory in cases where reciprocal access to external assistance has been established.
e. In the case of measures taken in any third country considered a Least Developed Country according to the criteria laid down by the OECD, participation in the award of procurement or grant contracts shall be open on a global basis:
Least Developed Countries: Afghanistan, Angola, Bangladesh, Benin, Bhutan, Burkina Faso, Burundi, Cambodia, Cape Verde, Central African Rep., Chad, Comoros, Congo Dem. f. In the case of Exceptional Assistance Measures and Interim Response Programmes, participation in the award of procurement or grant contracts shall be open on a global basis.
g. In the case of measures adopted in pursuit of the objectives referred to in Article 4 of the regulation (Assistance in the context of stable conditions for cooperation), participation in the award of procurement or grant contracts shall be open, and rules of origin shall extend, to any natural or legal person of a developing country or of a country in transition, as defined by the OECD, and to natural or legal persons of any other country eligible under the relevant strategy:
