MINUTES OF TELEPHONE CONFERENCE CALL

TIME & PURPOSE: / After an attempt to schedule a regular meeting failed, pursuant to § 54.1-2408.1 of the Code of Virginia, a telephone conference call of the Virginia Board of Pharmacy was held at 8:35 a.m., on February 13, 2007, to consider the summary suspension of the registrations of Lynn S. Boyd and Amanda B. Harper to practice as pharmacy technicians; and the license of Ronald J. Malsam to practice as a pharmacist.

POLL OF MEMBERS: / Each Board member was polled as to whether they could have attended a regular meeting at the office in a timely manner for the purpose of hearing evidence in two possible summary suspension cases. Each Board member polled stated that they would not have been able to attend.
With seven Board members participating and three members unable to participate, it was established that a quorum could not have been convened in a regular meeting to consider these matters.
LYNN S. BOYD
Registration #0230-008974 / Mr. Schliessmann presented a summary of the evidence in the case.
Decision: / Mr. Ross moved, that with the evidence presented, the practice as a pharmacy technician by Lynn S. Boyd poses a substantial danger to the public; and therefore, that the registration of Lynn S. Boyd to practice as a pharmacy technician be summarily suspended. The Board voted 6-0 in favor of the motion, with Mr. Beckner abstaining.
Mr. Stredler moved, that a Consent Order be offered to Ms. Boyd for the revocation of her registration in lieu of a hearing. The Board voted 6-0 in favor of the motion, with Mr. Beckner abstaining.
At this time Ms. Dunaway was released from the telephone conference call.
RONALD J. MALSAM
License #0202-005051 / Mr. Schliessmann presented a summary of the evidence in the case.
Decision: / Mr. Yi moved, that with the evidence presented, the practice as a pharmacist by Ronald J. Malsam, poses a substantial danger to the public; and therefore, that the license of Ronald J. Malsam, to practice as a pharmacist be summarily suspended. The Board voted 6-0 in favor of the motion, with Mr. Beckner abstaining.
Mr. Stredler moved, that a Consent Order be offered to Mr. Malsam, for the indefinite suspension of his license in lieu of a hearing. The Board voted 6-0 in favor of the motion, with Mr. Beckner abstaining.
At this time Mr. Arnott was released from the telephone conference call.
AMANDA B. HARPER
Registration #0230-004989 / Mr. Schliessmann presented a summary of the evidence in the case.
Decision: / Mr. Ross moved, that with the evidence presented, the practice as a pharmacy technician by Amanda B. Harper posses a substantial danger to the public; and therefore, Ms. Harper’s right to renew her pharmacy technician’s registration be summarily suspended. The Board voted 6-0 in favor of the motion, with Mr. Beckner abstaining.
Mr. Stredler moved, that a Consent Order be offered to Ms. Harper for the indefinite suspension of her right to renew her registration for not less than one (1) year in lieu of a hearing. The Board voted 6-0 in favor of the motion, with Mr. Beckner abstaining.
