PLEASE READ VERY CAREFULLY, SO THAT THERE IS CLEAR COMMUNICATION AND UNDERSTANDING BY BOTH PARTIES OF WHAT IS EXPECTED AND WHAT STANDARDS WILL BE UPHELD ON THE DAY OF THE WEDDING.

ENTIRE AGREEMENT:

This agreement will be the entire understanding between Little Miss Creative and the client and supersedes all prior discussion and agreements between the parties.

Any agreement to waive one or more provisions of this agreement does not constitute a waiver of any other portion or provision of this agreement.

RESERVATION:

A signed full page proposal (or contract) as well as a retainer fee of 50% of wedding cost is required to reserve the dates and times of the event.The full wedding cost as of this agreement is set at $2280 (quote includes an hourly rate for 7 hours as well as a drive payment of $180 for the travel involved). The deposit is 50% $1140. If the event is rescheduled, postponed, or cancelled; or if there is a breach of the contract by the client, the retainer fee is non-refundable. The client is also responsible for the payment of any of Little Miss Creative’s costs associated with planning for the wedding (such as requested props, or materials specifically purchased at request of the client).

EVENT SCHEDULE:

The client agrees to confirm the final schedule at least 2 weeks prior to the event. Notification of any changes in schedule or location must be made 2 weeks prior to event to allow proper planning arrangements.

SAFETY:

Little Miss Creative reserves the right to terminate coverage and leave the location of the event if the photographer experiences inappropriate or offensive behavior from any person at the event that is seen as unsafe, dangerous, or disrespectful.

PUNCTUALITY:

Little Miss Creative and the client agree to cooperation and punctuality as they are essential to accomplish the goals of the event. Photography will commence at the scheduled start time and will end at the scheduled end time even if the client does not follow set schedule. Any and all additional time beyond the scheduled end time will be billed to the client. The photographer will notify the client that the overtime is occuring so the client can make the decision to keep or release the photographer.

RESPONSIBILITIES:

LMCS is not responsible for a lack of coverage due to causes beyond the control of the company... included but not limited to... obtrusive guests, lateness of the client or guests, weather conditions, schedule complications, incorrect addresses provided to the company, unsightly decor, or restrictions of location. LMCS is not liable for non-ideal lighting conditions or background sets that were chosen by client. LMCS will however, give honest opinions of best lighting and background areas to direct the best possible photo scenes.

VENUE & PERMIT:

LMCS will gladly offer technical recommendations to the venue if inquired, and will uphold and honor the guidelines of the chosen venue or site management.

The client is responsible for acquiring all permits necessary for all locations on which LMCS will be performing services.

MODEL RELEASE:

The client assigns LMCS with full rights to use and publish photos which the client may be included in, for later promotional, editorial, advertising, and social media purposes, and to alter or copyright photos without restriction.

LIMIT OF LIABILITY:

In the unlikely event that the photographer is unable to perform the guidelines of this proposal/contract due to an illness, injury, or unforeseen emergency, the photographer will make every possible effort to ensure a replacement. If a replacement is not found, responsibility and liability is limited to the return of all payments received for the event. In the unlikely event that all digital files have been lost, stolen, or destroyed for reasons beyond the company’s control, including but not limited to harddrive crash or equipment malfunction, the company is fully responsible to return all payments received for the event. If however, only parts of the files have been lost, stolen, or destroyed, LMCS will prorate a partial refund based on the total number of final images and the amount of ‘lost’ images. After receiving all final images from the wedding day, the client is held responsible for maintaining a database of images for their own personal use, not the photographer.

CAPTURING & DELIVERY:

LMCS will honor each request as best as possible to get a significant amount of photos throughout the event, but will not be held responsible for ‘missing’ any moments. The photographer uses artistic discretion to determine what will be presented in each photograph and will do their very best to be present and aware of each special moment. The photographer is given full responsibility to determine which images to release to the client.

POST PROCESSING & EDITING:

All final post processing & editing styles, effects, and overall look of the images will be discussed prior to wedding day so that there are no suprises. The photographer will do their best to share past work and editing style to give a very clear example of what to expect. The client is responsible for viewing online galleries and being fully aware of photographers equipment, editing style, and overall photo quality.

FINAL AGREEMENT:

After reviewing in detail the proposed contract, signing below will state that you read & understand fully the expectations and responsibilities associated with the event previously scheduled. This states that you stand by this contract and have absolutely agreed to the rights and responsibilities of both the client and LMCS on this proposed contract.
