Sub: Abnormal and unwarranted delay in taking final decision on the draft charge submitted by BSNL/DOT regarding Sri M.S.S Rao, ITS of 1978 and worked as CGM/Kerala. Delay in disposal of the case raises legitimate and serious issues of probity. Kind personal intervention solicited to decide on the draft charge sheet expeditiously.

Respected Sir,

The aforesaid officer committed serious irregularities when he was working as GM/Marketing in BSNLCO in the year 2008. A PE report was filed by CBI and the matter was extensively investigated by CBI over a period of six years. Eventually, after establishing involvement of the said officer in serious irregularities perpetrated by him, on the basis of concrete evidence, CBI directed DOT to initiate major disciplinary proceedings against the said officer. The officer has also been placed in the “Agreed list” in May, 2015.

Based on the opinion of CBI, DOT has finalized a draft charge sheet against the said officer and sent it to your office for final approval more than three months before. Unfortunately, final decision on the draft charge sheet is still awaited.

The officer is retiring in December, 2015 and it would be huge wastage of investigations conducted by CBI, spanning over seven years, in case the officer against whom serious charges of corruption are prima facie established by CBI goes unpunished because of delay on part of CVC to decide on the draft charge sheet. It would also erode the credibility of CVC in case immediate decision is not taken and appropriate disciplinary proceedingsare not initiated prior to retirement of the said officer.

Needless to say, the officer is also found prima facie guilty of numerous serious irregularities committed by him as CGM/Kerala after 2012 and action on these irregularities is awaiting approval of MOC&IT. Thus immediately initiating major disciplinary proceedings against the said officer by deciding on the draft charge sheet sent to your office by DOT should be a matter of highest priority for officers dealing with the issue in your office, since this alone will facilitate expeditious initiation of disciplinary proceedings against the said officer prior to his retirement.

Any further delay whatsoever in deciding on the draft charge sheet will be fatal since it will let the officer who is retiring in December, 2015 off the hook and this will encourage corrupt practices to flourish for which entirely CVC will be responsible.
