Repeal of Yard Sale Ordinance

The Town of Hampden hereby ordains that the “Town of Hampden, Maine Yard Sale Ordinance” adopted on October 4, 1982, as amended on November 17, 2003, is hereby repealed in its entirety.

Pursuant to the requirements of Section 213 of the Town Charter, the repealed Ordinance is set forth below, enclosed in brackets.

TOWNOFHAMPDEN,MAINEYARDSALEORDINANCE

[A.PermitRequired.Noperson,firm,corporationorotherentityshallconductayardsaleintheTownofHampdenwithoutfirstobtainingayardsalepermitfromtheCodeEnforcementOfficer of designee.

1.PermitFee–ThefeeforsuchapermitshallbepaidinaccordancewiththeTownofHampdenFeesOrdinance.Civicgroups,schoolgroups,churchgroups,charitableorfraternalorganizationsshallbeissuedayardsale permit freeofcharge.

2. Permit to be Posted.Yard sale permits issued under this ordinance shall be posted at the yardsale in a location which is easily visible fromthe street.

B.Definitions.

1.WordsandtermsnotdefinedinthisordinanceshallhavethemeaningsgiventhemintheZoningOrdinanceoftheTownofHampden,orintheabsenceofdefinitionsinsaidordinance such words and terms shall have their customary dictionary definition.

2.YardSale. Thesaleofgoodsfromaresidentialpremises,whetheradvertisedinlocalmedia,bysigns,orotherwiseasayardsale,barnsale,garagesale,householdsale,movingsale,orothersale,whetheraccomplishedbydirectsaleorauction;orthesale,attheseller’splaceofresidence,ofallorpartofthehouseholdgoods,whether accomplishedbydirectsaleorauction;orsalesconductedbycivicgroups, schoolgroups,churchgroups,charitableorfraternalorganizationsandothernon-profit organizationsifsuchsaleisheldontheorganization’spremisesorwithintheTownBusiness Districts.

2A.Thesaleofneworusedgoodspurchasedorconsignedspecificallyforyardsalesisprohibited.

3.Residential premises. A building or structure having at least one dwelling unit and the lotof land associated therewith.

C.Requirements.

1.No yard sale may be conducted for more than three (3) consecutive days.

2.Noperson,firm,corporationorotherentityshallconductmorethantwo(2)yardsalesfromany residential premises or location in any one (1) calendar year.

3.Intheeventthatahardshipsituationdevelopswhichmaycausecancellationofasale,theCodeEnforcementOfficermayissueanotherpermituponapplicationfromtheperson conducting the sale, setting forth the reason for such cancellation. A fee as prescribed shall not be required in such cases.

4.Allsuchsalesfromnon-residentialpropertiesshallcomplywiththeZoningOrdinanceoftheTownofHampdenexceptyardsalesconductedbycivicgroups,schoolgroups,churchgroups,charitableorfraternalorganizationsandothernonprofitorganizationswhich shall be governed by this ordinance.

5.Signsdesignatingyardsalesshallnotexceedfour(4)squarefeetandshallbearthenameofthepermittee.Signsshallnotobstructtrafficviewsandshallberemovedimmediatelyafter the sale has ended.

D.Enforcement.ThisordinanceshallbeenforcedbytheCodeEnforcementOfficerand/ortheHampden Police Department.

E.Violation.Anypersonwhoviolatesany provision of this section, or fails to comply with anyofitsrequirements,shall,uponconvictionthereof,befinednotlessthantendollars($10.00)ormorethanonehundreddollars($100.00).Eachdaysuchviolationcontinuesshallconstitute a separate offense.]
