Trading Terms and Booking Conditions

Booking and Payment

Your SailingBreaks booking is with Andy Taylor of SailingBreaks who is a RYA approved Commercial Yachtmaster, RYA Yachtmaster Instructor, Principal and Chief Instructor of SailingBreaks sail training school. Provisional bookings made by telephone, email, verbally or via our web site will be held for 7 days. A completed booking form, together with a deposit of £100 per person is required to secure a booking. The final balance of your SailingBreak reservation must be received at least 30 days before the start of your SailingBreak reservation. Failure to pay the balance within 30 days will result in your SailingBreak reservation being cancelled and your deposit forfeited.

Cancellation

If you cancel your SailingBreak reservation at least 30 days before the start of your SailingBreak reservation we will refund 50% of your deposit providing we can re-sell your place. If through unforeseen circumstances we have to cancel your SailingBreak reservation we will offer you alternative dates. Should these be unacceptable to you all monies received will be fully refunded to you. SailingBreaks will have no further liability.

Insurance

The yacht insurance for ‘Brandy of Troon’ does not cover you for accidents or loss or damage to personal effects unless caused by the neglect of our Skipper. It is recommended that you have adequate insurance to cover medical, personal accident, and loss or damage to personal effects. We carry the usual marine insurance policy relating to collision and 3rd party liability limited to £3,000,000.

Joining Instructions & Transport

Should you choose to accept a lift from Andy be aware that SailingBreaks is not a licensed private hire operator. Your payment to us for transfers or transport is your shared contribution to fuel costs only. If you travel to Brandy independently we will meet you in the car park at the agreed time.

Variations

The description of ‘Brandy of Troon’, our SailingBreaks sail training yacht and her equipment is intended to be accurate but we are not liable for any minor inaccuracies.

Fitness

All passengers should be fit enough to participate in operating the yacht. If in doubt please discuss this with us before booking. There is no upper age limit, but all customers must satisfy themselves and a medical professional that they are fit and able to join their chosen course. Sailing is regarded as a physical pastime and customers may be asked to undertake physically demanding work, as part of the course. In signing the booking form I declare to the best of my knowledge, I am not suffering from epilepsy, disability, giddy spells, asthma, diabetes, angina, or other heart condition and I am fit to participate in the sailing course. Please forward details of any medical treatment being received which will be supplied to the instructor. Please advise your instructor if you cannot swim.

Children

Under 18’s are only permitted on courses if accompanied by a parent or guardian.

Safety

Brandy of Troon’ our Moody 36 is a fully ‘Category 2’ coded charter and sail training yacht licensed by the Maritime & Coastguard Agency, a Department of Transport authority. All safety equipment is provided. Customers must ensure they don’t undertake any reckless action which could jeopardise the safety of your fellow students, instructor, any yacht or other vessel or endanger others. Customers must observe high standards of personal conduct and not engage in any activity which could be considered offensive or annoying by a reasonable person. SailingBreaks reserves the right to terminate without warning, the course or experience of any customer engaging in any behaviour considered by the course instructor as offensive or dangerous. It is expressly a condition of course continuation that all customers must comply with the instructions of the Course Instructor. Customers may not use or be in possession of any illicit or illegal substances, firearms or other such offensive or dangerous weapon, item or noxious thing.

Complaints

At the end of your course you will be handed a RYA feedback form. Please use this form to document any dissatisfaction or complaint you may have about your course. The form will be forwarded to the RYA and SailingBreaks will respond in writing to any specific complaint. Please bring any complaint to the immediate attention of your instructor. If we are unable to resolve a dispute to your satisfaction, the RYA will provide an arbitration service whose decision will be binding on both parties.
