Approval of previous minutes

Case # 10-002: Mark & Larissa Gibson, 18329 Laurence Creek Lane, Loveland, CO.

Clarification of our written policy on contractor exam waiver: “Related to scope”

Board Members were provided withStaff report and agenda.

REQUEST: Appeal the Class “B” roof covering & Class III flame-spread rating in the Wildfire Hazard Area.

DISCUSSION: Per Tom Garton: The variance is being requested due to the structure being built in the wildfire hazard area and the yurt (a membrane structure) does not meet the Class “B” roof covering and the Class III flame-spread rating of siding required by the Wildfire Mitigation Ordinance. A tent left in place more than six months is subject to a building permit and is considered a membrane structure.

APPEAL: Applicant would like to use a yurt as a weekend designation during fair weather but leaving it up year around. The owners have stated that there would be no intention of using a wood stove although there is a modification for heat in the current used yurt they purchased. There is no electricity to the site but will have a composting toilet in an adjacent shed. The yurt purchased by the owners sat in an open area for 15 years and has the extra wind/snow kit. The retractable dome was lost due to being left open during a windstorm. The owners would consider taking down the yurt annually leaving only the deck structure.

STAFF RECOMMENDATION:Denial, not sufficient protection being offered to protect the yurt from a forest fire or enough protection for the forest from a yurt fire.

The board passed the motion to deny the yurt to remain on the property permanently through the year.

The regular meeting of the Larimer County Board of Appeals was held in the Horseshoe Lake Conference Room in the Larimer County Courthouse, Fort Collins, Colorado at 7:30 a.m., July 14, 2010, at which time the following business was transacted.

Minutes:Chris Allison moved and Mark Beford seconded the Motion to approve the March 10, 2010 Minutes of the Larimer County Board of Appeals as presented. The Minutes were unanimously approved.

Action:Chris Allsion moved and Mark Belford seconded the motion to deny the variance request.The variance was unanimously denied.

Findings:

Request: Clarification on the Board of Appeal’s policy on contractor exam waiver whether work experience related to Class “B” general contractor license “scope of work” may be both commercial and residential.

Motion: That the scope of work experience for a general contractor license “B” may be both commercial and residential.

Action: Chris Allision moved and Mark Belford second the motion to approve the clarification that Class “B” contractor “scope of work” may be both commercial and residential experience. The Motion was unanimously approved.
