PREAMBLE

This document has been prepared as part of a set of generic documents for use in community water schemes in South Africa. DWAF and BIGEN used the original documents with success in the development of groundwater resources in North West Province. They were subsequently re-formatted with minor adjustments by the VKE/SF Joint Venture, to form part of the "Toolbox" of documents to be utilized by local government authorities and their consultants and advisors to develop their water services.

This document is intended to be used to carry out controlled test pumping of boreholes in order to design and size the correct pumping equipment. The documents need to be adapted for specific projects and the following should be noted:

1.Documents in Section 6 should only be completed after the award of a tender for the Works.

2.Pages should only be initialled by the Contractor and witnessed after the award of a tender for the Works.

3.Documents in Section 8 will be bound in when concluding the Contract Agreement.

1FORM OF CONTRACT AND SUBCONTRACT

Tenders are hereby invited for the testing of boreholes in the ______Municipality”s Area of Jurisdiction in the North-West Province.

This tender calls only for rates on specified items. The contract entered into between the client and contractor shall be binding for _____ year(s) from the appointment of contractor, but may be extended for another year.

The work to be carried out during the currency of the contract may be given as separate tasks. Each task to be undertaken will be issued as a written instruction by the Engineer and will consist of a detailed scope of work and relevant details for each particular task.

The order that will be given to the successful tenderer will be based on the accepted rates and scope of work as decided by the Client in consultation with the Department of Water Affairs and Forestry.

The value of work to be carried out as stipulated in the order will include ten per cent to be used as contingencies in accordance with the general conditions of contract.

Details regarding the works as well as the way in which it must be done are described in Clause PS 3, Details of the Contract, Part 5, Portion 1 of this document.

2ISSUING OF DOCUMENTS

(a)One set of tender documents, one set of drawings, and one copy of the Schedule of Rates are issued to a prospective Tenderer. These documents are obtainable upon payment of a deposit of R200-00 per set from:

(b)This tender document contain pages numbered consecutively. Tenderers must satisfy themselves that the documents are complete. Should any figures or writing be indistinct, or should any pages be missing from this document, or should this document or the drawing(s) contain any obvious errors, the Tenderer must immediately notify the Engineer in order to have any discrepancy rectified, as no claim whatsoever will be entertained for faults in the tender price resulting from the abovementioned discrepancies.
(c)This document is to be left intact in its original format and no pages are to be removed or re-arranged. Should there be inadequate or no space for the Tenderer to enter a particular item, then such information shall be submitted in a covering letter and shall be referred to in the schedule in Part9 entitled "Alterations by Tenderer".
(d)All Tenderers shall be deemed to have waived, renounced and abandoned any conditions which are in conflict with the conditions that are laid down in this document, which are printed or written upon any stationery used by them for the purpose of or in connection with the submission of tenders for this Contract.
(e)The drawings issued with the tender are for tendering purposes only. They form part of the tender and shall be read in conjunction with the standard specifications. The drawings will take precedence over the standard specifications although the latter shall not to be deleted.

3SITE INSPECTION / BRIEFING MEETING

A compulsory official tender briefing meeting will be held. Particulars regarding the briefing meeting appear in the Invitation to Tender, a copy of which has been bound into Part2. The briefing meeting will be attended entirely at the Tenderers own risk and expense insofar as transport and accommodation are concerned. Tenderers shall make their own arrangements in this regard. The Briefing Meeting Certificate that is included in Part9 of this document must be completed in respect of every tender submitted.

Notes

(i)All prices quoted shall be in South African currency and shall exclude Value Added Tax.

(ii)The tender must be signed and witnessed on the Form of Tender annexed hereto, with all blanks in the Tender, Appendix and other forms filled in.

(iii)Individual pages should only be initialled by the Contractor and by the witnesses after the award of a tender for the Works.

(iv)All spaces in the State Tender Board forms and other annexures shall be completed in full.

(v)The Schedule of Rates must be fully priced. Tenderers must tender for all options included in the tender.

(vi)The pro-forma Contract Agreement and Guarantee bound into Part 8 of this volume are not to be completed at the time of tendering.

(vii)The tender documents shall not be separated in any way nor must any pages be detached from the original documents.

5SUBMISSION OF TENDER

The tender document shall be duly completed and signed and shall be submitted as follows:

(a)The tender, together with the covering letter and supporting documents, shall be sealed in an envelope endorsed:

(b)Tenders sealed and endorsed, will be received by:

Tenders must be received in the tender box at the address listed above not later than 12:00 on ______, ______200__.

(c)The extra copy of the Schedule of Rates may be retained by the Tenderer for his records, but the set of drawings must be returned to the consultants at the address listed above. Tenders must be received in the tender box at the address listed above not later than 12:00 on ______, ______2001.

6AUTHORITY OF SIGNATORY

If the Tenderer is a company, a certified copy of the resolution of the Board of Directors of the company (personally signed by the Chairman of the Board), authorising the person who signs this Tender to do so, as well as to sign any contract resulting from this Tender and any other documents and correspondence in connection with this Tender and/or Contract on behalf of the company, must be submitted with the Tender.

If the Tenderer is a close corporation, a certified copy of a resolution of the Board of Officials (personally signed by the Chairman of the Board), authorising the person who signs this Tender as well as any contract resulting from this Tender and any other documents and correspondence in connection with this Tender and/or Contract requiring such signature, to do so on behalf of the close corporation, must be submitted with the Tender.

If the tenderer is a partnership, a certified copy of the resolution of the partners (personally signed by all the partners), authorising the person who signs this Tender, as well as any contract resulting from this Tender and any other documents and correspondence in connection with this Tender and/or Contract on behalf of the partnership, must be submitted with the Tender.

Where the Tenderer constitutes a oneman business, certified proof must be submitted that the person signing this Tender as well as any contract resulting from this Tender and any other documents and correspondence in connection with this Tender and/or Contract, is the sole owner of the oneman business.

If the Tender is submitted by a joint venture of more than one person(s) and/or companies and/or firms, it shall be accompanied by the following:

(a)A draft document under which such joint venture will be constituted. Such document must inter alia define precisely the conditions under which the joint venture will function, its period of duration and the participation of the several constituent persons and/or companies and/or firms;
(b)A certificate signed by or on behalf of each participating person and/or company and/or firm authorising the person(s) who signed the tender to do so.

The form provided for this purpose in Part9 shall be completed in order to indicate the nature of the legal person or body that is submitting the tender.

7______MUNICIPALITY TENDER CONDITIONS AND PROCEDURES

The Contract shall governed by the “General Conditions of Contract for Works of Civil Engineering Construction, Sixth Edition (1990)”. The only variations from these General Conditions of Contract shall be as given in the Special Conditions of Contract as contained in Part3 of this document.

The pro-forma Appendix contained in the General Conditions of Contract is replaced by Appendix contained in Part9 to this document.

The General Conditions and Procedures of ______Municipality as approved by the Department of Water Affairs and Forestry shall apply. Such conditions can be obtained from ______Municipality.

8ALTERNATIVES

A Tenderer who has duly submitted an offer which in all respects complies with the specification may, at his own initiative, also submit an alternative offer at the same time or any time prior to the closing time of tenders. Provided that the tenderer's offer to specification is acceptable to the Goudveld Water Board in every respect, his alternative offer may also be considered for purposes of the award of the contract. Any deviation from specification or alternative condition of tender must be clearly stated. Any saving or additional expenditure for the Municipality brought about by each deviation or alternative proposal must be quantified in the tender documents.

Should the Tenderer wish to offer alternative designs and/or construction materials or any other alternative, he shall include with his Tender full details thereof, including a complete schedule of rates, formal design calculations, and full details of all alternative components proposed to be included in the works. Refer also to Clause 6(2) of the Special Conditions of Contract in this regard.

Failure to properly comply with this clause, thereby not enabling the Employer and/or the Engineer to properly assess the full implications of the alternative tender, is likely to disqualify the alternative offered from further consideration.

No submission by the Contractor after award for additional payment or time for completion of the Works relating to the alternative offer will be considered, the tendered rates submitted being considered to reflect the full and final cost implications of the alternative offer.

9VALIDITY

This Tender shall remain valid for the number of calendar days that is indicated in the Appendix to Tender (Part9), calculated from the date and time of tender closure indicated on the cover page of this volume. Should the tender validity expire on a Saturday, Sunday or public holiday, the tender shall remain valid and open for acceptance until the closure of business on the following working day.

In submitting a tender, the Tenderer expressly agrees that he shall be committed to these tender conditions, and to his offer to execute the Works at his tender price as may be adjusted in terms of the Preamble and the Form of Tender, for the period of validity as calculated above.

Should the Tenderer unilaterally withdraw his tender during this period, the Employer shall, without prejudice to any other rights he may have, be entitled to accept any less favourable tender for the Works from those received, or to call for fresh tenders, or to otherwise arrange for execution of the Works, and the Tenderer shall pay on demand any additional expense incurred by the Employer on account of the adoption of the said courses, as well as either the difference in cost between the tender withdrawn (as corrected in terms of the Preamble and Form of Tender) and any less favourable tender accepted by the Employer, or the difference between the tender withdrawn (as corrected) and the cost of execution of the Works by the Employer as well as any other amounts the Employer may have to pay to have the Works completed.

10FORM ST8

The copy of Form ST8, annexed to these documents (as Annexure 9.17), must be completed and signed by the Tenderers. In the event of a conflict between the terms and conditions of Form ST8 and the terms and conditions of the rest of the bound document, the terms and conditions of the rest of the bound document will take precedence over the said Form ST8.

11PREFERENCE FOR PRODUCTS MANUFACTURED OR ASSEMBLED LOCALLY

Tenderers desirous of claiming preference for products manufactured or assembled in the RSA and/or territory granted independence by or under any Act of Parliament of the RSA must complete and sign the Preference Certificate, Form ST11 (as Annexure 9.11) or no preference will be allowed.

12TENDERERS TO COMPLY WITH DOCUMENTS

Tenderers must allow in their Tenders for all labour, materials, machinery and everything necessary for the execution and completion of the Contract in accordance with the tender documents. No alternations may be made in the Form of Tender, Schedule of Rates or other documents and the tender will be deemed to comply entirely with the terms of the documents.

13SUBCONTRACTORS

Tenderers must submit with their Tenders (Part9) the names and addresses of any subcontractors they propose to appoint, as well as the section of the Works on which each such subcontractor will be employed. The abovementioned subcontractors are not to be confused with the Emerging Contractors as mentioned previously in the document.

14ACCEPTANCE OR REJECTION

Tenders may be rejected if they show unacceptable departure from the conditions or specifications contained in the tender documents, or if they are incomplete in any way. The Employer does not bind itself to accept the lowest or any tender, and reserves the right to accept any tender it may deem expedient, nor will it assign any reason for the acceptance or rejection of any tender.

15TELEGRAPHIC TENDERS

Telegraphic, telexed, telefaxed or e-mailed tenders will not be considered.

16REFUND OF DEPOSITS

The tender deposit is non-refundable.

17CHEQUES

All payments and deposits are to be made in the currency of the Republic of South Africa and cheques are to be made payable to the ______, ______Municipality.

18DETAILS OF DOCUMENTS TO BE KEPT CONFIDENTIAL

All recipients of the tender documents, whether they submit a tender or not, must treat the details of the document as private and confidential.

19EMPLOYMENT OF LOCAL LABOUR

The Government has indicated a desire to stimulate the local economic activities in the area and for this reason a high rate of local labour will be a pre-requisite for the activities which are to be executed by means of LIC-methods.

20FINANCIAL STANDING

Should he be so requested, the Tenderer shall within 7 days of the date upon which he is requested to do so, submit a full report from his banker as to his financial standing. The Employer may, in its discretion, and subject to the provisions of Section 4(1)(d) of the State Tender Board Act 86 of 1968, condone any failure to comply with the foregoing condition.
