Hazardous Waste Controls

for Construction, Renovation, and Demolition Projects

Theconstruction,renovation,or demolitionof buildingsor otherfacilitycomponentsgenerates wastematerialswhichtheFloridaDepartmentof EnvironmentalProtectionandtheU.S. EnvironmentalProtectionAgencymightconsiderhazardous.Thesematerialsinclude,butarenot limitedto,spentfluorescentlamps,PCB containingballasts,mercurycontainingthermostats, switchesandrelays,paints,paintthinners,strippers,cleaningproducts,adhesives,caulking materials,contaminatedrags, drop clothsandbrushes andwastematerialscontainingheavy metals such as lead,mercuryandchromium.

Under theResourceConservationandRecoveryAct,generatorsof hazardouswastes are responsiblefor theproperhandling,trainingof personnel,andthestorage,labeling,

transportationanddisposalof thesewastes.Thedefinitionof generatorin40 CFR 260.10 is“any person, by site, whose act or process produces regulated hazardous waste”.TheFlorida Departmentof EnvironmentalProtection(DEP) hasdeterminedthatregulatedgeneratorsof hazardouswasteareresponsiblefor allhazardouswastes generatedon theirsites.

FloridaGulfCoastUniversityisdesignatedaConditionallyExempt-SmallQuantityGenerator (EPA ID # FLR000102293).Dependingon wastevolumes,thisdesignationissubjecttochange. TheEnvironmentalHealthandSafety(EH&S) departmentwillnotifytheContractorifthis designationchanges.Allwork conductedwithintheboundariesof thisprojectmustmeetthe regulatoryrequirementsof theUniversity’scurrentgeneratordesignation.

As anagentof FGCU, theContractormustabideby allof therequirementsapplicabletothis generatorstatusregardingtrainingandstorage,handling,anddisposalofallconstructionderived wastes. Therefore,contractors,sub-contractors,andtheiremployees,intendingtobidon projects anddo work for theUniversity,mustcomplywiththefollowingproceduresandrecord-keeping requirements.

Contractor Liabilities forEnvironmental Protection

TheContractorisadvisedthatthisprojectandtheFGCU campusaresubjecttoFederal,State, andlocalregulatoryagencyinspectionstoreviewcompliancewithenvironmentallawsand regulations.TheContractorshallfullycooperatewithanyrepresentativefromanyFederal,State

or localregulatoryagencywho mayvisitthejobsite,andwillprovideimmediatenotificationto EH&S.A representativeof EH&SwillaccompanytherepresentativeandContractoron any subsequentsiteinspections.

TheContractorwillcomplete,maintain,andmakeavailabletoEH&SandotherFGCU, or regulatoryagencypersonnel,alldocumentationrelatingtoenvironmentalcomplianceunder applicableFederal,Stateandlocallawsandregulations.TheContractorwillimmediatelynotify EH&SiftheContractorisissued anoticeofviolation,deficiency,or noncompliancefor an activityrelatedtohealth,safety,or theenvironment.

CONTRACTOR agreestoindemnifyandholdharmlessUNIVERSITY, itsgoverningboard, officers,employees,andagentsfromandagainstanyandallcosts, losses, damages,liability, claims,expenses,damages,demands,fees,fines,penalties,suits,proceedings,actionsandcosts of actions,includingcourtcosts andattorney’sfeesfor trialandon appealandfor the preparationof same,whichmayariseas aresultof CONTRACTOR’s, itsofficers’,agents’or employees’actsintheperformanceof theservicesrequiredunderthiscontract.

UnforeseenHazardousor RegulatedMaterial

If theContractorencountersahazardousmaterialnotanticipatedinthecontractdocuments whichpresentsadangertohealthor theenvironment,stopthatportionof thework andnotify EH&Simmediately.Examplesof potentialunforeseenhazardousmaterialincludebutarenot limitedtomaterialscontainingPCBs, leadpaint,mercury,petroleumproducts,andfriableand non-friableasbestoscontainingmaterials.

Oily and Hazardous Substances

TheContractorwillpreventoilor hazardoussubstancesfromenteringtheground, drainageareas, or navigablewaters.Surround temporaryfueloilor petroleumstoragetankswithatemporary bermor containmentof sufficientsizeandstrengthtocontainthecontentsof thetanks,plus10 percentfreeboardfor precipitationinaccordancewith40 CFR 112. Thebermwillbeimpervious tooilfor 72 hours andconstructedso thatanydischargewillnotpermeate,drain,infiltrate,orotherwiseescapebeforecleanupoccurs.

Conductthefuelingandlubricatingof equipmentandmotorvehiclesinamannerthatprotects againstspillsandevaporation.Manageallusedoilgeneratedon siteinaccordancewith40 CFR

279.

Contractorshalldetermineifanyused oilgeneratedwhileon-siteexhibitsacharacteristicof hazardouswaste.In addition,usedoilcontaining1000 partsper millionor moreof halogenswill beconsideredahazardouswaste.Used oilmixedwithahazardouswastewillalsobeconsidered a hazardouswaste.

Control and Disposal of Solid Wastes

Pickup solidwastes, andplaceincoveredcontainerswhichareemptiedregularly.Prevent contaminationof thesiteor otherareaswhenhandlinganddisposingofwastes.Recyclingis encouragedandcanbecoordinatedwithEH&SandtheFGCUPhysicalPlantdepartment. RemoveallsolidwastefromUniversitypropertyanddispose off-siteatanapprovedlocationor facility.Solidwastedisposaloff-sitemustcomplywiththemoststringentlocal,State,or Federal requirementsincluding40 CFR 241, 40 CFR 243, and40 CFR 258.

LightingFixtures

Fluorescentbulbsandballastsshallberemovedfromalllightingfixturespriortodisposal. Fluorescentbulbsshallbeplacedinappropriatesizetubecartonsfromoriginalcartonsor availablefrombulbrecyclingfacilities.Do notbreakbulbs.Do nottapebulbs.Placebroken bulbsinsealedcontainersandhandledseparately.Labeleachbox inaccordancewithFAC 62-

737 anddate.

BallastsshallbeseparatedintoPCB andnon-PCBcategoriesandplacedintoseparate55 gallon (or appropriatesmallersize)open-headsteeldrums.Labeleachdrumwithappropriatelabels: "PCB Ballastsfor Recycling"or "Non-PCB Ballastsfor Recycling".

PaintRemnants

Contractorisresponsiblefor removalof excesspaintproductsas wellas emptycontainersfrom theproject.ThecontractorshalldelivertothePhysicalPlantdepartmentpaintshop asampleof eachof thepaintcolorsandtypesusedon theproject.Eachsampleislimitedtoindividualmetal or plastic1-gallonpaintcaningood conditionwiththeappropriatelabelinformationattached includingthemixspecificationsandapaintedsampleon apieceof paper.Rustedor severely dentedcansarenotingood condition.

Dumpsters

Equipdumpsterswithacoverandkeepthecoverclosed,exceptwhen loadingtrashanddebris. Locatedumpstersbehindtheconstructionfenceandoutof thepublicviewtotheextentpossible. Securecoverson dumpstersnotlocatedwithintheconstructionfencetopreventunauthorizeduse. If necessary,provideadditionaltrashcontainerstocollectdebrisintheconstructionsite

area.Locatethetrashcontainersbehindtheconstructionfenceor outof thepublicview,and emptyatleastdaily.

For largedemolitions,largedumpsterswithoutlidsareacceptablebutshouldnothavedebris higherthanthesides beforeemptying.

Alldumpstersandtrashcontainersmusthavea“No HazardousWaste”signs affixedtheexterior andvisiblefromalllocationswherewastes canbeputintothecontainer.Adhesivesignmodel

Releases/SpillsofOilandHazardousSubstances

Takeprecautionstopreventreleases/spillsof oilandhazardousmaterials.

In theeventof anyreleasesofoilandhazardousmaterials,chemicals,orgases;immediately (within15 minutes)notifytheUniversityPoliceDepartmentandEH&S.TheUniversityEH&S shallmakeverbalandwrittennotificationstotheappropriateagencyas requiredby Federalor Stateregulations.TheContractorshallcollectandprovideinformationas neededtoEH&S.

Spillresponse shallbeinaccordancewithFederal,Stateandlocalregulations.Containandclean up thesespillswithoutcosttotheUniversity.If Universityassistanceisrequestedor required,

theContractorshallattheUniversity’sdiscretionreimbursetheUniversityfor reasonable expensesarisingfromsuch assistance.

Air Conditioning Equipment

Removeairconditioningequipmentidentifiedfor removalwithoutreleasingchlorofluorocarbon refrigerantstotheatmosphereinaccordancewiththeCleanAir ActAmendmentof 1990. Recoverallrefrigerantspriortoremovingairconditioningequipmentanddispose ofas directed by EH&S.

ClassI ODS as definedandidentifiedhereinshallnotbeused intheperformanceof this contract,nor beprovidedas partof theequipment.Thisprohibitionwillprevailoveranyother conflictingprovision,specification,drawing,or referenceddocuments.

REQUIRED SUBMITTALS

Environmental Records Binder

Maintainon-site,inaseparategreenthree-ringbinder(s),copiesofallsubmittalsrequiredinthis section.SubmitthisnotebookandtheincludeddocumentstotheUniversity’sDepartmentof EnvironmentalHealthandSafetyatthecompletionof project.

PollutionPrevention

TheContractorshalldocumentthemanagementproceduresimplementedtopreventthe accidentalreleaseof hazardousor otherwiseregulatedwastegeneratedon thisproject.At a minimum,thisdocumentationshallinclude:

1.Methods of accumulation(i.e.,intanksand/orcontainers),anddesignationof the individual(s)responsiblefor thewasteaccumulationsite(s).

2.Contractor’smanagementproceduresfor identification,storage,labeling,transportation, anddisposalof hazardouswasteanduniversalwaste(treatmentof wasteisnotallowed unless specificallynoted).

3.Contractor’smanagementproceduresandregulatorydocumentationensuringdisposal of hazardouswastecomplieswithLandDisposal Restrictions(40 CFR 268).

4.Contractor’smanagementproceduresfor thepreventionor controlof released hazardousmaterials.

Hazardous Waste Minimization

TheContractorshallactivelypursue minimizingtheuse of hazardousmaterialsandthe generationofhazardouswastewhileon theFGCU campus.Contractorshalldocumentthe managementproceduresimplementedto minimizethegenerationof hazardous,universal,and industrialwastes. In addition,theContractorshalldocumenteffortstoidentifyandrecover recyclablematerialsonthisproject.Ataminimum,thisdocumentationshallinclude:

1.Contractor’smanagementproceduresfor recyclablehazardousmaterials.

2.Contractor’smanagementprocedurestoidentifyandrecovernon-hazardousrecyclable materials.

3.Contractor’sused oilandoilfiltermanagementinaccordancewith40 CFR 279.

4.Contractor’smanagementplanto minimizethegenerationof hazardous,universal,and industrialwastes.

Hazardous Materials List

TheContractorshallprepareandsubmitalistofthehazardousmaterials,or productscontaining hazardousmaterials,intendedfor use duringthisproject.CalledtheHazardousMaterialsList, thisreportshallincludetheprojectname,estimatesof thequantitiesof thehazardousmaterials intendedfor use, copiesof theMaterialSafetyDataSheets(MSDS) for thesematerials,andthe nameandcontactinformationfor theperson(s) preparingthislist.Submitthislistandrevisions

toEH&Sfor approvalpriortobringinganyproductscontaininghazardousmaterialsontothe

FGCU campus.

Theuse of solventscontainingan F-listed(40 CFR 261.31) constituentinexcessof 10% by volumeisnotpermittedon theFGCU campuswithoutthepriorwrittenpermissionof the University’sDepartmentof EnvironmentalHealthandSafety.Torequestpermissiontouse a solventcontainingan F-listedconstituent,documentthespecificneedtouse theproduct,andthe proceduresthatto minimizetheamountofproductused andto managewastes and

contaminationresultingfromuse of theproduct.

Waste Profile Documentation

TheContractorshallcompleteawasteprofilefor allwastes resultingfromconstruction, renovation,or demolitionactivitiesand/ortheuseof such productsas:

allpaints

caulkingmaterials solvents

adhesives

aerosols

petroleumbasedmaterial treatedlumber

cleaningproducts

Contractormayuse theformattachedattheendof thissection“HazardousWasteDeterminationForm for Construction,Demolition,or Renovation”,or anotherformprovidingequivalentinformation. Determinewasteprofilesatthepointofgenerationandsufficientlydocumentwhetherthewastewill

beasolidwaste,hazardouswaste,universalwaste,industrialwaste,or otherwiseregulatedwaste.

Basethewasteprofileupon aconstituentlistingfromthemanufactureror avisualidentificationof the wastecombinedwithconsiderationof thewastegeneratingprocess, andanylaboratoryanalysis necessarytocompletethedetermination.MaterialSafetyDataSheets(MSDS) by themselvesarenot adequate.TheContractorshallbearthecostof thewasteprofiledeterminations.

SubmitthecompletedwasteprofiletoEH&Sfor reviewpriortoaggregatingor disposingof anysolid waste.

LaboratoryAnalysis and Accreditation Certificate/License

Retaincopiesof anylaboratoryanalysisof wasteor debrisused tosupport anyWasteProfile determination.Analyticallaboratoriesmustuse EPA approvedmethods,andbeaccreditedby the NationalVoluntaryLaboratoryAccreditationProgram,or theAmericanIndustrialHygiene Association,andlicensedfor work intheStateofFloridawhereapplicable.

Contractor 40 CFR Employee Training Records

TheContractorshallensureproperclassroomoron-the-jobtrainingfor allpersons who work or superviseoperationsatthisproject,andwhose actionsor failuretoactmayresultinnoncompliance. Thistrainingmustteachtheparticipantstoperformtheirdutiesinaway thatensures compliancewith theapplicableFederal,StateandlocalhazardouswasteregulationsappropriatetotheUniversity’s currentRCRA generatorstatus.Prepareandmaintainrecordsof thisemployeetrainingthroughoutthe termof theproject.

Solid Waste Disposal Report

MonthlytheContractorshallsubmitasolidwastedisposalreporttoEH&S.For eachwasteprofile category,thisreportshallstatetheclassification,amount,location,andnameof thebusiness receiving thewaste.TheContractorshallincludecopiesof thewastehandlingfacilities’weighttickets,receipts, billsofsale,copiesofallapplicableEPA andFLDEP permit(s),manifest(s),or license(s)for transportation,treatment,storage,anddisposalofhazardousor otherwiseregulatedwaste,andany other relateddocumentation.

In lieuof salesdocumentation,theContractormaysubmitastatementindicatingthedisposallocation for thesolidwaste,signedby anofficerof theContractorfirmauthorizedtolegallyobligateor bind the firm.Thesalesdocumentationor Contractorcertificationshallincludethereceiver’stax identificationnumberandthebusiness’sEPAor Stateregistrationnumber,alongwiththereceiver’s deliveryandbusiness addresses andtelephonenumbers.

For eachsolidwasteretainedby theContractorforhisor herown use, theContractorshallsubmiton thesolidwastedisposalreporttheinformationpreviouslydescribedinthisparagraph.Pricespaidor receiveddo notneedtobereportedtoEH&Sunlessrequiredby otherprovisionsor specificationsof thisContractor publiclaw.

For allhazardousor otherwiseregulatedwastes,theTransporter’sManifestmustincludethe

University’sDEP/EPA IdentificationNumber.
