Regular Town Board Meeting Minutes

Wednesday, January 12, 2011

6:45 p.m.

Present: Town Supervisor Roy Barriere, Town Councilperson Ron Clark, Town Councilperson Jean Owens, Town Councilperson Debbie Teeter, Town Highway Superintendent Barry Rollins, Town Clerk Alice Linton. Absent: Town Councilperson Chris Hern.

Town Supervisor Barriere opened the meeting at 6:45 p.m. by leading the assemblage in the Pledge of Allegiance to the Flag.

Privilege of the Floor:

Gerry Achilles of 121 South Applegate Road was concerned that the road for the new highway facility wasn’t included in the bid. He also was concerned about the Enfield Highway Department working on the road.

Stanley and Carol Carpenter requested that the local law concerning purebred licenses be revisited.

Approval of Minutes:

Councilperson Owens moved to accept the minutes of the regular meeting of December 8, 2010 and the special meeting of December 16, 2010, with a second by Councilperson Teeter.

Vote: Councilperson Clark abstain, Councilperson Owens aye, Councilperson Teeter aye, Supervisor Barriere aye. Councilperson Hern absent. Carried

Councilperson Teeter moved to accept the minutes of the January 5, 2011 Organizational Meeting, with a second by Councilperson Clark.

Vote: Councilperson Clark aye, Councilperson Owens abstain, Councilperson Teeter aye, Supervisor Barriere aye. Councilperson Hern absent. Carried

Correspondence:

Letter from Recreation Partnership stating that our payment for 2011 is reduced by $350 down to $5,185. Our agreement extends through 2013, but there is concern that some municipalities may back out. Their next meeting is January 25.

Audit Claims:

Councilperson Clark moved for the board to authorize the supervisor to pay General Fund vouchers #1-#40 dated January 12, 2011 in the amount of $45,435.55 and Highway Fund vouchers #1-#23 dated January 12, 2011 in the amount of $31,399.20 and Fire Department vouchers #1-#2 dated January 12, 2011 in the amount of $86,206.00. Councilperson Owens seconded the motion.

Vote: Councilperson Clark aye, Councilperson Owens aye, Councilperson Teeter aye, Supervisor Barriere aye. Councilperson Hern absent. Carried

County Legislator’s Report: None

Highway Superintendent’s Report:

Buddy Rollins received a call from BOCES regarding the internship program. There are two high school seniors from Enfield interested this year – one on the mechanical side and the other on the operator side. Releases will be signed – there will be no liability for the town. The highway crew has been plowing snow and everything is running smoothly.

The 284 Annual Plan of Major Projects was presented by Superintendent Rollins. Oil and stone on the last mile of Fish Road and the last mile of Harvey Hill Road, along with bridge work on Enfield Center Road are planned.

Councilperson Owens moved to enter into an agreement for the expenditure of highway money for the year 2011 with the highway superintendent. Supervisor Barriere seconded the motion.

Code Enforcement Officer’s Report:

Alan Teeter presented the Annual Report for 2010. There were 77 building permits issued or renewed, 16 new homes, 54 certificates of occupancy/completion issued, 300 building inspections, 6 certificates of compliance issued, 14 meetings with owners/builders/state, 15 complaints received, 12 complaints valid, 6 letters of voluntary compliance sent, 8 orders to remedy, 7 fire and safety inspections – public assemblies, 1 fire and safety inspection – multiple residence, 3 fire and safety inspections – general occupancies, 5 fire and safety inspections – re-inspections, 4 fire and safety inspections – owner requested, 9 operating permits issued, 8 house numbers issued, 16 house numbers installed. They have also been working on the annual report for the state and a new local law for adopting the 2010 building codes.

Committee Reports:

Planning Board: Alan Teeter attended the meeting and reported the committee is still working on the final site plan review law. Mike Carpenter was appointed co-chair along with Virginia Bryant. Jim McConkey will remain on the board.

Health Insurance Consortium: Supervisor Barriere stated we are now receiving bills.

Enfield Community Council: Supervisor Barriere met with the ECC. They are going to review the contract – we currently are in our third year of a five year contract with the ECC. Due to the lack of funding from the county, we can either amend or redo the contract. Councilperson Teeter added some minor changes are being made to their By-Laws and their annual meeting is set for February 1. The summer camp will once again be held at Robert Treman State Park and this year the park will provide free hang tags so families can drop off and pick up campers without paying a fee.

Enfield Volunteer Fire Company: No report.

Facilities Manager: No report.

Communication Access Committee: No report.

Facilities Development:

Resolution #2011-19

ENFIELD HIGHWAY FACILITY PLAN APPROVAL AND BID SCHEDULE

Whereas, after careful consideration by the Enfield Town Board working in conjunction with the Facility Development Committee and Resource Associates, a building design and BID schedule has been developed for the new Enfield Highway Facility, NOW THEREFORE BE IT

RESOLVED, that the design for the new Enfield Highway Facility prepared and presented by Resource Associates on January 7, 2011 and unanimously recommended by the Facility Development Committee be approved for construction, and BE IT FURTHER

RESOLVED, that the Facility Development Committee is authorized to finalize and approve BID specifications for the new Enfield Highway Facility, and BE IT FURTHER

RESOLVED, that the Enfield Attorney for the Town be instructed to prepare the legal notice to be posted starting on January 31, 2011 putting the construction of the new Enfield Highway Facility out for public BID according to the requirements of NYS Town Law, and BE IT FURTHER

RESOLVED, that sealed BIDS must be submitted before 4:00 PM Wednesday, March 2, 2011 to the Enfield Town Clerk at the Enfield Town Hall, 168 Enfield Main Rd., Ithaca, NY 14850, and BE IT FURTHER

RESOLVED, that those sealed BIDS submitted before 4:00 PM on March 2, 2011 will be opened by the Enfield Town Supervisor or Enfield Deputy Town Supervisor starting at 4:00 PM Wednesday, March 2, 2011 at the Enfield Community Building, 182 Enfield Main Rd.. Ithaca, NY 14850, and BE IT FURTHER

RESOLVED, after careful consideration of the BIDS, the Facility Development Committee will make recommendations to the Enfield Town Board. On March 16, 2011 at 6:30 PM the Enfield Town Board will award the BID for the construction of the new Enfield Highway Facility, reserving the right to reject any and all BIDS.

Councilperson Owens moved, with a second by Councilperson Teeter to adopt Resolution #2011-19.

Discussion: Councilperson Owens mentioned there is a two week period between when bids are opened and when the bid is awarded. This will provide time to make sure each line of the bids that come in are in agreement with the bid specifications and will allow opportunity for either Resource Associates or committee members to make contact with the bidder if there are any questions.

The committee will have a final meeting with Resource Associates after everyone has had an opportunity to look at the binder of bid specifications. The specs will be firmed up and thoroughly discussed, since change orders are expensive. There are certain parts of the specifications, such as cold storage, that can be removed if the bids come in over the limit of what the town can borrow. If necessary, all bids can be rejected. Councilperson Owens added that at the meeting with Resource Associates they will discuss who will be responsible for watching the progress and signing off. The town is trying to use local people for the work if possible.

Personnel Committee: No report.

Tompkins County Council of Governments: No meeting in December.

Old Business:

Deferred Compensation: No update.

New Business:

Volunteer of the Month: Kenneth and Mary Eckert were nominated for the January, 2011 Enfield Volunteer of the Month. Mr. and Mrs. Eckert have volunteered at the Enfield Food Pantry for over 20 years. They help with Health Department flu clinics and the Enfield Senior Citizens group.

Adjournment: Supervisor Barriere moved, with a second from Councilperson Teeter, to adjourn the meeting at 7:25 p.m.
