CHAPTER D.1

MAINTENANCE ORGANIZATIONS AND DESIGN ORGANIZATION

1.GENERAL

1.1This chapter prescribes the condition for grant of approval to a maintenance organization forming as well as not forming (a separate) part of an aircraft operator's organization and also specifies the application procedures for grant, extension or renewal of a Certificate of Approval as per NCAR-145.

1.2This chapter prescribes the condition for grant of validation of design organization based on the approval granted by the competent authority of the contracting state.

2.CONDITIONS FOR EXTENSION OR RENEWAL OF APPROVAL FOR MAINTENANCE ORGANIZATION

2.1ISSUE OF APPROVAL

The issue of a maintenance organization approval by a CAAN shall be dependent upon the applicant demonstrating compliance with the requirements of NCAR 145 and the relevant provisions contained in Annex 19 for such organizations.

2.1.1 The approval document shall contain at least the following:

a) organization’s name and location;

b) date of issue and period of validity;

c) terms of approval.

2.1.2The continued validity of the approval shall depend upon the organization

remaining in compliance with the requirements of Para 2 and NCAR 145 and with the relevant provisions contained in Annex 19 for an approved maintenance organization.

2.2 MAINTENANCE ORGANIZATION’S EXPOSITION MANUAL

2.2.1 The maintenance organization shall provide for the use and guidance of

maintenance personnel concerned a procedures manual which may be issued in separate parts containing the following information:

a)a general description of the scope of work authorized under the organization’s terms of approval;

b)a description of the organization’s procedures and quality or inspection system in accordance with 2.4;

c)a general description of the organization’s facilities;

d)names and duties of the person or persons required by 2.6.1;

e)a description of the procedures used to establish the competence of maintenance personnel as required by 2.6.3;

f)a description of the method used for the completion and retention of the maintenance records required by 2.7;

g)a description of the procedures for preparing the Certificate for Release To service and the circumstances under which the release is to be signed;

h)the personnel authorized to sign the maintenance release and the scope of their authorization;

i)a description, when applicable, of the additional procedures for complying with an operator’s maintenance procedures and requirements;

j)a description of the procedures for complying with the service information reporting requirements of Annex 8, Part II, 4.2.3 f) and 4.2.4; and

k)a description of the procedure for receiving, assessing, amending and distributing within the maintenance organization all necessary airworthiness data from the type certificate holder or type design organization.

2.2.2 The maintenance organization shall ensure that the exposition manual is amended as necessary to keep the information contained therein up to date.

2.2.3 Copies of all amendments to the exposition manual shall be furnished promptly to all organizations or persons to whom the manual has been issued.

2.3 SAFETY MANAGEMENT

Note. Annex 19 includes safety management provisions for approved maintenance organizations. Further guidance is contained in the Safety Management Manual (SMM) (Doc 9859).

2.4 MAINTENANCE PROCEDURE AND QUALITY ASSURANCE SYSTEM

2.4.1 The maintenance organization shall establish procedures, acceptable to the State granting the approval, which ensure good maintenance practices and compliance with all relevant requirements of this chapter.

2.4.2 The maintenance organization shall ensure compliance with 2.4.1 by either establishing an independent quality assurance system to monitor compliance with and adequacy of the procedures, or by providing a system of inspection to ensure that all maintenance is properly performed.

2.5 FACILITIES

2.5.1 The facilities and working environment shall be appropriate for the task to be performed.

2.5.2 The maintenance organization shall have the necessary technical data, equipment, tools and material to perform the work for which it is approved.

2.5.3Storage facilities shall be provided for parts, equipment, tools and material. Storage conditions shall be such as to provide security and prevent deterioration of and damage to stored items.

2.6 PERSONNEL

2.6.1 The maintenance organization shall nominate a person or group of persons whose responsibilities include ensuring that the maintenance organization is in compliance with the requirements of Para 2 for an approved maintenance organization.

2.6.2 The maintenance organization shall employ the necessary personnel to plan, perform, supervise, inspect and release the work to be performed.

2.6.3 The competence of maintenance personnel shall be established in accordance with a procedure and to a level acceptable to the State granting the approval. The person signing a maintenance release shall be qualified in accordance with Annex 1.

2.6.4The maintenance organization shall ensure that all maintenance personnel receive initial and continuation training appropriate to their assigned tasks and responsibilities. The training programme established by the maintenance organization shall include training in knowledge and skills related to human performance, including coordination with other maintenance personnel and flight crew.

2.7 RECORDS

2.7.1 The maintenance organization shall retain detailed maintenance records to show that all requirements for the signing of a maintenance release have been met.

2.7.2 The records required by 8.7.7.1 shall be kept for a minimum period of one year after the signing of the maintenance release

2.8 CERTIFICATE FOR RELEASE TO SERVICE

2.8.1 A Certificate for Release To Serviceshall be completed and signed to certify that the maintenance work performed has been completed satisfactorily and in accordance with approved data and the procedures described in the maintenance organization’s procedures manual.

2.8.2Certificate for Release To Serviceshall contain a certification including:

a) basic details of the maintenance carried out including detailed reference of the approved data used;

b) the date such maintenance was completed;

c) when applicable, the identity of the approved maintenance organization; and

d)the identity of the person or persons signing the release.

2.1An organization approved to perform specified maintenance may apply for its approval to be extended to cover additional maintenance. The application must be made in writing and must detail the reasons for the application and the facilities available to perform the additional maintenance.

2.2A Certificate of Approval is valid for one year. It may be renewed by CAAN if the organization continues to meet the conditions applicable to the original grant of the certificate and subject to satisfactory annual audit report from Airworthiness Inspection Division. Application for renewal of a Certificate of Approval must be made in writing not later than two weeks before expiry of the existing certificate.

  1. CONDITIONS FOR VALIDATION OR RENEWAL OF VALIDATION FOR DESIGN ORGANIZATION

3.1 An organization approved to perform specified design on repair may apply for its validation to CAAN. The application must be made in writing and must detail the reasons for the application with applicable supporting documents and required manuals.

3.2.1A Certificate of validation is valid for one year. It may be renewed by CAAN if the organization continues to meet the conditions applicable to the original grant of the certificate. Application for renewal of a Certificate of validation must be made in writing not later than two weeks before expiry of the existing certificate.

3.3Director General may grant certificate of validation to such organization if it meets the requirements mentioned in part 21 of FAR and EASA and of equivalent document of contracting state.

4.INSPECTION OF A MAINTENANCE ORGANIZATION/ DESIGN ORGANIZATION

4.1A maintenance organization/ Design organization for which application has been made for the issue/ validation, extension or renewal of a Certificate of Approval is subject to inspection by the authorized person from the Airworthiness Division.

4.2An applicant for approval shall provide them with any information or access required for verifying the capability of the organization to meet the conditions of approval.

4.3A maintenance organization/ Design organization holding a Certificate of Approval is subject to random inspections by an authorized person from Airworthiness Inspection Division, although such inspections will only be made at reasonable times.

5. ISSUE/ RENEWAL OF VALIDATION OF FOREIGN CERTIFICATE OF APPROVAL FOR MAINTENANCE ORGANIZATION

5.1Maintenance organizations outside Nepal issued with a Certificate of Approval by a Contracting State may apply for the validation of the Certificate of Approval and this may be granted by the Director General in compliance with the Rules 49 of Civil Aviation Regulation if the applicant:

(a) submits the exposition manual/ quality manual and latest amendments if any.

(b) Pays the prescribed fees.

(c) If the operator is applying on behalf of the Maintenance organization,

authorization letter from the respective organization must be submitted.

5.2 Validation remains in force only during the period of validity of the foreign Certificate of Approval.

5.3 Maintenance organization holding validation or an applicant for validation, which is not in Nepal, isnormally subjected for inspection or verification for every three years by an Airworthiness Inspection Division official unless Memorandum of Understanding is signed between CAAN and Contracting State or other types of oversight capability means is applied and is acceptable for Director General. The expenses of such inspection shall be borne by the organization itself or the Nepalese operator utilizing the service of such organization.

5.4 The Director General may withdraw the validation if the maintenance organization fails to abide by or acts in contradiction to NCAR and fails to maintain the standard performance.

5.5 The certificate of validation shall remain valid till the date of validation of original approval but shall not exceed one year.

5.6 The authority issuing original approval shall also be informed about the validation of certificate.

5.7 Maintenance Organization Approval issued by FAA USA and EASA may be directly accepted.

5.8Airworthiness Inspector may conduct audit of foreign Maintenance organization if found necessary in between the said periods if Memorandum of Understanding is not Signed between CAAN and Contracting states.
