Rules and Regulations

These Rules and Regulations are intended to govern the use of the property incorporated within the Anglers Club Association (Common Areas). They are an overview supplement and/or highlight those use restrictions made part of the Association’s Declaration of Covenants and Restrictions.

These rules and regulations have been adopted by the Board of Directors of the Anglers Club Association and are in full force and effect upon publication and distribution to the membership.


A. General Rules – This is an overview of general property rules. A complete list of prohibitive restrictions that all owners have agreed to honor is set forth in Article VIII of the Declaration.

1.  The Common Areas are for the use and enjoyment of members of the Anglers Club (hereafter referred to as Owners), registered Renters and House Guests and their Day Guests, so long as such use is consistent with these Rules and Regulations.

House Guest is defined as any person staying overnight at an Owner’s house with or without the owner in residence. A Day Guest is defined as any person who visits an Owner, Renter or House Guest during the day or evening but not overnight.

2.  Notwithstanding the above, property owners are ultimately responsible for the actions of any and all Family Members, House Guests, Renters or Day Guests that occupy their home or visit the community.

3.  Except as permitted by the Anglers Club Association, no commercial advertisements shall be posted or circulated in or on the Common Areas, nor shall solicitations of any kind be made on Common Areas.

4.  Vehicles are to be parked in driveways or garages or in Common Area parking areas. Boat trailers, recreational vehicles, commercial vehicles, mobile homes and vehicles are not allowed to park on the roads or Common Areas except with prior approval from the Association. Violators will be towed.

Explanation: Roadways must be kept clear for emergency vehicles. Vacant lots are privately owned and the owners have not authorized parking on their property. Violators will be towed.

5.  Absolutely no fireworks are permitted on any Common Areas, unless they are part of a fireworks display organized and conducted or otherwise approved in advance by the Association.

Explanation: Fireworks are a fire hazard and dangerous if not handled properly.

6.  Dogs are to be kept on a leash at all times while on Common Areas. An owner of a dog is responsible for cleaning up after his/her dog(s). Dogs and other pets are not permitted at the Anglers Club Recreation Area. Certain breeds of dogs are specifically prohibited by the Declarations.

Explanation: All “pit bull” breeds are prohibited. For further details refer to Article VIII.G of the Association Declaration of Covenants, Easements and Restrictions.

7.  Personal radios or music systems may only be used on the Common Areas with personal headphones, except in the pool clubhouse when it is reserved and then the sound volume shall not be offensive to other members using the facility.

8.  An Owner, Renter, House Guest and his/her Day Guest(s) may be asked to leave the pool or other Common Areas by a member of the Board of Directors or its designee, including security personnel, if his/her/their deportment or appearance is in violation of these Rules and Regulations or is otherwise inappropriate.

9.  The Board of Directors of the Anglers Club Associations reserves the right to amend or modify these Rules and Regulations when necessary and will notify all Owners of any changes.

B. Loss, Destruction of Property, Personal Injury

1.  Each Owner, Renter, House Guest and each of his/her Day Guests, as a condition of use of the Common Area facilities, assumes sole responsibility for any loss or damage to any private property used or stored on or at the Common Areas.

2.  No person shall remove from the Common Areas any property or fixtures belonging to the Anglers Club Association without expressed written authorization from the Anglers Club Association.

3.  An Owner, Renter or House Guest, and each of his/her Day Guest(s) using the Common Areas shall be liable for any property damage caused by him/her or his/her Day Guest(s) and any personal injury to him/her or his/her Day Guests while at the Common Areas.

4.  Any Owner, Renter or House Guest and each of his/her Day Guest(s), or any other person who in any manner makes use of or accepts use of any apparatus, appliance, facility, privilege or service whatsoever owned, leased or operated by the Anglers Club Association, or who engages in any contest, game, function, exercise, competition or other activity operated, organized, arranged or otherwise authorized by the Anglers Club Association, shall do so at his or her own risk and shall hold the Anglers Club Association, its Directors and Officers harmless from any loss, cost, claim, injury, damage or liability.

5.  Should any party bound by these Rules and Regulations bring suit against the Anglers Club Association, its Directors or Officers in connection with any event operated, organized, arranged or otherwise authorized by the Anglers club Association and fail to obtain judgment therein against the Anglers Club Association, its Directors or Officers, the said party shall be liable to the Anglers Club Association its Directors and Officers for all costs and expenses incurred in defense of such suit.

C. Use of Common Areas

1.  The Common Areas are for the private use and enjoyment of the Owners, Renters or House Guests. An Owner, Renter or House Guest must accompany Day Guests who are using Common Area amenities.

2.  Anglers Club streets and walkways are private property and for the exclusive use of Association members and guests.

Explanation: This is a private, gated community.

3.  The Angler’s Club clubhouse may be reserved by an Owner for a private party or other function which party or function excludes other Owners, subject to the approval of the Association Board of Directors.

Explanation: If an owner would like to reserve the clubhouse, please refer to the Clubhouse Use Policy under the Information section on the website.

D.  Pool Facilities

1.  Use at any time of the Anglers Club pool facilities is at the Owner’s, Renter’s, House Guest’s and their Day Guests own risk.

2.  Swimming is permitted only during daylight hours.

3.  Showers are required before entering the pool.

4.  All swimmers must wear appropriate swimming attire. Cut-offs, jeans and Bermuda shorts are not considered acceptable swimwear.

5.  Glass containers or sharp objects of any kind are strictly prohibited at the pool or beach facilities.

6.  Running, ball playing, noisy or hazardous activity is strictly prohibited. Pushing, dunking and dangerous games are also strictly prohibited.

7.  Children in diapers are not allowed in the pool at any time

8.  Additional rules, which must be observed, may be posted at the pool.

Explanation: State of Florida and Charlotte County required rules. Violation of State and local Health Department rules could cause the pool to be closed by those authorities.

E.  Trash Disposal

1.  Animal proof, clean containers in good repair and specifically manufactured for trash removal shall be provided by the Association for curbside trash disposal.

2.  Curbside trash pick-up is available every Wednesday. Lawn waste and recyclable materials are also picked up every Wednesday.

3.  Do Not Put The Garbage Can Out By The Road.

The Association has made arrangements with Charlotte County Waste Management to have their drivers go under the house area to get the cans, empty them, and put them back under the house.

Please leave the garbage can in the area under the house that is closest to the street. The main thing to remember is that the location of the can must not be blocked in by a vehicle or boat, etc. The Waste Management people must have a clear path to roll the can from the garage area to their truck and back. If there is not a clear path the can will not be emptied.

F.  Rental Rules

1.  PARKING. Ample parking is provided at each unit. Extra vehicles must be parked so as not to obstruct other Owners and Guests from entering their units or the complex. No motor homes, boats or trailers are allowed on site unless they can be parked in the driveway of your applicable unit. Please make arrangements for parking these vehicles off premises prior to your arrival. Violators will be towed.

2.  GOLF CARTS. Children under the age of 18 are not permitted to use golf carts on the Angler’s Club property.

3.  PETS. Pets are not allowed at any time unless specifically pre-arranged with the unit owner and shall be kept in a manner so as not to constitute a nuisance to others.

Explanation: No “pit bull” breeds are allowed on property.

4.  POOL. Rules have been posted at the pool for your safety. Please read and observe them. Containers and drinking glasses made of glass are not to be taken to the pool area. Personal belongings, toys, towels, etc. should not be left at the pool overnight. No pets are permitted in the pool area.

Explanation: Posted rules have been established by State and County Health Departments. Violation of the State and local Health Department rules could cause the pool to be closed by those authorities.

5.  TRASH. Trashcans and recycling bins are provided under each unit. Place all garbage in sealed plastic bags. Trash pick-up is on Wednesday.

6.  PERSONAL BELONGINGS. Please keep all personal belongings inside the unit. Clothes, towels, bathing suits, etc. cannot be hung over balconies or railings.

7.  FIRES. No open fires are allowed on the property except at the designated fire pit. No trash, garbage or other refuse shall be left in any of the amenity areas. Glassware, bottles and similar breakable containers are not permitted around any of the amenity areas.

Explanation: Common sense, safety and respect for others who use the amenity areas.

8.  OUTDOOR COOKING. This can present a serious fire hazard! No barbecue grills are to be used on screened porches or entry porches. They may be used and maintained on the ground level, but never underneath a unit. Used charcoal should be disposed of safely and deposited with the trash.

Explanation: The townhomes are wooden structures. The Charlotte County Fire Code prohibits ANY open flame on decks and structures where there is a ceiling above the open flame.

9.  DOCKS. The Association is required to adhere to strict rules regarding the use of the docks in front of the town homes. The dock rules are attached hereto and must be followed closely and without deviation.

10.  Any use of the property that would be considered a nuisance by surrounding guests and owners, such as party noise, loud TV or radios, immoral behavior, etc. will not be tolerated. We must ask you to leave the community if you don’t comply with these basic rules.


G. Boat Basin

In order for the developer to establish Anglers Club, certain concessions, agreements and commitments were entered into with Gasparilla Marina. The Anglers Club docks are located within a boat basin that is owned and operated by Gasparilla Marina. The use of our docks is subject to the Rules of the Basin as established by Gasparilla Marina. Failure of our owners and/or guests to abide by the rules set forth herein could cause a breach of our agreement with the marina and our loss of use rights in the boat basin.

1.  The boat spaces are intended for the use of owners, renters and guests only. To ensure dock spaces are being used only by owners, renters or guests, each boat moored at the dock must have a registration number prominently displayed so it can easily be read from the dock. Registration number must be on file in the management office.

Explanation: The registration number is the number assigned by each state that is required to be clearly posted on the starboard and port side of the boat’s bow. The common dock belongs to the Association. If there is a problem with a boat, we need to know who the boat belongs to and in which unit the boat owner is staying. If a boat is not registered, it may be towed.

2.  If necessary, in the future a waiting list and procedures will be established for boaters who are unable to secure a boat space.

3.  Only one boat per property is allowed to be moored at the common dock.

4.  An owner, renter or guest must be in residence if their boat is moored at the common dock. If the boat owner is not in residence, the boat may not be kept or moored at the dock.

The docks are for transient use and not for boat storage. Boat owners must be in residence to be able to take care of their boat and address any concerns of safety or damage.

5. Live-aboards shall not be permitted (non-competition agreement with Gasparilla Marina.)
