General Terms & Conditions

Bid Deadline

Bids for Tires, Tubes, and Related Services to be purchased by members of the Community, University and Education Purchasing Association, hereafter referred to as CUE, must be returned to Andy Roth, Contract Administrator, c/o The University of Akron, Department of Purchasing, Delivery Address - 100 Lincoln Street, Akron, Ohio 44325-9001, Mailing Address – 302 Buchtel Common, Akron, OH 44325-9001 before 12:00 noon, November 7, 2006. At that time, the bids will be publicly opened. Bids are to be sealed and marked: "CUE TIRES, TUBES AND RELATED SERVICES."

Supply Period

Tires, Tubes and Related Services are being bid for a period of one year; from 01/01/2007 through 12/31/2007 with an option to renew said contract for two additional years, one year at a time, upon mutual agreement of both parties.

Deliveries

Delivery shall be no later than seven days after the receipt of order for tires and tubes and immediate response is required for related services (i.e.- road service). See Section 1, "STANDARD TERMS AND CONDITIONS", PARAGRAPH 17. DELIVERY/FREIGHT CHARGES (roster of CUE Members is attached).

Quantities - more or less

The CUE does not obligate itself to purchase the full quantities indicated. Even so, the entire amount of any discount offered must be allowed, whether or not the purchases are less than the full quantities indicated. On the other hand, the CUE unit requirements may exceed the quantities shown and the vendor shall be obligated to fulfill all requirements from purchase orders with mailing dates falling within the term of an awarded contract.

Disqualification of Bidders

Bidders may be disqualified and their bids rejected for any of (but not limited to) the following causes:

1. Failure to complete the Form of Proposal as supplied.

2. Lack of signature by an authorized representative on the Form of Proposal.

3. Unauthorized alteration of the Form of Proposal.

Any actual or potential bidder, provider or contractor who is allegedly aggrieved in connection with the solicitation or award of a contract may protest. The protest must be submitted in writing to the CUE Tire Bid Chairman, within seven (7) days after such aggrieved person knows or should have known of the facts giving rise thereto. If the protest is not resolved by mutual agreement, the CUE Chairman will promptly issue a decision in writing to the Protestant and any other party intervening. If the Protestant wishes to appeal the decision rendered by the CUE Chairman, such appeal must be made to the CUE Steering Committee, through the CUE Chairman. The decision of the Steering Committee will be final. The Steering Committee need not consider protests unless this procedure is followed.

FORM OF PROPOSAL

The undersigned Bidder hereby declares and agrees to furnish tires and tubes in accordance with all the terms, conditions and requirements as specified within this request for proposal and Bidder certifies that all products offered meet or exceed Ohio Specification 3313.46.

Prices quoted are FOB Destination as specified on CUE members' purchase orders. Each supplier responding to this RFP must show pricing as a discount off of the manufacturer's published price list.

NEW TIRES: The following is a listing of generic types of tires. All tires bid must be of O.E.M. or better grade quality.

Prices offered are for black side-walled tires. Please indicate if there is an additional charge for white side-walled tires (if available).
