1.  This permit application is for a banquet hall in the M-X-T Zone. The applicant must submit in writing in detail how this use will operate. Please note – a restaurant serves food on non-disposable table ware and has incidental carryout service where the area use for carryout service does not exceed 5% of the total patron seating area or 80 s.f. whichever is less. A banquet hall is not a use listed in the use table of the Zoning Ordinance however it is a customarily found accessory use to a restaurant and catering establishment, which also serves food. An auditorium is a building used for public meetings and seated artistic performances and does not include any food service. A dance hall, “go-go”, any events that require a commercial dance license, or artistic performances that include customer participation are all a recreational establishment of a commercial nature (an establishment which provided entertainment, recreation, or amusement for profit). If another individual organizes an event at this facility, with food provided by the applicant, which consists of dancing or other entertainment and this individual charges a fee to attend this event, this is not a restaurant/catering establishment/or auditorium, it is a recreational establishment of a commercial nature. The written document must be very specific as to whether there will be any form of adult-oriented entertainment/performances (topless dancing, lap dances, topless waitresses). Please include the hours of operation for this facility. The correct use will be determined once the applicant has clearly indicated how this proposed use will operate. 3/9/09 – Per detailed letter detailing how this use will operate it was determined that this use will be a recreational establishment of a commercial nature with no adult entertainment or performances.

2.  Per Sec. 27-546(a) of the Prince George’s County Zoning Ordinance a Conceptual Site Plan and a Detailed Site Plan shall be approved for all uses and improvements, in accordance with part 3, Division 9 of this Subtitle. A letter from Susan Shields, Supervisor, permit Review Section dated 12/2/98 to Fern Piret, Planning Director and Mike Petrenko, Deputy Planning Director stating that Section 27-546 of the Zoning Ordinance applies to new, proposed development versus the use of existing nonconforming buildings or structures. The specific M-X-T site plan requirements were established to govern “proposed development,” “proposed floor area ratio,” and “improvements and uses proposed.” Section 27-108.01(a)(13)(A) of the Zoning Ordinance, interpretations and rules of construction, states (A) “And indicates that all the connected items shall apply;” which is not the case in this situation. It was determined in a meeting on 3/4/09 with Debbie Gallagher, Mary Hampton Chiddy Umeozulu, Fern Piret, Rana Hightower and Andre Green that no CSD & DSP would be required for a change in use only until subsequent legislation indicates different.

3.  This site was approved as an integrated shopping center. An integrated shopping center is defined in Section 27-107.01(208) as a group of three (3) or more) retail stores planned and developed under a uniform development scheme and served by common and immediate off-street parking and loading facilities. Please confirm whether this facility has (3) retail uses. If not an updated parking and loading schedule must be submitted that demonstrates all uses on the property by address or unit number, the square footage of each use, the parking and loading spaces required for each use, and the parking and loading provided for each use. Vacant units must be included in the schedule and can be listed as “vacant”. 3/9/09 – Per the applicant, Mr. Everett, the (3) retail uses are Modern Floors and Carpeting, Sarah’s Beauty Supply and East Coast Pawn Shop.
