Chairman Gary Harvey opened the meeting at 6:00 PM.
Approval of Minutes:
Minutes of the November 18,2015 meeting were reviewed. Ms. Garafalomade a motion to approve as written, seconded by Ms. Daly

NEW BUSINESS: OPENING OF PUBLIC HEARING
Public Hearing Opens Area Variance V-6-2015Joan Pine 680 Embought Road,Catskill.
Chairman Gary Harvey opened the Public Hearing for Area Variance V-6-2015Joan PineEmbought Road, Catskill.The Notice of Public Hearing was published in the Daily Mail on January 7, 2016 and January 8, 2016.
NOTICE OF PUBLIC HEARING
The Town of Catskill Zoning Board of Appeals will hold a Public Hearing
pursuant to Article160-10 (E)of the Town of Catskill Zoning Laws to allowConstruction of a pool house owned by Joan Pine located atEmbought Road, Catskill NY 12414ApplicationArea VarianceV-6-2015Tax Map #172.1-7.2The Public Hearing will be held on the 13th day ofJanuary at 6:00 PM ,at the Town Hall located at 439-441 Main Street, Catskill, NY.to allow public comment on the above application is open for inspection at the Office of the Zoning Board of Appeals located at 439 Main Street, Catskill, New York between the hours of 8:00 a.m. and 4:00 p.m. By order of Gary Harvey Chairman, ZoningBoard of Appeals, Town of Catskill.
The applicant submitted the green cards from the certified mailing.
The Board had made a site visit.
Michael Fanelli is the contractor for this project. Mr. Fanelli gave a brief presentation on the proposed project .
Edward Marshall owns property adjacent to the site. Mr. Marshall asked if the project will be a commercial use .
Mr. Fanelli answered “NO”. This is not for a commercial use; it is for the resident to use as a therapy pool.
Mr. Marshall asked how this could affect the water in the area.
Mr. Fanelli answered the water will be filled by a water company.
Mr. Harvey asked if there were any other questions or comments regarding V-6-2015.
There were no additional questions or comments.
Mrs. Garafalomade a motion to close the Public Hearing for V-6-2015, seconded by Ms. Zubris.
Ayes, 5 Nays, 0 Absent, 0 Motion Carried.
Mr. Harvey thanked everyone who attended for the Public Hearing.

Chairman Gary Harvey opened the Public Hearing for Area Variance V-7-20154350 Rt.Catskill.The Notice of Public Hearing was published in the Daily Mail on January 7, 2016 and January 8 2016.

Mr. Deily is an attorney representing the applicant at this night’s meeting. Mr. Deily gave a brief description of the proposed project.
Mr. Harvey asked if there were any questions or comments regarding V-7-2015.
Mrs. Garafalo made a motion to close the Public Hearing for V-6-2015, seconded by Ms. Lange.
Ayes, 5 Nays, 0 Absent, 0 Motion Carried.

Public Hearing Closed at 6:09 PM.
Area Variance V-1-2016Michael Kohl 45 Beck Rd., Catskill.
The applicant was not able to attend this nights meeting but was being represented by an associate Chris Rogers. The applicant has submitted an application along with a sketch plan and a letter authorizing for Mr. Rogers to represent him.
The Board reviewed the plans.
Mr. Rogers stated the applicant is would like to construct a 30’ X 30’ garage with an attic.
Mr. Harvey asked why the applicant can not build behind the dwelling.
Mr. Rogers answered because of the topography.There is a drop of behind the house.
Mr. Harvey asked what is the distance from the roadway to the site where the garage is proposed to be constructed.
Mr. Rogers answered he is not sure.
Mr. Harvey asked if the site is staked out.
Mr. Rogers answered “Yes”. it is staked out with ribbons.
Mr. Harvey asked how much road frontage is there along Becks Road.
Mr. Rogers answered he was not sure.
Mr. Harvey stated the Board will be making a site visit .Also the application will require a 239 Review from the County.
Mr. Harvey stated the Town of Cairo will have to be informed about the Public Hearing. The Board will need to see the foot print of the building on a revised site plan showing the property line and the dimension for the structure in relation to the roadway.
OLD BUSINESS:
Opens Area Variance V-6-2015 Joan Pine 680 Embought Road, Catskill.
The Board reviewed the Findings and Decisions with all answers’ being “No”.
Ms. Lange made a motion to accept the application for V-6-2015 as complete, seconded
by Ms. Zubris.

OTHER BUSINESS:
The Board has received a question from the CEO regarding the definition of a rear lot line.
Mr. Harvey stated the Board would like for the CEO to apply for an interpretation regarding this matter.
Informational - Interpretation to Appeal- Stella Martin
Mr. Harvey asked if the Board members had a chance to review the correspondence regarding this matter. In response to the letter from the Ms.” Martin’s attorney, it appears that the CEO has requested that the Ms. “Martin’s attorney contact the CEO in order to discuss the violation. The Board will be tabling this matter until the Board receives notification from Ms. Martins Attorney or the CEO.
Ms. Daily stated the request would consider an Interpretation. The Zoning Board would be interpreting for the administrative official. This matter will have to be reviewed by the TownAttorney
