MINUTES OF JULY 7, 2009

The Tewksbury Township Board of Health met in regular session at 7:30 P.M. on the above date, in the Mountainville Meeting Hall, 60 Water Street, Mountainville, NJ.

Chairman Peter Goyer presided.

Other members present were Shirley Czajkowski , Janet Masterton and alternate Richard Mahevich.

Anthony Formica, Anthony Miele and alternate Zia Shey were not present.

1.  Open Public Meetings Statement

The Open Public Meetings Statement was read by Mr. Goyer.

2. Action to be Taken

Block 5 Lot 1.02

Bob Lorentz Vice President of Heritage Consulting Engineers presented plans and information for a malfunctioning septic system located at 23 Beavers Road. The existing system was found to be malfunctioning, the tank had collapsed and the laterals were non functional on this 67 year old system.

Mr. Lorentz explained that due to the physical constraints of the property and the location of the well, the septic was forced to be located in one area of property, which is the same location as parts of the existing system.

It was noted that successful soil testing was achieved, and based on initial testing, it was thought that an artesian condition existed.

Discussion followed regarding the level at which the water stabilized during testing.

Mr. Lorentz noted that he just received the analysis from the original testing and the testing revealed that an artesian condition did not exist and the soil samples were classed as K3 permeability.

It was noted that the system will be constructed at the original depth in order to achieve gravity flow: the new sewer line will be located near the new tank.

As a safeguard, the design will include a 45 ml PVC curtain drain lining along the disposal bed side to a depth of 5 feet.

A letter from the HCDOH was discussed and the following items were noted.

·  An interceptor drain will be installed since the drain will be only 10 feet from the proposed disposal bed.

·  A curtain drain will be installed as outlined above.

·  The drain depth will be at 60 inches which would be below the hydraulically restricted horizons.

·  The drain outlet is located 10’ from the Beavers Road right of way, but the drainage will be onto the applicant’s property. It was suggested that Mr. Lorentz contact the Township Engineer and Superintendent of Public Works to notify them of the matter.

Mr. Kenyon noted that the property has two driveways and the drains are located above the driveway.

In response to a question by Mr. Goyer, Mr. Lorentz started that the area under discussion for the system is the most appropriate location for the system because of the grade of the property and the location of the well. He added that in order to maintain the 100 foot distance, a large area of the property would be eliminated for siting the system. He added that altering the location of the system could entail having a pump up system and would require routing around the house and uphill for approximately 200-300 feet.

In response to a question by Ms. Masterton, it was noted that the area behind the house is open field/pasture and the proscribed road setback is 30 feet.

In response to a question by Mrs. Czajkowski, Mr. Lorentz noted that the house is a three bedroom house and the number of bedrooms will not change.

Further discussion followed regarding the complicated artesian condition and the time and conditions at which testing was performed.

Mrs. Vaccarella noted parameters related to wet and dry season sampling.

Mr. Lorentz opined that this system will be the best system for the property and the conditions. He added that this system will function properly on the property.

An extra 2 feet of select fill will be utilized to reach the depth of permeable material.

In light of the property constraints, Mr. Goyer made a motion to accept the Engineer’s design for a curtain drain to be located 10 feet from the disposal bed utilizing 45 ml PVC liner along the disposal bed side of the drain; additionally the depth of the drain to be situated at the depth of 60 inches which will be below the hydraulically restrictive horizon was approved, seconded by Ms. Masterton. The motion was approved. Ayes: Czajkowski, Goyer, Mahevich, Masterton. Nays: none. Absent: Formica, Miele, Shey.

Mr. Lorentz stated that he would advise the Township Engineer and Superintendent of Public Works regarding the location of the drain outlet.

Block 11 Lot 22.03

Judith Kleiner presented well information and water testing results related to the property located at 586 Califon Cokesbury Road.

Doug Fine stated that he inspected the septic system at the property. The septic and pump tanks were pumped and it was verified that they were adequately water tight, monolythic tanks with no seams below the water level. Additional it was determined that there is 88 feet of well casing.

Mr. Goyer made a motion to accept the waiver for the distance from the septic and pump tanks to the existing well for the property located at Block 11 Lot 22.03. The required distance is 50 feet and the septic tank is located 48 feet from the well and the pump tank is located 45 feet from the well.

Ms. Masterton noted that the Board wants to show due diligence with regard to septic repairs adding that the fact that work is sometimes done incorrectly is unfortunate.

She added that the Board prefers to be proactive and the fact that Mrs. Kleiner spent time and money regarding this matter could have been avoided if work had been done correctly.

Discussion followed regarding notifying people concerning individuals or firms that should not be utilized.

Ms. Masterton opined that the need for a waiver was merely because the installer did not correctly measure the distance.

Mr. Fine agreed, adding that it appeared that the tanks were installed in line with the existing delivery line and that the tanks were rotated to accommodate the available space.

The above noted motion was seconded by Ms. Masterton. The motion was approved. Ayes: Czajkowski, Goyer, Mahevich, Masterton. Nays: none. Absent: Formica, Miele, Shey.

Further discussion followed regarding why the system was initially installed in 2007 and it was not noticed until 2009 that final approval was not granted.

Mrs. Vaccarella noted that the HCDOH has sent out over 500 letters regarding deficient applications and have now set up a procedure so this will not happen in the future.

She added that peat systems should be more closely inspected and the engineer and excavator should have worked together more closely.

In response to a comment by Mr. Goyer, Mrs. Kleiner noted that the high lead level noted in the water was taken from an area of the house dating back to the 1700’s. She was waiting to have this waiver approved prior to going to the Construction office for a permit to redo the bathroom and replace the old piping.

Mrs. Vaccarella stated that the HCDOH will move forward with the application and will not create a situation so Mrs. Kleiner cannot move forward with her construction project.

In response to a question by Mr. Mahevich, the history of how this property “slipped through the cracks” was explained.

Mr. Goyer made a motion to adopt the minutes of 06/01/09 with the correction as noted by Mrs. Czajkowski, seconded by Mrs. Czajkowski. The motion was approved. Ayes: Czajkowski, Goyer, Mahevich, Masterton. Nays: none. Absent: Formica, Miele, Shey.

Discussion followed regarding Ms. Masterton’s comments on the matter related to writing a letter to SMG on behalf of Judith Kleiner and the advice of the Township Attorney that the Board should not represent themselves.
